MEETING WAS CALLED TO ORDER BY CHAIRMAN LAMAN AT 7:30 P.M. ROLL CALL: PRESENT: MR. MOSBY MR. KELLEY MR. NEUBERGER MR. CAPP MR. HANEY VICE CHAIRMAN DERNBACH CHAIRMAN LAMAN ABSENT: NONE ALSO PRESENT: MR. COOPER, BUILDING OFFICIAL; MR. BONACCI, CHIEF BUILDING iNSPECTOR; MR. NICHOLSON, CODE ENFORCEMENT OFFICER. APPROVAL OF MINUTES; MOTION BY VICE CHAIRMAN DERNBACH, SECONDED BY MR. NEUBERGER TO APPROVE THE MINUTES OF MEETING HELD 3/10/92 AS WRITTEN. MOTION CARRIED. NEW BUSINESS: LETTER OF RECIPROCITY STOVER, MICHAEL/HARV "B" CONTRACTOR TRYON, ROBERT C./PLUMBING CONTRACTOR RANCOURT, JEAN L./DRYWALL SUB-CONTRACTOR MOTION BY MR. NEUBERGER, SECONDED BY MR. MOSBY TO ACCEPT THE , LETTERS OF RECIPROCITY OF MICHAEL STOVER, HARV "B" ROBERT TRYON, PLUMBING, AND JEAN RANCOURT, DRYWALL. MOTION CARRIED. BLOCK EXAM SMITH, ROGER E./BUILDING CONTRACTOR ROTT, KEVIN J./ELECTRICAL MAINTENANCE DUZAN, ROGER C./PAINTING SUB-CONTRACTOR SUMMERALL, ROBERT/PAINTING SUB-CONTRACTOR MOTION BY MR. CAPP, SECONDED BY VICE CHAIRMAN DERNBACH THAT THE BOARD SPONSOR THEM FOR THE BLOCK EXAM. PAGE 2 SEBASTIAN CONSTRUCTION BOARD - REGBLAR MEETING - 4/14/92 NEW BUSINESS IT WAS NOTED THAT UNDER THE ELECTRICAL MAINTENANCE LICENSE THAT THEY COULD WORK WITHIN A BUILDING FOR THEIR EMPLOYER BUT THAT THEY COULD NOT CONTRACT FOR ANYONE ELSE. VIOLATION HEARINGS FISCHER & SONS, INC./H. FISCHER 1636 N. CENTRAL AVE. MOTION CARRIED. MR. NlCHOLSON GAVE A RUNDOWN OF THE CASE. MR, FISCHER PLEADED NO CONTEST, THAT HE AGREED WITH MR. NICHOLSONo HE ALSO TOLD THE BOARD THAT THEY WOULD BE LICENSED TO DO MASONRY WORK BEFORE THEY DID IT AGAIN AND THAT UNTIL THAT TIME THEY WOULD SUB THE WORK OUT. MR. FISCHER TOLD THE BOARD THAT HE HAS BEEN DOING THIS TYPE OF WORK FOR 17 YEARS A~D THAT HE HAS ALSO BEEN DOING ASSOCIATED CONCRETE worK ALL THAT TIME. FINDING OF FACT: MOTION BY VICE CHAIRMAN DERNBACH, SECONDED BY MR. HANEY THAT WE FIND MR. HENRY FISCHER IN VIOLATION OF SEC. 7-99(A), ACTING AS AN UNLICENSED CONCRETE: FORMING & PLACING CONTRACTOR. ROLL CALL: AYES: MR. MOSBY MR. KELLEY MR. NEUBERGER MR. HANEY VICE CHAIRMAN DERNBACH CHAIRMAN LAMAN NAY: MR. CAPP MOTION CARRIED. MOTION BY VICE CHAIRMAN DERNBACH THAT IN VIEW OF THE FACTS OF THIS CASE THE BOARD SHOULD FINE MR. FISCHER $150.00, SUSPENDED. MOTION DIED FOR LACK OF SECOND. MR. FISCHER WAS PRESENT AT THE MEETING AND SWORN IN BY CHAIRMAN LAMAN. PAGE 3 SEBASTIAN CONSTRUCTION BOARD - REGULAR MEETING-- 4/14/92 MOTION BY MR. NEUBERGER, SECONDED BY MR. MOSBY THAT DUE TO TH~ FACT THAT MR. FISCHER HAS BEEN DOING THIS IN THE PAST AND HE ADMITS GUILT IN THIS PARTICULAR CASE AND ASSURES~Us THAT IT"S NOT GOING TO HAPPEN AGAIN. THEREFORE THIS BOARD SHOULD FIND NO CAUSE FOR ACTION AND THAT THE BOARD SHOULD DO SOME HOMEWORK ON THIS QUITE GRAY AREA. ROLL CALL: AYES: MR. MOSBY MR. KELLEY MR. NEUBERGER MR. CAPP NAYS: MR. HANEY VICE CHAIRMAN DERNBACH CHAIRMAN LAMAN MOTION CARRIED. RUSS THISTLE 1101 FELLSMERE RD./SEBASTIAN LAKES MR. THISTLE WAS SWORN IN BY CHAIRMAN LAMAN. MR. NICHOLSON READ THE VIOLATION TO THE BOARD. MR. THISTLE DESCRIBED HIMSELF AS AN INDEPENDENT SALES'PERSON. THE BOARD WAS GIVEN A BLANK CONTRACT FROM LUKE'S PAINTING TO LOOK AT. IT WAS A STANDARD CONTRACT FORM. IT WAS NOTED DURING THE DISCUSSION THAT ADAM BRUSTOWICZ, LICENSED PAINTING SUB-CONTRACTOR IN THE CITY OF SEBASTIAN COMPLETED THE JOB. MOTION BY MR. NEUBERGER, SECONDED BY MR. HANEY TO TABLE D.NT~IL WE CAN GET MR. PERINCEK HERE AND GET TO THE BOTTOM OF THIS BECAUSE HE IS THE MAJOR OFFENDER HERE. MOTION CARRIED. MR. COOPER 'FELT I'.~i WAS NOT NECESSARY TO BRING MR. THISTLE BACK BEFORE THE 'BOARD. DISCUSSION~ PRESSURE CLEANING FOLLOWING A BRIEF DISCUSSION, IT WAS THE BOARD'S DECISION NOT TO LICENSE ANY TYPE OR PHASE OF PRESSURE CLEANING. PAGE 4 SEBASTIAN CONSTRUCTION BOARD -.REGULAR MEETING MR. HENRY (HANK) FISCHER WAS ASKED TO COME BACK TO THE POBZUN. IT WAS AGAIN NOTED THAT MR. FISCHER HAS BEEN DOING SITE PREPARATION SUCH AS STORM WATER DRAINAGE, CURBS, ETC. FOR THE PAST 17 YEARS. THIS. TYPE OF WORK WOULD COME UNDER THE PAVING, COMMERCIAL~, UNLIMITED LICENSE. MOTION BY MR. HANEY, SECONDED BY MR. CAPP TO GRANT HENRY FISCHER AND SONS A PAVING CONTRACTOR, COMMERCIAL, UNLIMITED UNDER THE GRANDFATHER CLAUSE. MR. COOPER NOTED THAT WE DO NOT HAVE A GRANDFATHER CLAUSE OTHER THAN THROUGH INDIAN RIVER COUNTY. MR. CAPP WITHDREW HIS SECOND. MR. HANEY WITHDREW HIS MOTION. MOTION BY MR. HANEY, SECONDED BY MR. NEUBERGER THAT WE GRANT HENRY FISCHER A PAVING CONTRACTOR, COMMERCIAL, UNLIMITED LICENSE SINCE HE HAS BEEN DOING THIS WORK PRIOR TO THE QUALIFICATIONS WE HAD ADOPTED AND AT THAT TIME HE WAS SHIFTED TO A DIFFERENT CATEGORY WHEN HE SHOULD HAVE BEEN SHIFTED TO THIS ONE. MOTION CARRIED. DISCUSSION: COPPER TUBING VS POLYBUTYLENE PLASTIC PIPE MR. BONACCI TOLD THE BOARD THAT TO HIS KNOWLEDGE, BURGOON BERGER WAS THE ONLY ONE USING THE PLASTIC PIPING AND THAT HE HAD NEVER HEARD ANY COMPLAINTS ABOUT IT. TEST SCORES WERE REGISTERED IN THE SCORE BOOK BY MR. CAPP AND MR. NEUBERGER. THERE BEING NO FURTHER BUSINESS T° DISCUSS~ THE MEETING ADJOURNED AT 9:00 P.M.
