Motion carried. BLOCK EXAM: BLACK, RiCHARD LYNN - Carpentry Mr. Richard Lynn was present and was sworn in by Chmn. Smith. MOTION by Cecrle/Herbig I make a motion that we approve Mr. Black to take the Block Exam. Roll call was taken. TOTH, LANE E. - Carpentry Mr. Lane Toth was present and was sworn in by Chnm. Smith. MOTION by HoldridgedCecrle I make a motion that Mr. Toth be able to take the exam for carpentry. ROWSEY, ROY L. - Painting Mr. Rowsey was not present. It was detezmin~ that since this is the third time Mr. Rowsey has failed to attend a meeting that his appearance was scheduled, and since he was notified prior to this meeting that his failure to attead would result in having to start all over in the licensing routine, it was determined that Mr. Rowsey will have to re-apply with a $75.00 application fee. ~OLAT.!ONS HEARINGS: RUSSELL, MIKE ~ 1342 Laconia Street Mr. Bonacei gave staff presentation, noting that on November 3, 1995, a permit was applied for for a swimming pool at 1342 Laconia, as an owner-builder, the contractor being Betty lane Parker. He noted that, at that time, Mike Russell came forward and told Mr. Bonacci that Ms. Parker was his Aunt. Mr. Russell noted that he had installed pools for many years in Brevard County and he was helping his Aunt, with no money involved. The permit was issued showing SJR Pools as a sub-contractor, and they did the excavating. Mr. Bonacci continued, that Be-Safe Electric did the electrical work. About a year ago, in the process of having an addition added to the house, Chuck G-eisz, a building respecter for the City was approached by the homeowner (Ms. Parker) and the story came out that Mr. Russell contracted the job as a pool contractor. Mr. Bonacci indicated a copy of a contract to Betty Jane and Denise Parker from Mike Russell, (Exhibit A) andhe passed it around for Board members to see. Ms. Demse Parker of 1342 Laconia Street was present and was sworn in as an interested party. She proceeded to give a description of this problem. In her description, she noted that she had to call the police at one point because Mr. Russell was yelling and screaming at her mother about money, and the job had not yet been completed. Afar a comment by the police officer, she and her mother paid the money to Mr. Russell, but even at~er several phone calls, he never came back to complete the job. CONSTRUCTION BOARD MINUTES OF REGULAR MEETING OF JUNE 10, 1997 Ms. Parker noted that Mr. Russell was a friend of a friend of hers, and indicated that he was licensed. She noted that she and her mother are not related in any way to Mr. Russell. She commented that Mr. Russell commented that he didn't finish the work because she called the police on him. She then noted that afar telling Mr. Geisz the reasons the pool project was not finished, he was going to look rote the situation, as it was never given final approval by the building inspector. In response to a question from Chnm. Smith, Ms. Parker stated that Mr. Russell had told her hc was licensed, so she was not aware that he was not licensed. At this point, Mr. Bonaeci referred to a memo from Mr. Geisz, dated May 22, 1997, .giving an accounting of Mr. Geisz's findings since 11/5/96, and noting the violations for which Mr. Russell is responsible. He noted that Mr. Russell was finally located and the subpoena served on May 22, 1997. During discussion, it was established that a separate permit was pulled for the pool enclosure (FabTech .Co, from Melbourne, FL), and the property owner, Ms. Parker, paid this Company directly. Mr. Mike Russell of 1955 Tallpalm, Melbourne, FL, and was sworn in by Chnm. Smith. Mr. Russell admitted he was in violation for not being licensed in Sebastian. He also stated that he never contracted to build the entire peel. He proceeded to explain his participation in this project. He noted that he did not know he was working in Indian River County, but thought he was still in Brevard County. He also noted that he was just acting as an intemuxiia~ to help as a favor. He denied threatening Ms. Parker's mother. He also stated that he has lived in Brevard County for fifkcn (15) years and had never been to indian River County or Sebastian before. MOTION by CecrleA-Ierbig I make a motion that we fine Mr. Russell for five Unlicensed Contractor. (Code 26.171(a)) hundred dollars ($500) for the Michael Herbig - yes Pierre Paquette - yes Michael Holdridge - yes Chnm. Jerald Smith - yes Thomas Cecrle - yes The vote was 5 - 0. Motion carried. Chmn. Smith informed Mr. Russell that he could appeal this finding. MOTION by Herbig/Pacquette I make a motion that we find Mr. Russell in violation of 26-171 (1), Willful Disregard of the Building Codes, with a fine of five hundred dollars ($500). B~JILDING, OFFICIA,,L MATTERS: Chmn. Smith asked about the Ordinance concerning the termite shield, and Mr. Bonaeei responded that it has had the first reading, and it should have the second reading next Wednesday, (6/18/97), and after be, co~ final, all contractors will be notified. Mr. Bonacci reported that in re~e~ence to Versa Builders, the qualifier has left the State of Florida and we are no longer able to contact him. Through the City Attorney, there is an attempt to have his license revoked.
