MOTION C~D PAGE SEBASTIAN CONSTRUCTION BOARD - REGULAR MEETING - 4/8197 VIOLATiON HEARINGS: NONE Bi~ILDING OFFIC~ MATTERS: DISCUSSION: SCOTT NOLLfPERGO FLOORS CHAIRMAN SMITH SWORE IN MR. NOLL. BECAUSE THiS TYPE OF FLOORING IS RELATIVELY NEW, THE MAIN QUESTION WAS EXPE~CE, MR. NOLL TOLD THE BOARD THAT tie HAS BEEN DOING 1T SINCE JANUARY, 1996. HE ALSO TOLD THE BOARD THAT INDIAN RIVER COUNTY GRANDFATHERED HiM IN SINCE HE HELD A BREVARD OCCUPATIONAL LICENSE, AFTER A BRIEF. DISCUSSiON, THE BOARD FELT THAT HE STILL NEEDED. TO SHOW THE TWO YEARS EXPERIENCE, ONE OF THOSE YEARS AS A SUPERVISOR BEFORE HE COULD BE LICENSED IN THE CITY OF SEBASTIAN. DISCUSSION: PROTECTION FROM BUILDERS MR. BONACCI NOTED THERE WERE SEVERAL PEOPLE 1N THE AUDIENCE WHO HAVE EXPERIENCED. A PROBLEM WITH A LOCAL BUILDER, WHOSE NAME WILL NOT BE MENTIONED AT THIS TIME SINCE THE BUILDER IS UNDER A POLICE INVESTIGATION. MR. BONACCI EXPLAJNED THAT WE COULD DISCUSS THEIR FEELINGS. ASTO WHAT HAD HAPPENED TO THEM AND WHAT THE BOARD COULD DO TO .STOP THiS IN THE FUTURE BILL COMEAU, PRESENTLY OF 4820 - 47TH COURT, VERO BEACH, HOPING TO RESIDE AT 1711 BARBER.STREET, SEBASTIAN. HE EXPLAINED THAT TftEY HAD RUN INTO A PROBLEM WITH THEIR BUILDER THAT HE HAD TAKEN OFF WITH $31,000.00 NOT ACCOUNTED FOR AND LEFT 'gHEM WiTH ALMOST $18,000.00 IN UNPAID SUB-CONTRACTOR BILLS. MR. COMEAU REQUESTED THAT SEBASTIAN SOMEHOW CREATE A SYSTEM WHERE THE BUILDER BE HELD RESPONSiBLE, HE SUGGESTED BONDING THE BUILDER. HE ALSO SUGGESTED A FOLLOW-UP QUESTIONNAIRE TO THE HOME OWNER AFTER THE SOB HAS BEEN COlVlPLE'I~D. JOHN MCKEEVER, 981 LANCO AVE., SEBASTIAN, TOLD THE BOARD THAT THE CONTRACTOR W1THD~ ABOUT $33,000.00 OUT OF THEIR CONSTRUCTION ACCOUNT AND WHAT WE'VE GOT TO DATE IS A CONCRETE BLOCK WALL AND SLAB. THERE WERE TRUSSES LAYING ON THE GROUND AND RECENTLY SEBASTIAN CONSTRUCTION BOARD r REGULAR MEETING - 4~8~97 ANOTHER CONTRACTOR AGREED TO PUT THEM UP FOR US BECAUSE HE GOT TIRED OF SEEING THEM SITTING ON THE GROUND AND GETTING WARPED. HE TOLD THE BOARD THAT HE DiDN'T KNOW IF THEY WOULD EVER RECOVER FROM THIS SITUATION. DAVID THOMPSON, 1531 SPINNAKER LANE, TOLD THE BOARD THAT THEY HAVE BEEN IN THEIR HOUSE 13 MONTHS AND HAVE RECEIVED A LIEN ON THE HOUSE. IT WAS A PHONY DOCUMENT THAT THEY TURNED INTO THE CONSTRUCTION COMPANY. WE PAID 1T AND THEN WE HAD TO PAY 1T AGAIN. HE ASKED IF TItEY ARE A BONDED CONTRACTOR WHAT 1T MEANT TO THEM. MR. BONACCI TOLD THEM THAT WE DO NOT REQUIRE BONDS ON ANY CONTRACTOR. WHATEVER THEY WERE TOLD MIGHT HAVE BEEN JUST A SALES PITCH. CHAIRMAN SMITH ASKED THAT WttEN THE PERMIT PACKET IS PICKED.UP IF THERE WAS A PACKET THAT WENT TO THE HOME OWNER. MR. BONACCISAiD TIlE CONTRACT IS A LEGAL DOCUMENT BETWE~ THE RESPECTIVE CLIENT AND' BUILDER. WE DON'T GET INVOLVED WITH THE CONTRACT. THE ONLY THING WE HAVE ON OUR APPLICATION IS THE FAIR MARKET VALUE. THE BOARD WAS TOLD THAT THE POLICE DEPARTMENT, AFTER SEVERAL WEEKS, SAID THEY DID NOT WANT TO HANDLE THIS CASE. MR. MCKEEVER SAID THEY HAD CONTACTED THE STATE'S ATTORNEYS OFFICE BUT FELT THAT THEY WERE GIVING THEM THE RUN AROUND. HE SAID THEY FINALLY GOT AHOLD OF FDLE AND THAT THEY PRACTICALLY HAD TO BEG THEM TO TAKE THE CASE. VICE CHAIRMAN MOSBY SAiD THAT A LETTER WOULD BE WRITTEN TO.MR. FRAME IN REGARDS TO THiS CASE AND MR. BONACCI SAID HE WOULD SEE IF MR. FRAME WOULD SIT AND TALK TO THE PEOPLE MAKING THE COMPLAINTS. HE SAID THAT THE LETTER WOULD BE COPIED TO THE CITY ATTORNEY. MR. BONACCI SAID HE WOULD PUT A MEMO IN EVERY PACKAGE ATTACHED WITH A COPY OF THE SUB-CONTRACTORS BEING USED AND TO CHECK THE SUBS FOR RELEASE OF LIENS. HE SAID HE WOULD DO THIS WITttiN THE NEXT WEEK. THE BOARD SECRETARY SUGGESTED THAT EVEN THOUGH IT IS UNLIKELY THIS CONTRACTOR WOULD APPLY FOR ANOTHER PERMIT IN SEBASTIAN, THAT THE BOARD HAVE A ttEARING AND SUSPEND HIS PERMIT PULLING PRIVILEGES. SEBASTIAN CONSTRUCTION BOARD ~ REGULAR MEETING - 418/97 MOTION BY VICE CHAIRMAN MOSBY, SECONDED BY MR. CECRLE THAT WE SERVE A NOTICE OF HEARING TO VERSA HOMES TO COME BEFORE THIS BOARD AT THE MAY MEETING TO REVIEW HIS LICENSE. ROLL CALL. MOTION CARRIED 5-0. MR. BONACCI NOTED THAT THE CODE VIOLATION WOULD BE THE ABANDONMENT OF TWO PROJECTS. BOARD MAT[ERS: NONE Ai'rORNEY MAT[ERS: NONE SCORES WERE RECORDED IN THE SCOREBOOK BY MR. PAQUETTE AND MR. HERBIG.
