CHAIRMAN CAREY NOTED THAT THE PURPOSE OF THE MEETING IS THE
RECOMMENDATION TO CITY COUNCIL TO AMEND ORDINANCE #0-90-01.
MR. COOPER SAID THE BOARD WOULD BE AMENDING CHAPTER 7 OF THE
CODE OF ORDINANCES, 40-90-0! HAS BEEN ENACTED AND
INCORPORATED INTO OUR CODE OF ORDINANCES.
MR. COOPER WENT OVER THE MEMORANDUM DATED 4/24/90 THAT WAS
GIVEN TO THE BOARD. (COPY ATTACHED)
A LENGTHY DISCUSSION FOLLOWED CONCERNING THE MEMO.
MOTION BY MR. CAPP, SECONDED BY MR. HANEY THAT SECTION 7-93
BE AMENDED AS IT READS IN THE MEMO DATED 4/24/90 BY BRUCE
COOPER TO THE CONSTRUCTION LICENSING BOARD AND THAT THE
LIABILITY AND PROPERTY DAMAGE LIABILITY BE CONSISTENT WITH
THE STATE.
MR. DERNBACH FELT THAT $25,000 FOR RESIDENTIAL CONTRACTOR WAS
NOT ENOUGH.

SECTION 7-93 AS REQUESTED IN PARAGRAPH 3 OF THE MEMO FROM THE
BUILDING OFFICIAL DATED 4/24/90.

CHANGE IN SECTION 7-93, CERTIFICATION, UP TO THE WORDING
"ALSO AMEND FOR SUB-PARAGRAPH D".

MR. COOPER TOLD THE BOARD THAT ALL ROOFING LIMITED
CONTRACTORS WILL HAVE TO REGISTER WITH THE STATE WITHIN 30
DAYS - SHOW PROOF TO THE BUILDING DEPARTMENT THAT THEY HAVE
FILED PAPERS WITH THE STATE.

MR. JIM PARKS, REPRESENTING THE TREASURE COAST ROOFERS
ASSOCIATION TOLD THE BOARD THAT ISSUING A LICENSE TO A
LIMITED ROOFING CONTRACTOR HAS BEEN CREATING A PROBLEM IN
SEBASTIAN AS FAR AS THE INTERPRETATION AS TO WHAT HE CAN DO
OVER AND ABOVE AN UNLIMITED ROOFING CONTRACTOR.
FOLLOWING A BRIEF DISCUSSION, MR. PARKS SAID HE HAD NO
PROBLEM WITH THAT LICENSE AS LONG AS IT WAS A TESTED TRADE.
BUT, HE HAD A PROBLEM WITH THOSE WHO ARE PRESENTLY BEING
GRANDFATHERED INTO THE COUNTY WITHOUT A TEST BEING TAKEN.
MR, COOPER ADVISED MR. PARKS TO CHECK WITH THE COUNTY.
THERE BEING NO FURTHER DISCUSSION, MEETING ADJOURNED AT 8:55

REFERENCE: Contractor Licensing
I informed you at your last regular Construction Board
meeting that the Indian River County Tax License Office (Gene
Morris) was enforcing their ordinance on obtaining an
occupational license for anyone that works within Indian
River County, including the City of Sebastian. The problem
was when a licensed Sebastian competency card holder would
try to obtain this occupational license from Indian River
County,they were then told that they must pass an examination
proctored by Block & Associates. This was due to the
inconsistences of the City of Sebastian and Indian River
County's ordinance on contractors which, the City of
Sebastian had some categories not required to obtain a test
from Block & Associates.
I had a meeting with Ester Rymer of Indian River County,
Building Department, on Thursday April 10, 1990 to discuss
the situation. I successfully negotiated with Ester to allow
all existing license Sebastian competency card holders to be
grandfathered with the Indian River County Building
Department provided they file an application with their
office. This was with the understanding also that the City
of Sebastian would attempt to change their ordinance to be
consistent with the County's in regards to testing of all
trades listed by Block & Associates.
i was preparing to ask City Council to amend the ordinance on
contractors licensing examination fees but, I will now
include a recommendation from the Construction Licensing
Board meeting tonight to also amend our contractor licensing
to be consistent with the County.
The following would be my recommendation to amend the
existing ordinance:
1. Amend Section 7-91 "Specialty Contractors",~ remove
last sentence stating, "provided, however, that the following
types of specialty contractors shall be exempted from the
testing requirements of this section: landclearing, grading,
insulation, floor covering, garage door installatio:n, cabinet
installation, landscaping, aluminum non-structural, water
pump, pressure cleaning and mildew control, roofing limited,
sign painting, vacuum systems, and fences,"
2. Section 7-93 Certification: Amend this section to
require all contractors regulated and defined by Chapter 489
of the Florida Statutes and categories tested by Block &
Associates must obtain a competency card from the City of
Sebastian. Also, amend subparagraph (d) requiring issuance
of certificate subject to satisfactory evidence of obtaining
public liability insurance in the following amounts. I would
recommend that we be consistent with the state and the county
in requiring the following: General and Building Contractors
$300,000.00 Bodily Injury Liability (Personal Liability) and
$50,000.00 Property Damage Liability (Property Insurance),
all others to be required $100,000.00 Bodily Injury Liability
(PersOnal Liability) and $25,000.00 Property Damage Liability
(Property Insurance).
3. Delete Section 7-95 "Special License", this
paragraph confuses whether or not this means a specialty
contractor or someone other than a specialty contractor..
I will also include in the recommendation your previous
motion to accept the fee structure under my memorandum
dated 11/20/89 to Chairman Carey and the Construction Board
Members increasing fees fo~ examinations.
