PRESENT: ED PALUCH, KRIS CURRY, JIM HARRIS, HUSTON TRIPP, JOHN CALMES, GREG PALMER, AND ARTHUR MAYER ED PALUCH ANNOUNCED THAT, THIS MEETING WAS CALLED DUE TO SEVERAL COMPLAINTS BEING MADE BY SUB-CONTRACTORS REGARDING UNPAID BILLS, UNLICENSED PERSONS WORKING WITHIN THE CITY, LICENSED SUB-CONTRACTORS WHO ARE NOT RESIDENTS OF THE STATE AND JOBS NOT BEING IDENTIFIED PROPERLY WITHIN THE CITY LIMITS. AFTER A VERY LENGTHY DISCUSSION REGARDING A NOTICE OF COMMENCEMENT, BARBARA DEVANE, SECRETARY, BUILDING OFFICIAL, STATED THAT IT IS A STATE STATUTE THAT A NOTICE OF COMMENCEMENT BE FILED BEFORE ANY CONSTRUCTION CAN BEGIN AND AT THE PRESENT. ~IME THE CITY OF SEBASTIAN DOES NOT ENFORCE THIS PROCEDURE. SHE RECOMMENDED THAT THE FILING OF THE NOTICE WOULD ELIMINATE ALOT OF LIENS BEING PLACED ON PROPERTIES THAT AREN'T EVEN BINDING. SHE ALSO EXPLAINED THAT THE NOTICE OF COMMENCEMENT CAN BE PURCHASED AT ANY LOCAL STATIONARY STORE AND THAT AN ATTORNEY IS NOT NEEDED FOR THE FILING. THE NOTICE CAN HE FILED WITH THE RECORDING CLERK AT THE INDIAN RIVER COUNTY COURT HOUSE FOR APPROXIMATELY $7.00. ED PALUCH.~,STATED THAT THE MAJORITY OF THE PROBLEMS ARE OCURRING FROM SUB-CONTRACTORS IN THE AREA WHO ARE STARTING JOBS WITHOUT A WRITTEN AGREEMENT. HE FELT THAT THE SUB-CONTRACTORS NEEDED TO BE MADE AWARE OF LIEN PROCEDURES AND WHERE TO BEGIN AS FAR AS PLACING A LIEN ON A JOB. ARTHUR MAYER, BUILDING OFFICIAL, STATED THAT THE CiTY OF SEBASTIAN REQUIRES THAT · THE PERMIT BE POSTED ON THE JOB SiTE AND FELT THAT THE NOTICE OF COMMENCEMENT BE POSTED ALSO. HE STATED THAT COPIES OF THESE DOCUMENTS ARE KEPT IN THE BUILDING DEPARTMENT AND IF A SUB-CONTRACTOR DOES HAVE A PROBLEM WITH PAYMENT HE WILL BE.7~ ABLE TO OBTAIN THIS LEGAL INFORMATION AND PREPARE TO FILE I~OR A LIEN. MOTION BY HUSTON TRIPP, SECONDED BY GREG P~R, THAT A NOTICE OF COMMENCEMENT BE FILED IN CITY HALL PRIOR TO ISSUING A BUILDING PERMIT. MOTION CARRIED. ED PALUCH STATED THAT THIS WOULD BE EFFECTIVE I~H4EDIATELY AND IF IT' CREATED A HARDSHIP, THE BUILDING OFFICIAL COULD MAKE A DECISION AT THAT TIME. BARBARA DEVANE fS,TATED THAT IT WOULD BE VERY HELPFUL IF THE CONTRACTORS WOULD POST THE LOT NUMBER AND BLOCK NUMEER ON THE JOB SITE, SINCE ALL INFORMATION IN THE BUILDING DEPARTMENT IS FILED IN THIS MANNER. ED PALUCH STATED THAT ARTHUR MAYER, BUILDING OFFICIAL, RECOMMENDED THAT THE SUB-CON- TRACTORS THAT ARE LISTED ON THE BUILDING PERMIT APPLICATION PRIOR TO THE ISSUANCE OF THE BUILDING PERMIT, BE REQUESTED TO COME INTO THE BUILDING DEP;~RTMENT AND INITIAL THE PERMIT APPLICATION, PRIOR TO ANY INSPECTION, VERIFYING THEM AS THE SUB-CONTRACTOR ON THE JOB. - 1 - SEBASTIAN CONSTRUCTION BOARD MEET. ING' ~. -L~ MAR~H 12, 1982.. ARTHUR MAYER EXPLAINED THAT THE PLUMBERS, ELECTRICIANS AND AIR CONDITIONING CONTRACTORS ARE REQUIRED TO FOLLOW THIS PROCEDURE NOW AND THaT IT HAS BEEN WORKING OUT. HE FELT THIS SHOULD BE CONTINUED WITH OTHER PHASES OF SUB-CONTRACTORS, SUCH AS PAINTER, INSULATION, CARPENTRY AND DRYWAY CONTRACTORS. AFTER A BRIEF DISCUSSION, ARTHUR MAYER STATED THAT ONLY ONE INITIAL BUILDING PERMIT iS ~SSUED TO THE GENERAL CONTRACTOR AND AT THAT TIME EACH SUB-CONTRACTOR .SHOULD BE LISTED AS DOING A PARTICULAR PHASE OF THE JOB.' THE PROBLEM ARISES DURING THE COURSE OF THE JOB, WHERE OTHER SUBS ARE PULLED IN TO DO THE WORK, SOME UNLICENSED, AND THEN THERE IS NEVER A RECORD OF WHO ACTUALLY COMPLETED THAT CERTAIN PHASE OF THE WORK. HE FELT IF EVERY SUB-CONTRACCDR iNITIALED THE BUILDING PERMIT APPLICATION ON FILE IN THE BUILDING DEPARTMENT BEFORE THE ~NSPECTION IS DUE, IT WOULD HELP TO KEEP A TIGHTER CON- TROL OF WHO IS ACTUALLY DOING EACH PHASE OF THE JOB. HE STATED THAT IF AN INSPECTION IS CALLED FOR AND THE BUILDING PERMIT APPLICATION IS NOT SIGNED OFF FOR THAT PARTICULAR PHASE OF WORK, AN INSPECTION WILL NOT BE MADE AND THE CONTRACTOR WILL BE CHARGED $5.00 FOR A RE, iNSPECTION. MOTION BY JIM HARRIS, SECONDED BY GREG PALMER, THAT ALL SUB-CONTRACTORS MUST INITIAL THE ~PLICATION IN CITY HALL BEFORE INSPECTION. MOTION CARRIED. FRANK OBERBECK, CONTRACTOR, RECOMMENDED THAT LICENSES SHOULD BE ISSUED TO EVERY CON- TRACTOR IN THE CITY REGARDLESS OF WHAT THE TRADE IS. HE FELT THIS WOULD3OONTROL AND PRO- VIDE MORE WORK FOR THE SUB-CONTRACTORS IN THE COMMUNITY. HE SUGGESTED THAT ALL TRADES ON A JOB SHOULD BE REQUIRED TO PROVIDE SOME FORM OF INDENTIFICATION REGARDING THEIR QUALIFICATIONS. MR. PALUCH STATED THAT AT THE PRESENT TIME EACH PERSON IS REQUIRED TO HAVE A CITY OCCUPATIONAL LICENSE AND THAT A NON-TESTED LICENSE IS KNOWN Ag A SPECIALTY LICENSE. MOTION BY HUSTON TRIPP , SECONDED BY JOHN CALMES , THAT WE LICENSE ALL SUB-CONTRACTORS PERTAINING TO CONSTRUCTION FROM START TO FINISH. ED PALUCH STATED THAT EVERY SPECIALTY SUB-CONTRACTOR WILL HAVE TO PROVIDE PROOF OF LIABILITY INSURANCE AND D~)CUMENTATION!]fNDICATING THAT THEY HAVE THE ABILITY TO DO THE JOB. HE REMARKED THAT TESTING OR CERTIFICATION OF .COMPETENCY WILL NOT BE NECESSARY. ED PALUCH RECOMMENDED THAT THE FEE FOR THESE SPECIALTY LICENSES AND REES FOR OTHER COMPETENCY LICENSES BE REDUCED. MOTION BY HUSTON TRIPP, SECONDED BY JOHN CALMES, THAT WE LICENSE ALL SUE-CONTRACTORS THAT PERTAIN TO CONSTRUCTION FROM START TO FINISH, TURN KEY OPERATION. MOTION CARRIED. ED PALUCH STATED THAT THIS WOULD BE EFFECTIVE IMMEDIATELY AND IF IT CREATED A HARDSHIP ON ANYONE THAT WE COULD NEGOTIATE ON A ONE PO ONE BASIS. - 2 - SEBASTIAN CONSTRUCTION BOARD MEETING - HAR6~ 12, 1982 AFTER A VERY LENGTHY DISCUSSION REG~RDING OWNER BUILDERS, ED PALUC~ STATED THAT THE PROBLEM IS WIT~ OWNER BUILDERS RETURNING UP NORTH AFTER ALL THE NECESSARY PAPER WORK HAS BEEN ARRANGED TO' START CONSTRUCTION AND ALL WORK IS SUBED OUT. HE FELT THEY SHOULD BE ON THE JOB SITE ~0 OVER SEE THE C~NSTRUCTION AND NOT LEAVE ALL OF THE RESPONSIBILITY ON THE SUB-CONTRACTORS. HUSTON TRIPP RECOMMENDED THAT THE OWNER BUILDER BE ON THE JOB SITE WHEN AN INSPECTION IS TO BE MADE. MOTION BY HUSTON TRIPP, SECONDED BY JOHN CALMES, THAT THE OWNER BUILDER BE PRESENT FOR ALL .INSPECTIONS. MOTION AMENDED BY HUSTON TRIPP, SECONDED BY JOHN CALMES, THAT W~ ALSO REQUIRE THE OWNER BUILDER TO BE PRESENT ~ND WORKING ON ANY PHASE THAT HE HAS S2~iD HE WOULD DO HIMSELF. MOTION CARRIED. A DISCUSSION FOLLOWED REGARDING THE REQUIREFIENT OF PERMITTED TRADES TO BE SUBED OUT TO LICENSED CONTRACTORS. ED PALUCH EXPLAINED THAT AN OWNER BUILDER CAN DO PERMITTED TRA~ES SUCH AS, ELECTRICAL, PLUMING OR AIR CONDITIONING IF HE IS COMPETENT? HUSTON TRIPP RECOMMENDED THAT THE CONSTRUCTION BOARD HOLD A MONTHLY MEETING TO REVIEW THE QUALiFiCATiONS OF ANY OWNER BUILDER WISHING TO DO A PERMITTED TRADE HIMSELF BEFORE A BUILDING PERMIT IS ISSUED. ED PALUCH STATED THAT IF AN OWNER?BUILDER CANNOT PROVE COMPETENCY TO THE SATISFACTION OF THE BOARD THE ONLY RECOURSE HE WILL HAVE IS TO TAKE A BLOCK EXAM TEST. ARTHUR MAYER FELT IT WASN,T NECESSARY FOR OWNER BUILDERS TO MEET WITH THE BOARD FOR SPECIALTY TRADES. MOTION BY HUSTON TRIPP, SECONDED BY GREG PALMER, THAT BEFORE AN OWNER BUILDER IS ALLOWED TO PULL A PERMIT THAT HE MEET WITH THE BOARD TO PROVE HIS COMPETENCY FOR ANY STRUCTURAL AND PERMITTING PHASE THAT IS NOT SUBED OUT TO LICENSED SUB-CONTRACTORS. MOTION CARRIED. THE BOARD AGREED TO ~EET ON EVERY FIRST TUESDAY OF EACH MONTH AT 3:00 P.M., IN CITY HALL AND ,-REQUESTED THAT EACH MEMBER BE NOTIFIED BY MAIL A~-FEW DAYS BEFORE TO CON- FIRM EACH MEETING. ED PALUCH sTATED THAT THE SUB-CONTRACTORS AND CONTRACTORS IN THE COMMUNITY ARE UN- FAMILIAR WITH THE CURRENT LIEN LAWS._73-HKVFELT MORE CONTRACTORS AND SUB-CONTRACTORS SHOULD .BE MADE AWARE OF THE~iLIEN LAWS AND PROCEDURES AND THAT IT WOULD HELP TO ELIMIN- ATE ALOT OF PROBLEMS. HE RECOMMENDED THAT A SEMINAR BE HELD ~ND TO HIRE, AN ATTORNEY TO SPEAK ON THE SUBZ~ECT OF MECHANIC LIEN LAWS & PROCEDURES. AFTER A BRIEF DISCUSSION IT WAS DECIDED THAT THE SEMINAR WOULD BE HELDTAT THE SEBASTIAI~ COMMUNITY CE~TERAND THAT A DONATION WAS SET FOR $5.00 PER PERSON TO COVER THE COST. THE BOARD HOPED TO HAVE ATLEAST 100 PERSONS ATTENDING. - 3 - SEBASTIAN CONSTRUCTION BOARD .MEETING MARCH12~ 1982 ANOTHER PROBLEM BROUGHT UP WAS REGARDING MECHANICS WORKING ON A JOB WITHOUT A FLORIDA STATE LICENSE PLATE OR FLORIDA DRIVERS LICENSE. ED PAAUCH STATED THAT HE WAS AWARE OF THE FACT THAT CONTRACTORS IN THE AREA ARE HIRING THESE sUBs WITHOUT A VALID LICENSE PLATE OR DRIVERS LICENSE AND RECOMHENDED THAT THEY CHECK INTO THIS FURTHER. ED PALUCH RECOMMENDED THAT NO LICENSE BE ISSUED TO ANYONE UNLESS PROOF OF RESIDENCY IS PRESENTED. HE FELT A DRIVERS LICENSE, VEHICLE REGISTRATION OR A VOTERS REGISTRATION CARD WOULD BE ADEQUATE. MOTION BY KRI$3'CURRY, SECONDED BY JOHN CALMES, THAT THE BOARD REQUIRE BEFORE ISSUANCE OF ANY COMPETENCY LICENSE WITH THE CITY, THAT THE APPLICANT PRESENT A VALID FLORIDA DRIVERS LICENSE, .gUEHI~LE~%.REGISTRATION OR VOTERS REGISTRATION. MOTION CARRIED. ED PALUCH REQUESTED THAT A LETTER BE SENT TO ALL THOSE LICENSEES WHO ARE NOT FLORIDA RESIDENTS, INDICATING THAT THEY PRESENT THIS PROOF WITHIN 10 DAYS OR THEIR LICENSE WILL BE ED'3PALUCH ANNOUNCED THAT THE NEXT REGULAR CONSTRUCTION BOARD MEETING WI_LL...BE._'_HELD ON APRIL~, 1982, AT 3:00 P.M., IN CITY HALL.
