NEUBERGER VICE CHAIRMAN LAMAN MR. HANEY MR. DERNBACH CHAIRMAN CAREY ABSENT: NONE ALSO PRESENT: BRUCE COOPER, BUILDING OFFICIAL RECESS WAS TAKEN AT 7:31 P.M. SO THAT THE BOARD COULD REVIEW ALL OF THE APPLICATIONS. MEETING WAS REOPENED AT 8:05 P,M. WITH ALL PRESENT. APPROVAL OF MINUTES MOTION BY MR. HANEY, SECONDED BY MR. DERNBACH TO ACCEPT THE MINUTES OF MEETING HELD B/18/90. CARRIED. NEW BUSINESS: CHANGE OF STATUS SANDERS JR., EARL R./ELECTRICAL CONTRACTOR MOTION BY VICE CHAIRMAN LAMAN, SECONDED BY MR. CAPP TO ACCEPT CHANGE OF STATUS'APPLICATION. MR. HANEY QUESTIONED PAGE 3 OF THE APPLICATION - MR. SANDERS WAS BEING SHOWN AS THE QUALIFYING AGENT BUT HE DID NOT FILL OUT WHETHER HE WAS GOING TO HAVE ANY OWNERSHIP IN THE FIRM. MR. CAPP WITHDREW HIS SECOND, VICE CHAIRMAN LAMAN WITHDREW HIS MOTION. JENKINS APPLICATION DUE TO THE FACT HE HAS NO VERIFIABLE CONSTRUCTION EXPERIENCE. HIS APPLICATION SHOWS TIME AS MAINTENANCE MECHANIC IN A LiFT STATION. THERE IS SOMETHING FROM AN ELECTRICAL CONTRACTOR BUT IT DOES NOT SAY WHAT HE DID. CARRIED. CHAIRMAN CAREY NOTED THAT PAGE 6 NEEDED TO BE CLARIFIED. NIEBEL, PAGE 4 WAS NOT COMPLETED. MR. KELLEY WITHDREW HIS SECOND, MR. HANEY WITHDREW HIS MOTION. MOTION BY MR. NEUBERGER, SECONDED BY MR. HANEY TO ACCEPT MR. DAIGE AND MR. WRIGHT AND SPONSOR THEM FOR THE BLOCK EXAM IN GAINESVILLE. CARRIED. MR. ROSS PHILLIPS SPOKE TO THE BOARD IN REGARDS TO HIS VERIFICATION OF EXPERIENCE. MR. PHILLIPS SAID HE HAD COPIES OF BUILDING PERMITS AND C/O'S ISSUED BY INDIAN RIVER COUNTY AND COPIES OF INCOME 'TAX RETURNS SHOWING HIM AS THE CONTRACTOR. MR. NEUBERGER FELT THAT C/O'S DID NOT SHOW PROOF OF EXPERIENCE. THE BOARD SECRETARY ASKED WHY A C/O COULD NOT BE USED SINCE INSPECTIONS WERE MADE DURING CONSTRUCTION TO MAKE SURE IT WAS BEING DONE ACCORDING TO CODE. MR. COOPER SAID IF THE C/O OR PERMIT SHOWED MR. PHILLIPS AS THE CONTRACTOR THAT IT COULD BE USED TO VERIFY EXPERIENCE. ~MOTION BY MR. CAPP, SECONDED BY MR. DERNBACH TO SPONSOR MR. PHiLLIP FOR THE BLOCK EXAM IN GAINESVILLE. CARRIED. PAGE 4 SEBASTIAN CONSTRUCTION BOARD - 6/12/90 NIEBEL, DAVID R./PAINTING SUB-CONTRACTOR MR. NIEBEL SPOKE TO THE BOARD. IT WAS NOTED THAT THE AFFIDAVIT ON THE APPLICATION WAS NOT SIGNED. MOTION BY MR. HANEY, SECONDED BY MR. KELLEY TO SPONSOR MR. NIEBEL FOR EXAMINATION IN GAINESVILLE AFTER HE FILLS OUT PAGE 4 AND ANY OTHER MISSING DETAIL, SUBJECT TO REVIEW FROM MEMBERS OF THIS BOARD. HANEY, SECONDED BY MR. NEUBERGER TO ACCEPT THE APPLICATION FOR DAVID NIEBEL FOR BLOCK EXAM IN GAINESVILLE. OLD BUSINESS DISCUSSION: CARRIED. INSURANCE REQUIREMENTS MR. COOPER TOLD THE BOARD THAT HE NEVER RECEIVED A RESPONSE FROM THE STATE AS TO WHY THEY REQUIRE THE AMOUNTS OF INSURANCE THEY DO. HE TOLD THE BOARD THAT HE WOULD CALL MILT RUBiN TO FIND OUT WHAT THE SITUATION IS. PAGE 5 SEBASTIAN CONSTRUCTION BOARD - 6/12/90 INSURANCE REQUIREMENTS cont THE BOARD SECRETARY WAS ASKED TO SEND A LETTER IN REGARDS TO THIS MATTER FOR CLARIFICATION IN WRITING. DISCUSSION: LEWIE GREEN II - DRYWALL LEWIS GREEN, A-1 PLASTERING SPOKE TO THE BOARD. HE TOLD THE BOARD THAT WHEN HE BROUGHT IN HIS STATE REGISTRATION FOR DRYWALL, HE WAS INFORMED THAT THERE WAS NO FILE SHOWING HIM AS A DRYWALL SUB-CONTRACTOR. UPON CHECKING HIS FILE FOR STUCCO/PLASTERING, THERE WAS SOME EVIDENCE THAT HE HAD ALSO APPLIED FOR A DRYWALL COMPETENCY IN 1986. A BRIEF DISCUSSION FOLLOWED. MOTION BY MR. DERNBACH, SECONDED BY MR. CAPP THAT WE RECOGNIZE MR. GREEN AS HAVING A DRYWALL LICENSE FROM 10/14/86 MEETING OF THE SEBASTIAN CONSTRUCTION BOARD WHERE HIS CHANGE OF STATUS WAS CHANGED FROM AN INDIVIDUAL TO A CORPORATION, STUCCO AND DRYWALL. CARRIED. DISCUSSION: USE OF UNLICENSED SUBS - CLIMATROL - MONSOUR MR. COOPER GAVE A BRIEF DESCRiPTiON OF THE SITUATION. MR. JEFF FLANNERY, REPRESENTATIVE FOR CLIMATROL ALSO SPOKE TO THE BOARD. MOTION BY MR. CAPP, SECONDED BY MR. NEUBERGER THAT THE RECORD REFLECT THAT CLIMATROL, WITH JEFF FLANNERY REPRESENTING THEM, WAS BROUGHT BEFORE THE BOARD FOR USING UNLICENSED SUB- CONTRACTOR. IF THIS OCCURS AGAIN, DPR WILL BE NOTIFIED. CARRIED. DISCUSSION: FINE AGAINST RICHARD VAETH MR. NEUBERGER NOTED THAT HE HAD MADE A MOTION AT THE MAY MEETING THAT THIS DISCUSSION BE TABLED UNTIL THE JUNE MEETING SINCE THE TWO PEOPLE INVOLVED IN THE MOTION WERE ABSENT. MR. COOPER SAID THE ORIGINAL QUESTION WAS IF THE BOARD COULD FiNE MR. VAETH FOR INDIVIDUAL JOBS BASED ON THE ATTORNEY'S DECISION WHICH WAS, AS A GENERIC QUESTION, THAT HE COULD BE FINED FOR EACH HOUSE. HANEY THAT WE FINE RICHARD VAETH $500.00 FOR EACH VIOLATION, EACH OF THE THREE, IN REGARDS TO HIM BEING FOUND GUILTY OF SECTION 7-99, SUB- PARAGRAPH A BY THE SEBASTIAN CONSTRUCTION BOARD. CARRIED. DISCUSSION: MERCEDES HOMES, INC. VS. CITY OF SEBASTIAN MR. COOPER TALKED TO ATTORNEY NICK TSAMOUTALES. THAT THE BOARD COULD NOT BE SUED PERSONALLY. HE EXPLAINED THE ATTORNEY WOULD ALSO BE CHECKING WITH OUR INSURANCE CARRIER TO FIND OUT IF THEY WOULD BE REPRESENTING THE BOARD INSTEAD OF ATTORNEY TSAMOUTALES. THE BOARD SECRETARY ASKED THE BOARD ABOUT THE GRANDFATHERING THAT WAS GOING TO BE TAKING PLACE. MR. COOPER NOTED THAT NO SPECIAL CATEGORY WAS PUT iNT© THE FEE SCHEDULE FOR GRANDFATHERING. HE FELT A NORMAL APPLICATION SHOULD BE FILLED OUT AND PAY THE FEE. AS LONG AS THEY CAN SHOW A CURRENT INDIAN RIVER COMPETENCY CARD IT WOULD NOT BE NECESSARY FOR THE APPLICATION TO COME BEFORE THE BOARD, THAT IT BE HANDLED iN-HOUSE. CREDIT REPORTS iWOULD NOT BE REQUIRED. THE BOARD ASKED THAT A LIST BE GIVEN TO THEM SHOWING THE NAMES OF THOSE RECEIVING A COMP CARD THROUGH GRANDFATHERING. MR. HANEY AND MR. DERNBACH REGISTERED SCORES IN THE SCOREBOOK. THERE BEING NO FURTHER BUSINESS, MEETING ADJOURNED.AT 9:50 P.M.
