NEUBERGER NOTED THAT THE ONLY PROOF OF EXPERIENCE IN MR. COSTIGAN'S FOLDER WAS A LETTER FROM A SUPPLY HOUSE. HE FELT THAT LETTER DID NOT VERIFY THAT MR. COSTIGAN WAS A TILE SETTER. MR. COSTIGAN SAID THAT HE HAD ALWAYS WORKED FOR HIMSELF. HE SAID HE COULD GET LETTERS FROM SOME OF HIS CUSTOMERS. MOTION BY MR. NEUBERGER, SECONDED BY MR. HANEY TO ACCEPT MR. COSTIGAN'S APPLICATION CONTINGENT UPON RECEIPT OF LETTERS BROUGHT IN TO THE BOARD SECRETARY. CARRIED. THE BOARD SECRETARY STATED THAT IN THE PAST THE BOARD HAD ACCEPTED STATEMENTS FROM SUPPLIERS AS PROOF OF EXPERIENCE. CHAIRMAN CAREY SAID THAT THIS MATTER WOULD BE DISCUSSED LATER ON IN THE MEETING. APPROVAL OF MINUTES: MOTION BY MR. NEUBERGER, SECONDED BY MR. HANEY TO APPROVE THE MINUTES OF MEETING HELD 3/13/90 AS WRITTEN. CARRIED~ PAGE 4 SEBASTIAN CONSTRUCTION BOARD - 4/10/90 COMPLAINT AGAINST USE OF UNLICENSED SUBS - ROBERT VETA CHAIRMAN CAREY SWORE IN MR. VETA. MR. CAPP NOTED THAT MR. VETA WAS WORKING ON ONE OF MR. MASLOW'S HOMES AND WAS UNLICENSED AT THE TIME. HE HAD ALLOWED HIS LICENSE TO EXPIRE. AFTER A "STOP WORK" ORDER WAS GIVEN, MR. VETA DID COME IN TO RENEW HIS LICENSE. MR. HANEY ASKED IF HE HAD BROUGHT THE EMPLOYMENT RECORDS AS REQUESTED CONCERNING THE TWO SUB-CONTRACTORS THAT WERE WORKING ON THE JOB. MR. VETA SAID HE DID BRING HIS WORKMANS COMPENSATION BUT NO EMPLOYMENT RECORDS. MR. VETA STATED THAT THE TWO SUB-CONTRACTORS WERE NOT EMPLOYEES, THAT THEY SUB-CONTRACTED FROM HIM. MR. VETA TOLD THE BOARD THAT HE DID NOT NEED THE CITY OF SEBASTIAN TO PUT FOOD ON HIS TABLE AND THAT IF THE BOARD WANTED TO TAKE AWAY HIS LICENSE THAT IT WAS UP TO THEM. MOTION BY MR. CAPP TO SUSPEND ROBERT VETA'S LICENSE INDEFINITELY IN THE CITY OF SEBASTIAN. MOTION WITHDRAWN BY MR. CAPP. MOTION BY MR. CAPP, SECONDED BY MR. NEUBERGER THAT WE SUSPEND ROBERT VETA'S SEBASTIAN LICENSE INDEFINITELY AND ALSO THAT DPR BE NOTIFIED OF THIS CASE. MR. COOPER ASKED IF IT WOULD PROPER IN STEAD OF SUSPENDING TO REVOKE THE LICENSE. MR. NEUBERGER WITHDREW HIS SECOND, MR. CAPP WITHDREW HIS MOTION. MOTION BY MR. CAPP, SECONDED BY MR. HANEY THAT WE REVOKE MR. VETA'S SEBASTIAN COMPETENCY LICENSE AND ALSO DPR BE NOTIFIED OF THIS CASE IMMEDIATELY. MR. COOPER FELT THAT THE MOTION SHOULD ALSO INCLUDE THE CODE SECTIONS THAT WERE IN VIOLATION. MR. HANEY THAT WE REVOKE ROBERT VETA'S SEBASTIAN COMPETENCY CARD TO DO DRYWALL. THE BOARD HAS FOUND HIM GUILTY OF VIOLATING SECTIONS 7-100, SUB- PARAGRAPH B, (2) AND (3) AND THAT DPR BE NOTIFIED OF THIS CASE IMMEDIATELY. CARRIED. MOTION BY MR. HANEY, SECONDED BY MR. CAPP TO PURSUE THIS CASE AND BRING IN THE EMPLOYEES, JiM MACINTYRE AND TONY TANNER, INCLUDING PAYROLL, WORKMANS COMP RECORDS THAT THEY ARE SUPPOSE TO HAVE. CARRIED. MOTION BY MR. HANEY, SECONDED BY MR. KELLEY TO BRING MR. MASLOW BACK IN FRONT OF THE BOARD AND HAVE HIM EXPLAIN THE FOUR PERMITS THAT MR. KELLEY HAS CONCERNING USING DIFFERENT LICENSED CONTRACTORS AND USING SOMEBODY ELSE. CARRIED. COMPLAINT AGAINST USE OF UNLICENSED SUBS - RICHARD VAETH MR. VAETH WAS NOT PRESENT AT THE MEETING. THE BOARD SECRETARY TOLD THE BOARD THAT MR. VAETH DID RECEIVE THE LETTER TO APPEAR BEFORE THE BOARD BUT THAT HE DiD NOT CONTACT HER. IT WAS NOTED THAT MR. VAETH IS NOT LICENSED IN THE CITY OF SEBASTIAN AND NEVER HAS BEEN. MR. COOPER TOLD THE BOARD THAT PAST TESTIMONY CONCERNING MERCEDES HOMES FOR HIRING MR. VAETH WAS GIVEN TO SHOW THE FACT THAT HE DID DO THE CARPENTRY ON THREE SEPARATE OCCASIONS AT HOMES LOCATED AT CARNIVAL TERRACE, CAPON TERRACE, (THE HOUSE THAT COLLAPSED) AND ABBOT TERRACE. MOTION BY MR. HANEY, SECONDED BY MR. KELLEY THAT THE BOARD FINDS RICHARD VAETH GUILTY OF BEING AN UNLICENSED SUB- CONTRACTOR IN THE CITY AND AT THIS TIME WE HAVE HIM FOR THREE jOBS ON ABBOT TERRACE, CAPON TERRACE AND CARNIVAL TERRACE VIOLATING SECTION 7-100, SUB-PARAGRAPH B, (1), (2) AND (3). HANEY, SECONDED BY MR. CAPP TO FINE MR. VAETH THE MAXIMUM $500.00 FOR THESE VIOLATIONS ON EACH VIOLATION. MR. COOPER SAID HE WOULD CHECK WITH THE CITY ATTORNEY ON THE AMOUNT AND WHETHER OR NOT WE CAN CHARGE $500.00 ON EACH VIOLATION. MR. CAPP WITHDREW HIS SECOND, MR. HANEY WITHDREW HIS MOTION. MOTION BY MR. HANEY, SECONDED BY MR. KELLEY THAT WE FIND MR. RICHARD VAETH GUILTY OF UNLICENSED WORK IN VIOLATION OF SECTION 7-99, SUB-PARAGRAPH A ON THE THREE HOUSES DONE AT ABBOT TERRACE, CAPON TERRACE AND CARNIVAL TERRACE. ROLL CALL: AYES: MR. KELLEY MR. NEUBERGER MR. HANEY MR. CAPP CHAIRMAN CAREY NAY: NONE CARRIED. MR. COOPER ADVISED THE BOARD THAT THE COUNTY, GENE MORRIS'S OFFICE HAS SENT A LETTER TO THE CITY ASKING FOR ALL OCCUPATIONAL LICENSES AND INFORMATION ON COMP CARDS BEING ISSUED BY THE CITY. THEY ARE GOING TO REQUIRE A MANDATE THAT THEY GET A COUNTY OCCUPATIONAL LICENSE. THE CITY DOES NOT HAVE A CODE TO REQUIRE THAT AND WE DO NOT HAVE TO. THE COUNTY REQUIRES EVERYONE TO TAKE THE BLOCK EXAM, SEBASTIAN DOES NOT. IF WE CONTINUE LICENSING UNDER THE CURRENT CODE, THE COUNTY WILL TELL THESE PEOPLE THAT THEY MUST HAVE A COUNTY OCCUPATIONAL LICENSE WHICH WOULD REQUIRE TAKING THE BLOCK EXAM. PAGE 7 SEBASTIAN CONSTRUCTION BOARD - 4/10/90 AT THIS POINT WE COULD GO ALONG WITH THE COUNTY AND TEST EVERYONE. MR. COOPER SAID HE WOULD ALSO ASK THE COUNTY TO GRANDFATHER ALL EXISTING COMP CARDS TO OBTAIN A COUNTY OCCUPATIONAL LICENSE. HE ALSO RECOMMENDED THAT THE BOARD MAKE A RECOMMENDATION TO CITY COUNCIL TO AMEND THE ORDINANCE TO REQUIRE A COUNTY OCCUPATIONAL LICENSE AND HAVE THE SAME REQUIREMENTS AS THE COUNTY TO TEST ALL TRADES. DISCUSSION: SHOWER ENCLOSURE VENTILATED SHELVING ACOUSTICAL TILE SANDBLASTING PRE-FABRICATED FIREPLACE INSTALLATION THE BOARD SECRETARY CHECKED WITH SURROUNDING AREAS ON THE LAST THREE TO FIND OUT HOW THEY WERE BEING HANDLED. VERO BEACH SANDBLASTING COMES UNDER PAINTING ACOUSTICAL - UNDER INSULATION BREVARD COUNTY - DOES NOT LICENSE SANDBLASTING OR ACOUSTICAL BOTH VERO BEACH AND BREVARD COUNTY ONLY REQUIRE AN OCCUPATIONAL LICENSE FOR PRE-FABRICATED FIREPLACE INSTALLATION. MR. COOPER FELT THAT SHOWER ENCLOSURE SHOULD BE UNDER GLAZING. PRE-FABRICATED FIREPLACE INSTALLATION WILL NOT BE REQUIRED TO HAVE A COMP CARD. SANDBLASTING WOULD COME UNDER PAINTING AND ACOUSTICAL TILE WOULD COME UNDER DRYWALL. IT WAS NOTED THAT IF ACOUSTICAL TILE WAS ALL THE CONTRACTOR WAS GOING TO DO, HE WOULD NOT HAVE TO TAKE THE DRYWALL TEST. MR. NEUBERGER FELT THAT VERIFICATION OF EMPLOYMENT ON THE APPLICATIONS NEEDED TO BE CLEANED UP. IN THE PAST, A LETTER WRITTEN ON ORIGINAL LETTER HEAD WAS ACCEPTED BY THE BOARD. ONLY LETTERS THAT ARE NOTARIZED WILL BE ACCEPTED. W-2 FORMS WILL NO LONGER BE ACCEPTED DUE TO THE FACT THAT THEY DO NOT VERIFY WHAT TYPE OF WORK WAS DONE. PAGE 8 SEBASTIAN CONSTRUCTION BOARD - 4/10/90 DISCUSSION TOOK PLACE WITH NO ACTION FROM THE BOARD. THE BOARD REQUESTED THAT THE PHOTOGRAPHS USED ON THE APPLICATIONS BE A PASSPORT TYPE PICTURE. MOTION BY MR. HANEY, SECONDED BY MR. CAPP THAT THE PHOTOGRAPHS ON THE APPLICATIONS BE A PASSPORT TYPE PHOTOGRAPH THAT CLEARLY SHOWS THE PERSONS FACIAL CHARACTERISTICS OTHER THAN BACKGROUND FEATURES. CARRIED. MR. HANEY AND MR. CAPP REGISTERED THE TEST SCORES IN THE SCORE BOOK. THERE BEING NO FURTHER DISCUSSION, MEETING ADJOURNED AT 10:50 P.M.
