DERNBACH VICE CHAIRMAN LAMAN CHAIRMAN CAREY ABSENT: MR. GREENIDGE, EXCUSED MR. HALLGREN, EXCUSED ALSO PRESENT.: BRUCE COOPER, BUILDING OFFICIAL; ROB MCCLARY, CITY MANAGER; RICHARD VOTAPKA, MAYOR; TOM PALMER, CITY ATTORNEY: RECESS WAS TAKEN AT 7:32 P.M. TO GIVE THE BOARD TIME TO LOOK OVER THE APPLICATIONS. MEETING REOPENED AT 7:49 P.M. WITH ALL PRESENT. MOTION BY VICE CHAIRMAN LAMAN, SECONDED BY MR. DERNBACH THAT A CREDIT REPORT WAS NOT REQUIRED FOR A MASTER OR JOURNEYMAN. CARRIED. DERNBACH, SECONDED BY VICE CHAIRMAN LAMAN TO ACCEPT THE MINUTES OF REGULARMEETING HELD 3/1/88, AND SPECIAL MEETINGS HELD 3/3/88 a~d 3/8/88 AS WRITTEN. CARRIED. BUSINESS: M · COOPER ASKED THAT THE DISCUSSION ON INDIAN RIVER HOMES UNDER NEW BUSINESS B~MOVED TO OLD BUSINESS ON THE AGENDA SINCE IT ALSO iNVOLVED JOHN B. ROBERTS, JR. THE BOARD HAD NO OBJECTIONS. DISCUSSION: JOHN B. ROBERTS, JR. MR, COOPER TOLD THE BOARD THAT SI'NCE HE WANTED MORE INFORMATION.THiS CASE WAS CONTINUED. HE NOTED THAT IN THE BOARDS PACKET WAS A CREDIT APPLICATION FROM UNITED LUMBER SIGNED BY JOHN ROBERTS, JR. AS AMERICAN COLLECTION OF FINE HOMES. THERE .WERE ALSO ORDERS FROM VARIOUS JOB SITES FOR AMERICAN' COLLECTION OF'FINE HOMES WHICH SHOWS HE USED THAT CORPORATION AS A CONTRACTING BUSINESS. MR. COOPER ALSO WROTE TO THE STATE AND GOT BACK THE CORPORATE PAPERSFOR AMERICAN COLLECTION OF FINE HOMES WHICH THE BOARD HAS A COPY OF. HE FELT THIS WAS SELF EXPLANATORY. IN HiS OPINION THIS WAS TO CONSTRUCT OR DEVELOPE AND THAT MR. ROBERTS WAS OPERATING AS AMERICAN COLLECTION OF FINE HOMES IN THE CONTRACTING BUSINESS WHICH WAS NOT LICENSED THROUGH THE CITY OR THE STATE OFFLORIDA AS RE- QUIRED BY CHAPTER 489. HE THEREFORE RECOMMENDED THE BOARD REVOKE HIS LICENSE. MR. ROBERTS WAS NOT PRESENT AT THE MEETING. MR. COOPER READ A LETTER RECEIVED FROM MR. ROGERTS INTO THE MINUTES. MR. COOPER STATED HE FELT DUE PROCESS AND NOTICE WAS GIVEN. THIS WAS A CONTINUANCE OF THE LAST MEETING AND MR.. ROBERTS KNEW THAT IT' WAS. HE WAS DELIVERED A PACKET LAST FRIDAY TO HELP HIM OUT IN HIS CASE, ALTHOUGH THERE WAS NOTHING ADDITIONAL AS FAR AS COMPLAINTS GO. TOM PALMER, CITY ATTORNEY, TOLD THE BOARD THAT AT THE LAST MEETING HE QUESTIONED MR. ROBERTS AS TO WHETHER AMERICAN COLLECTION OF FINE HOMES WAS BEING USED TO SELL ONE LOT TO ONE PERSON. HE ASKED IF HE WAS USING AMERICAN COLLECTION OF FINE HOMES FOR THE PURPOSE OF ANY OTHER CONTRACTING BUSINESS. MR.: ROBERTS SAID HE WAS NOT. MR. PALMER MADE RECORD OF THE DOCUMENTATION OF A LETTER DATED 3/16/88 WITH A COMPUTOR PRINTOUT FROM TALLAHASSEE FOR AMERICAN COLLECTION OFFINE WOMES AND ATTACHED TO THAT, THE FIRST PAGE OF THE 'ARTICLES OF iNCORPORATION, PARAGRAPH II STATING THE PURPOSE OF THE CORPORATION. ATTACHED FROM UNITED LUMBER WAS A CREDIT APPLICAzION WITH INFORMATION SHOWING THAT MR. ROBERTS WAS USING AMERICAN COLLECTION OF FINE HOMES TO CONTRACT IN THE CITY OF SEBASTIAN. SEBASTIAN CONSTRUCTION BOARD..- ~GULAR MEETING - APRIL 5~ 1988 JOHN B. ROBERTS, JR. cont. FOLLOWING FURTHER DISCUSSION, THE FOLLOWING MOTION WAS MADE AND PASSED UNANIMOUSLY: MOTION BY MR. CAPP, SECONDED BY MR. DERNBACH TO REVOKE JOHN ROBERT'S ~iCENSE FOR ONE (i) YEAR AT WHICH TIME MR. ROBERTS MUST PROVE TO THE. BOARD THAT HE HAS REFORMED AND REHABILITATED HIMSELF PRIOR TO THE BOARD LICENSING HIM AGAIN. CARRIED. DISCUSSION: INDIAN RIVER HOMES - BROTHERTON MR. COOPER'TOLD THE BOARD THERE WERE TWO CASES PENDING - ALICIA TOVAR AND FREDERICK .WALTER, REFERENCED INDIAN RIVER HOMES. THE MAJOR QUESTION WAS WHY MS. TOVAR SPENT $40,000.00 TO FINISH HER HOME. THE BOARD WAS GIVEN COPIES OF EVERYTHING SUBMITTED PERTAINING TO THIS CASE. MR. COOPER RAN A TOTAL FROM THE PAPER WORK MS.: TOVAR GAVE THE BOARD AND IT TOTALED $14,800.00, ALMOST $1.5;000.00 MINUS APPROXIMATELY $1,000.00 BEYOND HER ALLOWANCES ON HER CONTRACT. ATTORNEY RENE VANDEVOORDE WAS PRESENT REPRESENTING INDIAN RIVER HOME-S - BROTHERTON. HE TOLD THE BOARD THAT INDIAN RIVER HOMES WAS WILLING TO WORK WITH BOTH CASES CONCERNING THE CONTRACTS. MOTION BY VICE CHAIRM LAMAN, SECONDED BY MR. DERNBACH TO CONTINUE THE BROTHERTON iSSUE FOR ONE MONTH TO SEE ~F ANY PERTINENT FACTS CAME TO LIGHT. CARRIED. DISCUSSION: COMPAINTS AGAINST IKE HUSSAIN, CONTRACTOR MR. COOPER, MR. HUSSAIN AND MR. BASSI WERE SWORN IN BY THE CITY ATTORNEY. MR. LEONARD BASSI, 57.3 BROWNING TERRACE, SPOKE TO THE BOARD STATING.¥3'THAT HE HAD RETAINED STEVEN LULICH AS HIS ATTORNEY ON OCTOBER' 22, 1987. HE TOLD THE BOARD THAT MR. LULICH, MR. LAMAN AND MR. COOPER HAD.ViSITED HIS HOME TO CHECK OVER HIS COMPLAINTS. MR. LAMAN MADE A LIST OF THESE COMPLAINTS THAT HE DISCUSSED WITH THE BOARD DURING THE MEETING. MR. BASSI ALSO PASSED AROUND PICTURES THAT HAD BEEN TAKEN OF THE COMPLAINTS. IKE HUSSAIN, OWNER OF CLASSIC BUILDERS TOLD THE BOARD THAT HE HAD TRIED TO WORK WITH MR. BASSI. HE SAID THAT MR. BASSI. HAD BEEN VERBALLY OBUSIVE AND WOULD NOT LET WORKERS IN HIS HOUSE TO DO SOME OF THE REPAIRS THAT NEEDED TO BE DONE. SEBASTIAN CONSTRUCTION BOARD - REGULAR MEETING - APRIL,~, 1988 IKE HUSSAIN, cont. RECESS WAS TAKEN AT 9:05 P.M. REOPENED AT 9:15 P.M. WITH ALL PRESENT MR. BASSI TOLD THE BOARD THAT ONLY ONE PAPER WAS EVER SIGNED. ALL THE OTHER PAPERS WERE FORGERIES. VICE CHAIRMAN LAMAN WENT OVER THE LIST HE HAD MADE WHILE VIEWING MR. BASSI'S HOUSE. MOTION BYMR. DERNBACH, SECONDED BY MR. CAPP TO HOLD THIS CASE OVER UNTIL THE MAY MEETING PENDING A PROGRESS REPORT ON THE ITEMS ON THE PUNCH LIST. DISCUSSION: CHAIRMAN CAREY SAID HE FELT A MONTH WAS TOO LONG FOR THE WORK TO BE DONE. SECOND WITHDRAWN BY MR. CAPP, MOTION WITHDRAWN BY MR. DERNBACH, MOTION BY MR. DERNBACH, SECONDED BY MR. CAPP THAT THE BOARD DIRECT MR. HUSSAIN TO ATTEND TO THE CODE VIOLATIONS WITHIN 7 DAYS AND HOLD OVER THE OTHER ITEMS UNTIL WE REVIEW THE CODE VIOLATIONS AT OUR NEXT REGULAR MEETING. DISCUSSION: MR. COOPER REFERRED TO ATTORNEY LULICH'S LETTER WITH THE ITEMS ON THE PUNCH LIST DATED 3/31/88. SECOND WITHDRAWN BY MR. CAPP, MOTION WITHDRAWN BY MR. DERNBACH. MOTION BY VICE CHAIRMAN LAMAN, SECONDED BY MR. DERNBACH THAT'MR~ HUSSAIN ADDRESS THE ITEMS OF THE PUNCH LIST FROM VICE CHAIRMAN LAMAN'S OBSERVATION AND COMPLETE THEM ~N A TWO WEEK PERIOD FROM THIS MEETING. IF'NOT COMPLETED, AT OUR NEXT MEETING A REASON IS TO BE GIVEN WHY AND A PROGRESS REPORT GIVEN. DISCUSSION: ATTORNEY PALMER ASKED MR. BASSI TO AGREE TO STAY OUT'OF THE WAY WHEN THE SUBS DO THE WORK. MR. BASSI AGREED. CARRIED. SANDY vs HUSSAIN BiLL SANDY, 548 BALBOA STREET WENT OVER THE LIST OF COMPLAINTS HE HAD CONCERNING THE CONSTRUCTION OF HIS HOME. THE BOARD WENT OVER THE LIST WITH MR. HUSSAIN. -- MOTION BY MR. DERNBACH, SECONDED BY VICE CHAIRMAN LAMAN TO DIRECT MR. HUSSAIN TO RESOLVE THESE PROBLEMS BY OUR NEXT REGULAR MEETING. CARRIED. SEBASTIAN CONSTRUCTI9~. BQARD.- ~GULAR MEETING - APRIL 5, 1988 AIRPORT MAINTENANCE BUILDING MR. COOPER TOLD THE BOARD THAT HE WANTED TO GET SOMETHING IN WRITTING FROM THE AIRPORT MANAGER AS TO THE ACTUAL USE OFTHE'-STRUCTURE. HE ASKED THAT THIS BE CARRIED OVER TO THE MAY MEETING. HOUSING CODE MR. COOPER STATED THAT WE ARE IN THE PROCESS OF ADAPTING OUR TECHNICAL CODES WHICH WILL GO THROUGH, BUT THAT HE WAS INTERESTED IN ADAPTING THE HOUSING CODE THROUGH THE SOUTHERN BUILDING CODE, HE ASKED FOR A RECOMMENDATION TO THE CITY MANAGER AND CITY COUNCIL. THIS WILL REQUIRE MINIMUM STANDARDS ON EXISTING BUILDINGS. THE BUILDING CODE IS FOR NEW STRUCTURES. MOTION BY VICE CHAIRMAN LAMAN, SECONDED BY MR. DERNBACH TO RECOMMEND~TO THE CITY MANAGER AND CITY COUNCIL THAT SEBASTIAN ADAPT THE STANDARD HOUSING CODE AS PART OF OUR ORDINANCE. CARRIED. THERE WAS A BRIEF DISCUSSION ON BONDING. MOTION BY MR. DERNBACH, SECONDED BY VICE CHAIRMAN LAMAN TO RECCOMEND TO CITY COUNCIL TO ADOPT ORDINANCE 0-88-22. CARRIED. SCORES WERE REGISTERED IN THE SCOREBOOK BY MR. DERNBACK AND MR, CAPP. LUTHER, PAT/PAINTING THE BOARD SECRETARY ASKED THE BOARD IF THEY WOULD ACCEPT A CREDIT LETTER FROM A PAINT STORE IN LIEU OF A CREDIT REPORT. MOTION BY VICE CHAIRMAN LAMAN, SECONDED BY MR. DERNBACH THAT THE BOARD MUST HAVE A CREDIT REPORT IN ORDER TO APPROVE HIS PAINTING SUB-CONTRACTORS LICENSE IN THE CITY OF SEBASTIAN. CARRIED.
