THIS ADDENDUM made and entered into this 12" day of November 2025 by and
between the City of Sebastian (City) and Brian Benton in his capacity as the City Manager for
the City of Sebastian, FL, (City Manager).
WITNESSITH:
WHEREAS, the City and the City Manager entered into an Employment Agreement dated
September 14, 2023 (hereinafter "Agreement"); and
WHEREAS, THE City and City Manager desire to amend the Agreement to allow the City
Manager to enter the City's Employee Retirement Plan that was created via Ordinance No. 0-
25-13 on September 241h, 2025.
NOW, THEREFORE, in consideration of the mutual covenants herein contained, the
Agreement is hereby amended as follows:
Section II. Compensation and Benefits is amended to add this additional language:
4. The City agrees to allow the City Manager to participate in the City's Employee Retirement
Plan and contribute the amount required, per the actuarial valuation. based on the percentage
contributed to the plan by the City Manager with an effective enrollment date of 10/1/2025.
The contribution shall be made pursuant to the terms and conditions of the Retirement Plan.
including any vesting schedule. The City agrees to contribute to a 457 deferred compensation
plan, an amount equal to nine (9%) of the City Manager's base salary during the pay periods in
which the City Manager is not vested in the Retirement Plan. The contribution shall be made on
a biweekly basis based on the number of pay periods by year.
IN WITNESS WHEREOF, the parties have caused this Agreement to be duly executed in
Sebastian, Florida on the date set forth above.
