THE SEBASTIAN CONSTRUCTION BOARD OF THE CITY OF SEBASTIAN, INDIAN
RIVER COUNTY, FLORIDA, WILL HOLD THEIR REGULAR MEETING ON TUESDAY,
JUNE 7, 1988 AT 7:30 P.M. IN THE CITY COUNCIL CHAMBERS.

MEETING WAS CALLED TO ORDER BY CHAIRMAN CAREY AT 7:30 P.M.

MOTION BY MR. HALLGREN, SECONDED BY VICE CHAIRMAN LAMAN TO ACCEPT THE
MINUTES OF 5/3J88'~"AS WRITTEN.
CARRIED.
OLD BUSINESS:
BASSI vs HUSSAIN, GENERAL CONTRACTOR
MR. HUSSAIN WAS NOT PRESENT AT THE MEETING DUE TO A PRIOR COMMITTMENT.
MR. COOPER INFORMED THE BOARD THAT MR.~ BASSI WAS TOLD HE SHOULD SUBMIT
A LETTER STATING HIS PROBLEMS TO THE DEPARTMENT TO ALLOW MR. CO0~ER
TIME TO GO OUT AND DO AN INSPECTION. THIS COULD BE BROUGHT BEFORE
THE BOARD AND MR. HUSSAIN COULD ACT ON THESE COMMENTS.
IT WAS NOTED THAT MR. BASSI WANTED TO USE THE LETTER DATED APRIL 8, 1988
FROM MR. HUSSAIN ON WHICH TOBASEHIS COMMENTS.
MR. BASSI TOLD THE BOARD THAT THE WOOD WAS STILL A PROBLEM. THE WOOD

HE HAD DOCUMENTS FROM WICKS LUMBER AND U.S. PLYWOOD STATING THERE WAS
NOTHING WRONG WITH THE WOOD.
MR. COOPER SAID THE SIDING HAD BEEN COMPLETED AND ASKED IF THERE WAS STILL
A PROBLEM. MR. BASSI SAID THERE WAS.
MR. BASSI SAID THE WEST SIDE OF THE HOUSE WAS BUCKLED. ELSEWHERE, PAINT
IS PEELING AND IS CHANGING COLORS. THE WOOD HAS LARGE CRACKS IN IT -
LOOKS LIKE FISH SCALES AND LARGE AIR BUBBLES.
MR. COOPER SAID AN EXPERT SHOULD HAVE CHECKED THE WOOD BEFOREANYTHING
WAS DONE.
MR. BASSI SAID HE HAD BEEN ADVISED BY HIS ATTORNEY TO LET MR. HUSSAIN
DO WHAT HAD TO BE DONE.
VICE CHAIRMAN LAMAN TOLD THE BOARD THAT HE rS BUILDING A HOUSE DIRECTLY
BEHIND MR. BASSI AND HE HAS LOOKED AT'THE HOUSE, ALTHOUGH NOT IN A~
OFFICIAL CAPACITY. THERE ARE CERTAIN SECTIONS WHERE THE PAINT IS LIFTING
FROM 'THE PAINT UNDERNEATH.

GOING OVER THE LIST FROM 4/8, MR. BASSI WAS STILL NOT SATISFIED WITH
4 ITEMS: I) GARAGE DOOR LOCK; 2) SUPPORTS UNDER THRESHOLD;
3) WOODEN PULLS ON KITCHEN CABINETS; 4) DEFECTIVE PIECE OF SIDING.
MR. COOPER SAID HE WOULD GO OUT AND CHECK THE 4 ITEMS. HE A~$O,TOLD
MR. BASSI THAT HE SHOULD GET THE EXPERTS TO PRESENT INFORMATION CON-
CERNING THE EXISTING SIDING AND FORWARD IT TO THE BOARD.
MR. BASSi SUBMITTED DOCUMENTS FROM THE SUPPLIERS TO THE BOARD.
MR. COOPER NOTED THAT FROM THE DOCUMENTS, EVERYTHING WAS FiNE EXCEPT
FOR ONE PIECE.
MR. BASSI SAID THERE WERE STILL PROBLEMS.
MR. QIZILBASH, CERTIFIED GENERAL CONTRACTOR WHO WORKED FOR MR. HUSSA1N
WHEN MR. BASSi'S HOUSE WAS BEING BUILT TOLD THE BOARD THAT THE WOOD WAS
LEFT EXPOSED FOR ABOUT 3 WEEKS.
MR. COOPER SAID HE WOULD REINSPECT THE FOUR REMAINING PROBLEMS AND
GIVE HIS FINDINGS TO THE BOARD.
MR. COOPER ALSO ADVISED MR, BASSI TO GET PEOPLE TO SUBSTANTIATE. HIS
CLAIMS ABOUT THE WOOD - MAINLY SUPPLIERS OR MANUFACTURERS OF MATERIALS.
LIBRIE vs AMERON HOMES
MR. LIBRIE TOLD THE BOARD THAT HE FELT AMERON HOMES WAS RESPONSIBLE
FOR THE TERMITES IN THE PLANTERS SINCE THE WOOD WAS PUT RIGHT INTO THE
SOIL. THE WOOD WAS NOT TREATED.
MR. DAN BROGNANO, OWNER OF AMERON HOMES WAS NOT PRESENT AT THE MEETING.
MR. COOPER SAID THAT IN HIS OPINION, THE WOOD HAD NOT BEEN TREATED.
IT WAS NOTED THAT THE HOUSE WAS THREE YEARS OLD.
MR. COOPER TALKED TO MR. BROGNANO WHO FELT THE HOUSE WAS PROPERLY
BUILT-AND THAT THE ELEVATION WAS HIGH ENOUGH.
CHAIRMAN CAREY REQUESTED A WRITTEN REPORT FROM MR. COOPER. HE ALSO
REQUESTED THAT MR. BROGNANO BE PRESENT AT THE NEXT MEETING.
MOTION BY MR. CAPP, SECONDED BY MRs. HALLGREN THAT MR. DAN BROGNANO,
AMERON HOME~ BE SERVED"A SUBPOENA TO APPEAR BEFORE THE BOARD AT THE
JULY MEETING.
CARRIED.
MR. COOPER SAID HE WOULD GO AHEAD AND TAKE PICTURE OF THE PROBLEM
TO SUBSTANTIATE THE COMPLAINT SO THAT MR. LIBRIE COULD GO AHEAD AND
HAVE HIS HOUSE TREATED.

MR. COOPER NOTED THAT THE MOTION SHOULD INCLUDE ASKING THE QUAEIFIER
OF AMERON HOMES TO ALSO APPEAR BEFORE THE BOARD SINCE MR. BROGNAND IS
NOT THE QUALIFIER.
MR. LIBRIE TOLD THE BOARD THAT AT THE TIME HIS HOUSE WAS BUILT, JOHN
LAMAN WAS THE QUALIFIER.
SECOND WITHDRAWN BY MR. HALLGREN, MOTION WITHDRAWN BY MR. CAPP.
MOTION BY MR. CAPP, SECONDED BY MR. HALLGREN TO SUBPOENA MR. BROGNANO.
OF AMERON HOMES AND REQUEST THE QUALIFIER OF THE PREMISES WHEN IT WAS
BUILT BE PRESENT AT THE JULY MEETING.
CARRIED.
BURTON vs AETNA ENTERPRISES, INC. (& BAYVIEW BUILDERS, INC.)
MR. COOPER TOLD THE BOARD THAT HE HAD AN AGREEMENT SIGNED BY THE
APPLICANT, MR. BURTON & AETNA ENTERPRISES WITHDRAWING THE COMPLAINT
AT THIS TIME, ALLOWING 45 DAYS TO SEE IF THE AGREEMENT CAN BE-WORKED
OUT. THIS WAS DONE BY AN ATTORNEY.
NEW BUSINESS:
A SHORT RECESS WAS CALLED AT 8:27 P.M.

FOLLWOING A BRIEF DISCUSSION, CHAIRMAN CAREY ASKED MR. MUENCKLER TO GET
MORE INFORMATION FROM THE SURROUNDING AREAS AND SUBMIT IT TO THE BOARD.
BUILDING OFFICIAL MATTERS:
MR. COOPER PASSED OUT COPIES OF THE PROPOSED BUDGET.
THE BOARD SECRETARY QUESTIONED THE AMOUNT BUDGETED FOR EDUCATION.
ATTORNEY FEES WERE ALSO DISCUSSED. MR. COOPER TOLD THE BOARD THAT THE
NEW ATTORNEYS CHARGED BY THE HOUR.
MR. COOPER SAID HE WOULD CHANGE EDUCATIONAL TO $250.00 AND ATTORNEY FEES
TO $1,200.00.
TOTAL BUDGET - $6,375. O0
MOTION BY MR. HALLGREN, SECONDED BY VICE CHAIRMAN LAMAN TO APPROVE THE
BUDGET AS SUBMITTED.

"HANDYMAN" LICENSE
FOLLOWING A BRIEF DISCUSSION IT WAS DECIDED THAT THIS WOULD BE BROUGHT
BACK TO THE BOARD AT'-A LATER DATE.
MR. DERNBACH AND MR. CAPP REGISTERED THE TEST SCORES' IN THE SCORE BOOK.
