All members present.
The first item of discussion was the application of Mr. Robert White.
This is the person who was asking for a Residential Contractor's license
from this Board, and we could not make a final decision until a full
Board was present.
Everyone was familiar with the background of this application, so we did
not have to discuss it again.
Ed Paluch made the motion that we reject this application. This motion was
seconded, then Huston Tripp made an amendment to the motion, to say:
That due to the circumstances of the evidence that has arisen from
the original application, we are declining this applicatio~ a~T~az~
Ail in favor, none opposed.
The next item of discussion was the matter of a licensed sub-contractor
who'had lost his original certificate, due to a fire in his off:ice. He
requested a duplicate and was so granted one. He is Mr. Charles Bluford
Power, d/b/a Chuck Power's Aluminum Products of Veto Beach.
.A certificate of competency was issued, through reciprocity with Brevard
County, to S&O Air Conditioning, Inc. They will be doing the H~RV work
in the~new Southern Bell building across the street from the City Hall.
This certificate will be issued after they submit a credit re~ort and
proof of insurance..
Mr. Francis Oberbeck re-submitted his original application to take the
'Block test, to be given in September. He had attempted to take this exam
in the past, and failed. Huston Tripp made the motion, Cliff Hoose seconded
it, that we allow Mr.-Oberbeck to take the next scheduled exam in September.
All in favor, none opposed.
Art had a topic of discussion that he brought up at this meeting. · He asked
the Board that, if a sub-contractor does not need a permit for the'work he
does, can we issue that person a special license without having to take
a test? In other words, if a drywall contractor does not need a permit
to do a job, why don't we issue him a license (not ~ certificate of com-
petency) as long as he posts insurance and workman's compensation?
The discussion that followed involved the comments of several of ~he Board
members. They all felt that, as this i~ a Competency Board, how could we
issue a certificate of competency if we don't test a person's competency?
The laws of this Board, as it now sta~s and is set up, does require a
test, in any category that we require a person to-hold a license for.
This Board was set up with the intention that only competent contractors
work within the city limits of Sebastian. If we do not test a person's
competency, how can we, in all conscience, confirm that competency? The
Board felt that all persons, who did not fall under the grandfather law,
and all persons who are requesting a certificate ~ithout a reciprocal
agreement, be tested prior to us issuing him a license.
A discussion then followed about contractors who are hiring unlicensed sub-
contractors. The general (contractor) will say, when asked, that he is
hiring the man and paying him by the hour, when we know that the parti-
cular job in question has been subbed out, on a contract basis.
Mr. Wallace Norman, Field Investigator with the Florida ConStruction In-.
dustry Licensing Board ~was present at this meeting. He stated.to the
Board that, ~if we get him one contractor, who we can.prove is aiding and
abetting an unlicensed man, whether he is a registered or certified con-
tractor, that he will bring him up before the Board and work on the case..
As soon as that happens, he assured us, the wor~ will get around.
Art then discussed the m~tter of an Owner-Builder problem we have with one
gentleman in particular. He has already been issued an Owner-Builder"~
permit, his son has already gotten one and now, this man is trying to
secure a permit in his daughter's name. She is under 18 yrs. of age
and is still in high school. We (the Building Dept.) had been advised
by our attorney, that under the Florida State Statutes, we could not
issue a permit to a minor, unless that minor would get married. Mr.
Norn~n was told of the building site in the Sebastian Highlands that
already has forms and blocks and a septic tank on it and we have not
issued him a building permit for any of this work. Mr. Norman then
suggested to Art to go out and take pictures of what work is done there
and then take it all to the State's Attorney's office for prosecution and
then go from there. This Owner-Builder also has a sign on the lot that
says to the effect that they "will Build to Suit".
The next meeting of the Board will be August 8, 1979 at 9:30 a.m. We
will review any applications from persons wishing to take. the test at
that time.
