TIM WILL/AMS, ASSISTANT CiTY ATTORNEY. APPROVAL OF MINUTES: REGULAR MEETING - 4/11/95 MSTION BT CHAIRMAN NEUBERGER, SECONDED BT MR. MESSINA TO APPROVE THE MINUTES AS WRITTEN, NDTION CARRIED. FOLLOWING THE IVlDTION, MR. TOZZOLO NOTED THAT HE DID NOT HELP RECORD THE SCORES OF THE. BLOCK EXAM, THAT iT WAS VICE CHAIRMAN J. SMITH. (THE BOARD SECRETARTMADE THE CHANGE IN THE MINUTES.) TOZZOLO, SECONDED BT VICE CHAIRMAN j. SMITH TO APPROVE LEET, KAHLER, CAPITO, STANT, PHENEGER AND BROWN FOR THE BLOCK EXAM. CHAIRMAN NEUBERGER NOTED THAT STANT HAD A LOCAL BUSINESS ADDRESS AND ASKED IF HE HAD A CITY OCCHPATIONAL LICENSE. MR. COOPER EXPLAINED THAT NEITHER ONE IS ISSUED UNTIL BOTH LICENSES ARE READY TO BE ISSUED. CHAIRMAN NEUBER6ER ASKED THAT STANT AND BROWN BE PULLED FROM THE MOTION. MOTION CARRIED, STANT, BRIAN/CARPENTRY MR. STANT WAS ASKED TO COME TO THE MICROPHONE. MR. COOPER ADVISED HIM TO ~PLT FOR HIS HO~ OCCUPATION LICENSE SINCE IT WILL TAKE SEVE~L WEEKS TO BE APPROVED BY P MOTION BY VICE CHAIRMAN J. SMITH, SECONDED BT MR. MOSBY TO APPROVEMR, STANT FOR THE BLOCK EXAM. NDTION CARRIED. MALEK, THOMAS. M,/CABINET INSTALLATION MR. MALEK WAS NOT PRESENT AT THE MEETIN6. CHAIRMAN NEUBERGER QUESTIONED THE VERIFICATION OF EXPERIENCE. HE NOTED THE VERIFICATION WAS DONE BY A PA. EMPLOYER BHT NOTARIZED BT A FLORIDA NOTARY. MR. TOZZOLO NOTED HE DID NOT SHOW ANY SUPERVISORY WORK. MOTION BT MR. MOSBY, SECONDED BY MR. TOZZOLO TO POSTPONE ANY RECOMV~NDATION ON MR. MALEK UNTIL THESE QUESTIONS CAN BE ANSWERED AND THE BOARD CAN TALK WITH HIM, MDTION CARRIED. BRO~tI~ CAME TO THE MICROPHONE. CHAIRMAN NEUBERGER QUESTIONED HiS EXPERIENCE SHOWING FROM 1992 TO DECEMBER, 1995 I~HICH ISN'T EVEN HERE YET. MR. BROWN EXPLAINED IT WAS A MISTAKE AND HAD A NEW NOTARIZED PAPER DONE WNICH HE GAVE TO THE BOARD. CHAIRMAN NEUBERGER ASKED ABOUT THE TWO SS #'S SHOWING ON THE CREDIT REPORT. MR. BROWN SAID HE WASN'T AWARE OF IT AND DIDN'T KNOW WHT THE SECOND NL[MBER WAS ON THERE. APPROVE MR. BROWN TO TAKE THE BLOCK EXAM. MOTION CARRIED. ,_B~!LDING OFFICIAL MATTERS: DISCUSSION: CREDIT REPORTS MR. COOPER EXPLAINED THAT MANY QUESTIONS HAD ARISEN CONCERNING THE FINANCIAL REPORT VERSES WHAT WE RECEIVE. ATTORNEY WILL/AMS EXPLAINED THAT ONCE THE CREDIT REPORT IS RECEIVED, IT DOES BECOME PUBLIC RECORD, PERSONAL VERSES BUSINESS CREDIT WAS ALSO QUESTIONED. VICE CHAIRMAN SMITH NOTED THE BOARD WAS TO HELP PEOPLE BECOME LEGITIMATE AND THE MAIN THING TO LOOK AT ON A CREDIT REPORT WAS ANYTHING BUSINESS RELATED. MR. COOPER SAID THAT WAS BASICALLTDISCRETIONARY. SOME PERSONAL BAD CREDITCOULD BE DUE TO AN ACCIDENT, ETC':,. ATTOP, NET WILLIAMS SAID THAT IF A PERsoN iS APPLYING AS AN INDIVIDUAL, THAT HIS PERSONAL AND BUSINESS CREDIT WERE ONE IN THE SAME. PAGE 4 SEBASTIAN CONSTRUCTION BOARD - REGHLAR ~ - MAY 9, 1995 DISCUSSION: CREDIT REPORTS, co~t IT WAS THE OPINION OF THE BOARD THAT IF THERE WAS A PROBLEM WITH THE CREDIT REPORT AND THE APPLICANT WAS NOT PRESENT, THE APPLICATION ~OHLD BE POSTPONED IINTIL THE NEXT NDNTH MEETING. THE DECISION WAS MADE THAT IF A CORPORATION WAS NEW, THE CREDIT REPORT SHOULD BE ON THE INDIVIDUAL. IF IT'S AN OLD CORPORATION, THERE SHOULD BE A CREDIT REPORT ON BOTH THE CORPORATION AND INDIVIDHAL. VICE CHAIRMAN J. SMITH QUESTIONED THE LEGALITY OF PUTTING A COPY OF THE CREDIT REPORT IN THE INDIVIDUAL BOARD MEMBER PACKET THAT IS PICKED UP PRIOR TO THE MEETING. MR. COOPER SAID THAT IT WAS AN ETHICAL SITUATION AND THAT AS A BOARD MEMBER IT SHOULD BE HANDLED IN A PROFESSIONAL MANNER. ATTORNEY WILLIAMS SUGGESTED THAT A WAIVER BE SIGNED THAT THE APPLICANT KNOWS THAT ONCE RECEIVED BT THE BOARD SECRETARY, THE CREDIT REPORT BECOMES PUBLIC RECORD AND IS OPENED TO THE PUBLIC. MR. COOPER TOLD THE BOARD THAT HE HAD ATTENDED A BOAF CONFERENCE AND THAT ONE OF THE SUBJECTS DISCUSSED WAS THAT THE STATE CAN NOW PUT A STOP-WORK-ORDER ON ANT JOB SITE THAT THEY FIND AN UNLICENSED CONTRACTOR ON INSTEAD OF TRYING TO COORDINATE WITH US. PER 489.128, CALLED AN UNENFORCEABLE CONTRACT FOR UNLICENSED CONTRACTORS, WE ARE ADVISED PER STATE STATUTES THAT IT IS LiNENFORCEABLE. ALSO, THE LAW HAS BEEN CHANGED TO REQUIRE THAT gHERE THERE IS AN UNLICENSED CONTRACTOR ON ANY KIND OF CONSTRUCTION OF $1,000.00 OR MORE, IT IS A 3RD DEGREE FELONY. AN ELECTRICAL JOB OF $5,000.00 OR MORE IS ALSO A 3RD DEGREE FELONY AND THE POLICE CAN BE INVOLVED iN THE INVESTIGATION. ALSO, DOUBLE FEEIN6 A PERMIT DOES NOT CONSTITUTE DISCIPLINARY ACTION. ONLY THE ACTION BT THE BOARD DOES IT REQUIRE · NOTIFICATION TO THE STATE OF DISCIPLINARY ACTION. PAGE 5 SEBASTIAN CONSTRHCTION BOAR~, - REGULAR MEETING - MAT 9, 1995 CHAIRMAN NEHBERGER INQUIRED ABOUT THE PERMIT FEES, MR, COOPER SAID WE NEEDED TO REVISE AND HPDATE OUR FEE SCHEDULE FOR THE CITY, HE MADE IT CLEAR THAT WE WERE NOT ASKING TO INCREASE FEES. WE HAVE SEVERAL FEES THAT HAVE BEEN TRADITIONALLY CHARGED, BUT THERE ARE NO SPECIFIC REQHIREMENTS IN THE CODES. HE FELT THERE NEEDED TO BE SOME CLARIFICATIONS MADE, MR, COOPER ASKED THAT WE HAVE INPUT FROM THE BOARD TO SHGGEST A FEE SCHEDULE FOR THEIR PARTICHLAR TRADE TO HELP FIG/iRE FEES. CHAIRMAN NEUBERGER ASKED FOR SOMEONE TO CHECK TO SEE IF A LONG TERM LEASE HOLDER CAN QUALIFY AS THE O~NER IF CERTAIN I~ORK NEEDS TO BE DONE. MR, COOPER SAID HE WOULD CHECK WITH THE ATTORNEY. CHAIRMAN NEUBERGER ASKED I~-IEN WE WOULD BE GETTING ANOTHER !'BOB NICHOLSON" AS FAR AS CODE ENFORCEMENT AND UNLICENSED CONTRACTORS WERE CONCERNED. MR. COOPER SAID THERE WAS AN OPENING THAT HE HAD TALKED TO THE CITY MANAGER ABOHT. CHAIRMAN NEUBERGER INQUIRED ABOUT THE VAN DRIVING AROUND WITH !'ECONOMIC ELECTRIC" WRITTEN ON ITS' SIDES, ECONOMY ELECTRIC NO LONGER HAS A QUALIFIER AND THE PERSON DRIVING IS NOT LICENSED. IT WAS ASKED THAT A SURVEY BE DONE ON THE SHRROI/NDING COUNTIES AS TO WHAT GRADE THET CONSIDER PASSING ON THE BLOCK EXAM. DISCUSSION: CULTURED MARBLE MR. COOPER SAID AT THIS POINT A LICENSE WOULD. NOT BE REQUIRED FOR CULTURED MARBLE, BUT BASED ON THE FINDINGS OF THE BOARD, IT COULD THEN BE REQUIRED, IT WAS REQUESTED A SURVEY OF THE TRI-COUNTY AREA BE DONE FOR THE TESTING OF TILE ~MARBLE AND CULTURED MARBLE. TOZZOLO THAT IT BE SUGGESTED THE PACKETS BE GIVEN TO THE BOARD ABOUT ONEWEEK EARLT AND CHANGE THE MEETING TO START AT T:OO P.M. NDTION CARRIED. MR. TOZZOLO ASKED IF BRUCE HAD CHECKED WITH LEGAL STAFF IN REGARDS TO THE TERMITE SHIELD AROUND THE FOUNI)ATION AND MAKE IT A REQUIREMENT. MR. COOPER SAID HE I40ULD BE REVIEWING SOME INFORMATION HE HAD GOTTEN AT THE CONFERENCE IN REGARDS TO TERMITES AND THEN CHECK WITH LOCAL CONTRACTORS TO ENSURE THAT WHAT WE IMPOSE WILL NOT BE A HARDSHIP. HE SAID HE ~ULD ALSO BE LOOKING AT THE STUCCO STOP AS WELL AS THE TERMITE SHIELD. SCORES WERE RECORDED IN THE SCORE BOOK BT VICE CHAIRMAN J SMITH AND MR. MDSBT.
