VIOLATION HEARING~ THE BOARD SECRETARY REQUESTED A .5 MINUTE RECESS TO..AWAi~T THE ARRIVAL OF MR. NICHOLSON WHO WOULD PRESENT THE VIOLATION HEARINGS. RECESS - 7:35 REOPEN - 7:45, WITH ALL PRESENT AGE 2 SEBASTIAN CONSTRUCTION BOARD - REGULAR MEETING - 4/13/93 VIOLATION HEARINGS cont PAT WHITE/WHITE DRYWALL MELROSE LANE MR. WHITE AND MR. NICHOLSON WERE SWORN IN BY'CHAIRMAN LAM'AN"~ MR. NICHOLSON GAVE A RUNDOWN OF THE CASE. MR. WHITE SPOKE TO THE BOARD. HE TESTIFIED THAT MR. FRED BARK HAD BEEN EMPLOYED BY ABOUT 15 YEARS AS A HANGER AND FINISHER AND THAT HE WASiTHE SUPERVISOR. HE ALSO SAID THAT BECAUSE OF THiS CASE THAT MR. BARK NO LONGER WORKS FOR HIM. BOARD MEMBER, MR. HANEY ARRIVED AT THE MEETING AT 8:15 P,M. MR. FRED BARK WAS SWORN IN BY.CHAIRMAN LAMAN TO TESTIFY iN REGARDS TO PAT WHITE'S CASE. IT WAS NOTED THAT MR. BARK WAS THE ONE WHO HIRED ALL OF THE SUBS FOR WHITE DRYWALL. MOTION BY MR. CAPP, SECONDED BY MR. HANEY THAT WE SUBPOENA THE WHITE DRYWALL ACCOUNT FOR THE LAST QUARTER OF 19927~THE FIRST QUARTER OF 1993 - WE'D LIKE TO SEE THE PAYROLL RECORDS, THE BANK STATEMENT, W-4'S, 1099'S, UNEMPLOYMENT RECORDS'. UTT6 AND WORKERS COMPENSATION. DURING DISCUSSION IT WAS NOTED THAT THE BANK STATEMENT WOULD BE FROM BARNETT BANK, ACCOUNT MOTION CARRIED. THIS INFORMATION WILL BE PRESENTED TO THE BOARD AT THEIR NEXT MEETING. FRED BARK/FRED BARK DRYWALL MELROSE LANE MR. BARK AND MR. NICHOLSON WERE SWORN IN BY CHAIRMAN LAMAN. MOTION BY MR. CAPP, SECONDED BY MR. NEUBERGER TO TABLE AND MR. BARK BE PRESENT AT OUR NEXT REGULAR SCHEDULED CONSTRUCTION BOARD MEETING UPON THE FINDING OF FACT OF PAT WHITE DRYWALL ACCOUNT. CAPP WITHDREW HIS MOTION. CHAIRMAN LAMAN ASKED MR. BARK HOW HE WANTED TO PLEAD ON ALL THREE CHARGES. MR. BARK SAID HE WANTED TO GET IT OVER WITH SO HE PLEADED GUILTY. FINDING OF FACTS MOTION BY MR. TRUMAN SMITH, SECONDED BY MRS. ENLOW TO ACCEPT MR. BARK'S PLEA OF GUILTY TO THE CHARGE OF 26-171(a), UNLICENSED CONTRACTOR; 26-171(b), USE OF UNLICENSED CONTRACTOR; 26-172(1), WILLFUL DISREGARD FOR THE BUILDING CODES; 26-171(2), AIDING & ABETTING REGARDING A VIOLATION'AT MELROSE LANE, ABOUT MARCH 23, 1993. MOTION CARRIED. MOTION BY MR. HANEY, SECONDED BY MR. MR. NEUBERGER ASKED THAT SINCE MR. BARK WAS LEAVING TOWN, WHAT RECOURSE THE BOARD HAD IF THE FINE WAS NOT PAID. MR. BARK SAID THAT THE FINE WOULD BE PAID TONIGHT. MOTION CARRIED. MR. PAT WHITE WAS CALLED BACK TO THE MIC. CHAIRMAN LAMAN ASKED MR. WHITE IF HE WANTED TO MAKE A PLEA. MR. WHITE SAiD HE DID NOT FEEL HE WAS GUILTY AND THAT HE WANTED A CHANCE TO PROVE HIS iNNOCENCE AT THE NEXT" MEETING. CHAIRMAN LAMAN NOTED THERE WERE TWO LETTERS ON FILE KBGARDING DENNIS DERNBACH. MRS. ENLOW REQUESTED A RECESS BE TAKEN TO ALLOW MR. BARK TO PAY HIS FINE. BOARD RECESSED AT 8:55 P.M. MEETING REOPENED AT 9:08 WITH ALL PRESENT. THE LETTERS IN REGARD TO DENNIS DERNBACH WERE LETTERS FROM TWO BOARD MEMBERS REQUESTING MR. DERNBACH'S RESIGNATION FROM THE CONSTRUCTION BOARD. MR. JERRY SMITH NOTED THAT THE BOARD REPRESENTS THE CONSTRUCTION INDUSTRY IN THE CITY OF SEBASTIAN AND AS BUSINESSMEN, WE SHOULD HANDLE OURSELVES IN A BUSINESS .LIKE MANNER. MOTION BY MR. MOSBY, SECONDED BY MR.. NEUBERGER THAT THE BOARD SECRETARY WRITE A LETTER TO BE SIGNED BY CHAIRMAN LAMAN TO REQUEST THE RESIGNATION OF DENNIS DERNBACH BASED ON THE TWO LETTERS RECEIVED BY THE BOARD FROM JERRY SMITH TILE, INC. AND SEBASTIAN HEATING AND AIR CONDITIONING, INC.. MOTION CARRIED.. DISCUSSION: INSTALLATION OF METAL STUDS MOTION BY MR. JERRY SMITH, SECONDED BY MRS. ENLOW TO POSTPONE THE DISCUSSION OF THE INSTALLATION OF METAL STUDS UNTIL NEXT' MEETING WHEN MR. COOPER WILL BE PRES.ENT AND ENLIGHTEN US A LITTLE MORE IN THE AREA. MOTION CARRIED.
