THE PROPOSED PERFORMANCE BOND ORDINANCE WAS ADDED TO THE AGENDA FOR DISCUSSION.
CHAIRMAN BALLOUGH STATED ~ CONSTRUCTION BOARD HAD WRIITEN A PERFORMANCE BOND
ORDINANCE THAT WAS TAKEN TO THE CITY COUNCIL WHERE IT WAS MET WI%~H SOME DISFAVOR.
COUNCILMAN VALIONE WAS ASKED TO ATTEND THIS MEETING TO MAKE SOME SUGGESTIONS FOR
AN ACCEPTABLE BONDING ORDINANCE.

DISCUSSION - PROPOSED AMENDMENTS TO %/-IE ELECTRICAL CODE - MR. DOMINIX
MR. DOMINIX WENT OVER THE PROPOSED AMENDENTS TO THE ELECTRICAL CODE.

THERE WAS A DISCUSSION ON SPECIALTY TRADES NOT BEING ABLE TO PULL PERMITS.
CHAIR~ BALLOUGH STATED THAT THEY WERE TRYING TO MAKE SOME (/tANGES ON THE
STATE LEVEL AND THAT UNTIL THEN NO CHANGES WERE BEING MADE BY qTHE BOARD.
THERE BEING NO FURTHER DISCUSSION, qTHE MEETING ADJOURNED AT 9:25 P.M.

I have reviewed the proposed draft ordinance requiring
performance bonds for certain individuals to obtain &
~uilding permit in Sebastian City limits. The following
are my con~nents;
1)i'i'State Law regulates the work of registered architects,
e~iheers and surveyors. ! don't see the need of
p~r£ormance bonds for these individuals. Otherwise
t~e~- construction board wil! be ruling over the State of
Florida Department of Professional Regulation.

2) Standard Building Code Section A 103.5, Page 372,
1985 Code, states conditions for contractor license and
bond requirements very clearly. No additional rules
are needed, otherwise a more extensive paper work will
result to enforce it.
3) Finally, as stated on the proposed ordinance,
any one of the five (5) findings of fact as per my point
of view are sufficient for not allowing a contractor,
corporation or other entity to work within the city limits.
Therefore, I see no reason to request performance bonds
f°'r someone we know, from the beginning shall create
problems. The best thin9 to do is not give them peri, its
to work in the city.

In the Standard Building Code this City hms adopted, I refer to
Section A103.5, (1985), Contractor License.
I quote, "and it shall be the further duty of every such person
to give good and sufficient bond in sum prescribed and as req%tire~
by the administrative authority and approved by the Dep&r~a~nt Qf
Law, conditioned to conform to the building regulations,...".
I do believe the intent is very good, however, I feel that the
problems lie in ~he enforcement of codes rather than Just passing
another code.
I do not feel, that I can give this proposed Ordinance a faworable
recommendation.
