7:30 P.M.

APPROVAL OF MINUTES
MOTION BY MR. CAPP, SECONDED BY MR. NEUBERGER TO ACCEPT THE
MINUTES OF REGULAR MEETING HELD 2/13/90 AS WRITTEN.
CARRIED.
ACTING CHAIRMAN DERNBACH ASKED THAT FOR ECONOMICAL REASONS
THAT THE MATTER OF MERCEDES HOMES BE MOVED UP ON THE AGENDA.
MR. COOPER ADVISED THE BOARD THAT HE HAD MADE THE REQUEST
SINCE MERCEDES HOMES WAS NOT PRESENT AT THE MEETING AND THERE
WAS SPECIAL LEGAL COUNCIL REPRESENTING THE CITY.
MOTION BY MR. CAPP, SECONDED BY MR. NEUBERGER TO BRING UP THE
COMPLAINT AGAINST MERCEDES HOMES AT THiS TIME.
CARRIED.
MR, COOPER TOLD THE BOARD THAT MERCEDES HOMES WAS BEING
BROUGHT BEFORE THE BOARD AT THE BOARD'S REQUEST CONCERNING
THE ACTIONS TAKEN PLACE AT 742 CAPON TERRACE WHERE THEY WERE
CONSTRUCTING A SINGLE FAMILY HOUSE.
ON 2/4/90 MR. COOPER WAS ADVISED OF A COLLAPSED STRUCTURE AT
742 CAPON TERRACE DUE TO THE LACK OF BRACING.
MR. COOPER TALKED TO MICHAEL WALSH, ONE OF THE FRAMING CREW
WHO STATED THAT HE WORKED FOR MERCEDES.

THE APPLICATION SHOWED RICHARD VAETH AS THE CARPENTER.
MERCEDES HOMES WAS NOTIFIED AT THE TIME OF THE ISSUANCE OF
THE PERMIT THAT MR. VAETH WAS NOT LICENSED.
TALKING TO TWO SUPERVISORS FROM MERCEDES HOMES, BOTH
CONCURRED THAT MR. VAETH WAS THE SUB-CONTRACTOR ON THIS JOB
AND TWO OTHER JOBS. THIS WAS CONFIRMED BY THE MELBOURNE
OFFICE.
MR. COOPER NOTED THAT THIS MATTER DID NOT CONCERN THE
COLLAPSED STRUCTURE BUT THE USE OF MR. VAETH WHEN MERCEDES
HAD BEEN NOTIFIED THAT HE WAS NOT LICENSED IN THE CITY OF
SEBASTIAN.
MR. COOPER INTRODUCED ATTORNEY TSAMOUTALES.
ATTORNEY TSAMOUTALES SAID THAT THERE WAS NOT MUCH THE BOARD
COULD DO UNDER THE PRESENT CODE.
MR. COOPER STATED THAT UNDER THE NEW ORDINANCE GOING BEFORE
CITY COUNCIL, THAT WE COULD WITHHOLD PERMITS FROM A CERTIFIED
CONTRACTOR.
ACTING CHAIRMAN DERNBACH ASKED IF ANYONE FROM MERCEDES HOMES
WOULD LIKE SPEAK. HE ASKED THAT THE RECORD SHOW THAT NO ONE
CAME FORWARD.
ACTING CHAIRMAN DERNBACH SUGGESTED THAT THE BOARD DO A
FINDING OF FACT AND FORWARD IT TO DPR.
MOTION BY MR. CAPP, SECONDED BY MR. HANEY THAT THE BOARD HAS
FOUND MERCEDES HOMES ARE IN VIOLATION OF SEC. 7-100, SUB-
PARAGRAPH B, (1), (2) AND (3).
A BRIEF DISCUSSION FOLLOWED.
MR. HANEY WITHDREW HIS SECOND, MR. CAPP WITHDREW HIS MOTION.
MOTION BY MR. CAPP, SECONDED BY MR. HANEY THAT THE BOARD HAS
FOUND MERCEDES HOMES IN VIOLATION OF SECTION OF THE ORDINANCE
7-100, SUB-PARAGRAPH B, (1), (2) AND (3). IT IS ALSO NOTED
THAT THIS THEIR SECOND VIOLATION OF THIS ORDINANCE. IT WAS
VIOLATED APPROXIMATELY A YEAR AGO WITH A GEORGE FLETCHER AS
THE SUBJECT IN THAT CASE.

IT WAS NOTED THAT MR. VAETH WAS SUPPOSE TO HAVE BEEN AT THE
MEETING, BUT DUE TO THE OVERSIGHT OF THE BOARD SECRETARY WAS
NOT NOTIFIED. ONCE AGAIN A REQUEST WAS MADE THAT HE BE
NOTIFIED TO APPEAR BEFORE THE BOARD AT THEIR APRIL MEETING.
AT THIS TIME, ATTORNEY WAS EXCUSED~FROM THE MEETING.
OLD BUSINESS:
DEFINITION OF ROOFING LIMITED
THE BOARD SECRETARY EXPLAINED THAT DUE TO HAVING PROBLEMS
WITH THE TAPE RECORDER AT THE FEBRUARY 13TH MEETING, SHE WAS
UNABLE TO GET ALL OF THE MOTION MADE BY MR. CAPP. SHE
REQUESTED HE WRITE IT DOWN AND BRING IT BACK TO THE BOARD FOR
A NEW MOTION. .~
MOTION BY MR. CAPP, SECONDED BY MR. KELLEY THAT LIMITED
ROOFING CONTRACTORS ARE QUALIFIED TO INSTALL, REPAIR AND
REPLACE ASPHALT AND FIBER GLASS SHINGLES, WOOD SHAKE AND
ASPHALT ROLL ROOFING INCLUDING FABRICATION AND INSTALLATION
OF SHEET METAL INCIDENTAL TO ROOFING'ON RESIDENTIAL OR
COMMERCIAL ROOFS. THIS IS NOT TO iNCLUDE TORCH DOWN ROLL
ROOFING OR ANY HOT WORK.

ON 2/22/90, ROBERT VETA, GREAT LAKES DRYWALL RENEWED HIS
LICENSE WITH THE CITY OF SEBASTIAN. PRIOR TO THIS, BOTH HE
AND MR. VETA ASSUMED HE (VETA) WAS LICENSED.
MR. HANEY ASKED THAT MR. VETA APPEAR BEFORE THE BOARD.

SECRETARY STATING THAT HE WAS UNABLE TO ATTEND.
MOTION BY MR. HANEY, SECONDED BY MR. CAPP TO AGAIN CONTACT
MR. VETA TO APPEAR IN FRONT OF THE CONSTRUCTION BOARD
CONCERNING THIS MATTER AT THE NEXT SCHEDULED MEETING AND THAT
TO BRING IN ANY RECORDS CONCERNING THE TWO EMPLOYEES, MR.
MACINTYRE AND MR. TANNER WHO WERE ON THE JOB SITE AT 28~ JOY
HAVEN.

MR. COOPER STATED THAT AT THE PRESENT TIME WE DO NOT HAVE A
CATEGORY FOR ACOUSTICAL TILE.
MR. CAPP NOTED THAT MOST OF THE COMPANIES HE USES ARE
INSULATION SUB-CONTRACTORS.
THE BOARD SECRETARY WAS REQUESTED TO DO SOME RESEARCH IN THIS
MATTER AND CHECK WITH THE COUNTY AND OTHER LICENSING OFFICES
AS TO HOW THEY HANDLE ACOUSTICAL TILE.

THE GENERAL FEELING WAS THAT THIS WOULD COME UNDER PAINTING.
A BRIEF DISCUSSION FOLLOWED.
MOTION BY MR. HANEY, SECONDED BY MR. KELLEY THAT SANDBLASTING
AND DRIVEWAY PAINTING BE LICENSED BUT NOT TESTED TRADES.
IT WAS NOTED THAT THERE IS A DIFFERENCE BETWEEN DRIVEWAY
PAINTING AND DRIVEWAY COATING.
MR. KELLEY WITHDREW HIS SECOND, MR. HANEY WITHDREW HIS
MOTION.
MOTION BY MR. HANEY, SECONDED BY MR. KELLEY THAT DRIVEWAY
COATERS AND SANDBLASTERS BE A LICENSED BUT NOT TESTED
CATEGORY WHETHER IT BE COATING WITH CHEMICAL OR EPOXY OR
PAINT AND THAT THEY BE TWO SEPARATE CATEGORIES.

AFTER A BRIEF DISCUSSION, THE BOARD ASKED THE BOARD SECRETARY
TO CHECK WITH SURROUNDING AREAS AS TO HOW THEY HANDLE THIS
TYPE OF WORK.
DISCUSSION: 1990 NEC CODE
IT WAS NOTED THAT THE BOARD WAS UNSURE AS TO WHETHER OR NOT
THE STATE HAD ADOPTED THE CODE YET.
MOTION BY MR. NEUBERGER, SECONDED BY MR. HANEY TO RECOMMEND
TO CITY COUNCIL TO ADOPT THE 1990 NEC CODE WITH AN EFFECTIVE
DATE THE SAME AS THE STATE ADOPTION.

ACTING CHAIRMAN DERNBACH NOTED THAT ON 3/28/90, THERE WILL BE
A PUBLIC HEARING ON THE ORDINANCE AND THAT THE LAST PARAGRAPH
ON THE SPECIALTY CONTRACTORS WHERE TRADES ARE LICENSED BUT
NOT TESTED, HE FELT IT SHOULD BE BROUGHT TO THE ATTENTION OF
THE CITY COUNCIL THAT IT WAS NOT IN THE ORIGINAL DRAFT THAT
THE BOARD HAD PROPOSED AND THAT THE CITY ATTORNEY FELT IT WAS
NEEDED AND ADDED IT IN, BUT THAT IT IS NOT NEEDED.
MR. COOPER TOLD THE BOARD THAT HE HAD BROUGHT THIS MATTER UP
AT THE FIRST READING, THAT THE BOARD HAD A CONCERN ON THAT
PARAGRAPH THAT EVERYBODY WOULD HAVE TO BE BROUGHT BACK TO
CHANGE THE ORDINANCE EVERYTIME YOU WANTED TO ADD A NON-TESTED
TRADE. THE ATTORNEY FELT IT WAS A LEGISLATIVE DECISION AS TO
WHO WOULD OR WOULD NOT BE TESTED AND THAT IT SHOULD REST WITH
THE CITY COUNCIL.
MOTION BY MR. NEUBERGER, SECONDED BY MR. HANEY THAT DENNIS
REPRESENT THE BOARD AT THE COUNCIL MEETING IN REFERENCE TO
THE PARAGRAPH THE BOARD DOES NOT AGREE WITH.
