NEUBERGER NOTED THAT MR, MEADE SHOWED EXPERIENCE FOR MAINTENANCE BUT NOTHING IN EXPERIENCE FOR BUILDING, MR. MEADE TOLD THE BOARD THAT HE HAD BEEN IN CONDOMINIUM MANAGEMENT~ AS WELL AS A CLEANINO AND MAINTENANCE BUSINESS. THE BOARD SECRETARY EXPLAINED THAT SINCE THERE IS NO HANDYMAN'S LICENSE~ THAT IN THE PAST~ THEY HAVE APPLIED FOR THE RESIDENTIAL CONTRACTORS LICENSE WHICH WOULD ALLOW, THEM TO DO DIFFERENT TRADES UNDER ONE LICENSE. FENCING AT THE BARBER STREET SPORTS COMPLEX, THE ONE LOW BID WAS NOT LICENSED AT THE TIME, WE HAD THE APPLICATION WHICH IS MINUS A FEW'ITEMS AT THIS TIME. DUE TO THE AMOUNT OF SAViN~S.~ON THIS BID',':'WE HAVE TWO OPTIONS: TO HEAR THE APPLICATI~N'~ TONIGHT AND MAKE CONDITIONS FOR THE APPROVAL OR HAVE A SPECIAL MEETING, MOTION BY MR. NEUBERGER, SECONDED BY MR. CAPP TO ADD THE APPLICATION OF LORI ANDERSON TO THE ?/13/93 AGENDA. · MOTION CARRIED. FOLLOW.lNG A BRIEF DISCUSSION, BECAUSE OF THE MISSING ITEMS, THE BOARD FELT THEY WOULD PREFER A~:SPECIAL MEETING. ~HE BOARD SECRETARY WOULD SET UP THE SPECIAL MEETING AS SOON AS ALL OF THE MISSING ITEMS WERE' RECEIVED AND THE APPLICATION WAS COMPLETE. BERNIE ZIMILINGHAUS 929 FULTON WAY/30 RIVER OAK DR. CHAIRMAN LAMAN NOTED THAT MR, NEUBERGER HAD A CONFLICT OF INTEREST AND THAT HE WOULD TAKE PART IN THE DiSCUS.$'ION. BUT WOULD NOT VOTE, MR, COOPER WAS SWORN IN BY CHAIRMAN LAMAN. MR, COOPER TOLD OF A SIMILAR CASE INVOLVING THE CHAIRMAN OF THE CODE ENFORCEMENT BOARD~ THAT THE CHAIRMAN STEPPED DOWN, MR, NEUBEROER STATED THAT HE WOULD NOT BE INFLUENCING THE BOARD, IT WAS DETERMINED THAT MR, NEUBERGER WOULD PARTICIPATE BUT NOT VOTE. KEN WATERS~ ELECTRICAL CONTRACTOR WAS NOT PRESENT AT THE MEETING. MR. COOPER STATED THAT DURING HIS INVESTIGATION, HE DID. NOT FEEL THERE WAS INTENT FOR HIM (WATERS) TO VIOLATE ANY CODE. IT WAS NOTED THAT MR. WATERS WAS THE NAMED ELECTRICIAN ON THE TWO PERMITS. MR. COOPER INTRODUCED EXHIBITS I & 2 TO THE BOARD. EXHIBIT 1 WAS A COPY OF A BUILDING PERMIT FOR 39 RIVER OAK DR.- KENNETH WATERS WAS NAMED AS THE ELECTRICIAN AND A SIGNATURE OF KEN WATERS ELECTRIC WITH NO DATE. EXHIBIT 2 WAS AN ELECTRICAL PERMIT FOR 929 FULTON: WAY, AGAIN WITH THE SIGNATURE OF A KEN WATERS,'5/$/93. THE TWO CONTRACTORS WERE FASHION HOMBS~ AND L & L BUILDERS. BOTH CONTRACTORS SURMISED THAT THEY WERE DEALING WITH KEN WATERS TO DO THE ELECTRICAL ON THESE HOMES. MR. COOPER EXPLAINED THAT IN DISCUSSION WITH MR. WATERS, MR. ZIMILINGHAUS HAD DISCUSSIONS WITH MR. WATERS AND THERE WAS SOME KIND OF BUSINESS ARRANGEMENT IN THE MAKING WHERE MR. ZIMILINGHAUS WAS GOING TO WORK FOR MR. WATERS AND MR. WATERS HAD EVEN GIVEN HIM A COPY OF HIS CERTIFICATE OF INSURANCE AND SOME BLANK WORK ORDER FORMS. IT WAS EXPRESSED BY MR. WATERS TO MR. ZIMILiNGHAUS THAT THAT WOULD, BE A SITUATION THAT WOULD BE WORKED OUT BUT THAT HE COULD NOT PULL THE PERMITS. AT THE TIME THAT MR. COOPER TALKED TO MR. WATERS HE WAS NOT AWARE OF THESE JOBS THAT.WERE ACTUALLY STARTED. HE WAS AWARE OF WORKING WITH FASHION HOMES TO"OET A JOBs NOT THAT THEY WBRE ACTUALLY STARTED. IN TALKING WITH THE OFFICE MANAGER OF L & L BUILDERS, IT WAS FOUND THAT THERE WAS A CHECK MADE PAYABLE TO KEN WATBRS~. REQUESTED BY MR. ZiMILINGHAUS WHO CAME BACK LATER AND ASKED THAT THE CHECK BE DONE IN HIS NAME BECAUSE HE WAS A PARTNER. A NEW CHECK WAS ISSUED. PAGE 5 SEBASTIAN CONSTRUCTION BOARD - REGULAR MEETING - 7/13/93 MR. COOPER SUBMITTED A COPY OF A LETTER DATED 5/14/93 FROM L & L BUILDERS, ALSO A COPY OF THE CHECK MADE OUT TO BERI~IIE ZIM.ILINGHAUS IN THE AMOUNT OF $1,203.00. TALKING WITH FASHION .HOMES, MR. COOPER FOUND THAT THEY WERE WORKING WITH WATERS ELECTRIC. MR. ZIM,ILINGHAUS WAS IN THEIR OFFICE ON SEVERAL OCCASIONS TALKING WITH THE SECRETARY. MR. COOPER HAD A COPY OF A CHECK MADE PAYABLE TO KEN WATERS IN THE AMOUNT OF $1,700.00. (.IT IS NOTED THAT THIS CASE WAS ALREADY IN THE HANDS OF ONE OF THE DETECTIVES FROM THE SEBASTIAN POLICE DEPT.) IT .WAS FOUND THROUGH THE INVESTIGATION WITH THE DETECTI:~ES THAT THIS CHECK WAS PICKED UP BY MR. ZIMILINGHAUS, l~l-lO ALSO CASHED IT. MR. COOPER NOTED THAT IF THE BOARD LOOKED AT THE SIGNATURES ON THE APPLICATIONS, IT WAS FOUND THAT THE SIGNATURES WERE NOT BY MR. WATERS BUT ACTUALLY BY BERNIE ZIMILIN~HAUS. MR', ZIMiLINGHAUS HAD INDICATED THAT HE FELT HE WAS WORKING FOR KEN WATERS AND THEREFORE WAS SIGNING..THE PERMITS iN KEN WATERS BEHALF. THE DETECTIVE TOLD HIM THAT HE COULD NOT SIGN SOMEONE ELSE'S NAME. CHAIRMAN LAMAN SWORE IN MR. BERNIE ZIMILINGHAUS. MR. ZIMILINGHAUS TOLD THE BOARD THAT HE WAS LICENSED HERE BEFORE HE MOVED AWAY. HE WAS GONE FOR FIVE YEARS. HE SAID THAT HE HAD TALKED TO MR. WATERS ABOUT WORKING WITH HIM AND HE SAID THEY WOULD SPLIT EQUALLY. HE THOUGHT THINGS WERE SET UP SO THAT HE COULD SIGN PERMITS, ETC. HE WAS. UNDER THE IMPRESSION THAT MR. WATERS WAS GOING TO FAX AUTHORIZATION FOR THIS PURPOSE. MR. COOPER STATED THAT IN THE MEETING WITH THE DETECTIVES, MR. WATERS STATED THAT HE HAD NO KNOWLEDGE OF ANY OF THIS. MR.. ZIMILINGHAUS SAID THAT WHEN HE TALKED TO MR. WATERS, HE WAS TOLD TO DO THE ESTIMATING AND WHEN THE JOBS WERE READY TO START, TO LET HIM (WATERS) KNOW. WHEN THE ESTiMATIONS"WERE DONE, MR, WATERS GAVE HIM SOME OF THE MATERIAL. MR. COOPER HAD A PROBLEM WITH THIS SINCE MR. WATERS HAD TOLD HIM THAT HE HAD NO KNOWLEDGE OF THE JOBS BEING STARTED. IN VIEW OF WHAT HAD BEEN SAID, MR. COOPER ASKED THAT THIS CASE BE POSTPONED AND THAT MR. WATERS BE SUBPOENAED. PAGE 6 SEBASTIAN CONSTRUCTION BOARD - REGULAR MEETING - 7/13/93 MR, CAPP SAID THAT MR. ZIMILINOHAUS HAD MENTIONED EARLIER THAT HE HAD AN EMPLOYEE WORKING'"FOR HIM WHO HAD A $OURNEYMAN~S CARD, IT WAS NOTED THAT HIS NAME WAS ARNOLD HENDRICKSON. MR, ZIMIL. INGHAUS SAID THAT HE HAD PAID HX'M HIMSBLF, MR. COOPER SAID THIS CREATED ANOTHER PROBLEM AND ANOTHER CHARGE. MR. COOPER SUGGESTED THAT MR. WATERS~ MR. HENDRICKSO~:~AND MR. ZIMIL'INGHAUS'BE PRESENT AT THE AUGUST MEETING. MR, CAPP ASKED THAT JIM HARRIS~ AND L & L CONSTRUCT:IOII BE AT THE NEXT MEETING. MOTION BY MR, HANEY~ SECONDED BY MR. $. HE STATED THAT HE WAIVED HIS RIGHTS OF DUE PROCESS. IT WAS NOTED THAT MR. ROMANO WAS LICENSED AS A GUNiTE SUB- CONTRACTOR IN THE CiTY OF SEBASTIAN, IN THE COMPLAINT THAT WAS FILED ,IT CLAIMED THAT HE DID WORK BEYOND THE SCOPE OF HIS LICENSE IN REGARDS TO THE CONSTRUCTION OF A POOL. MR. COOPER READ A.,LETTER FROM MRS. SANTIAGO~ 641 NOBLE ST. WHICH WAS IDENTIFIED AS "EXHIBIT 1" A MEMO FROM GEORGE BONACCI~ CHIEF BUILDING INSPECTOR;WAS READ .TO THE BOARD AND IDENTIFIED AS 'IEXHIBIT 2". MR. ROMANO WAS ASKED WHAT WORK HE HAD DONE ON THIS CASE. MR. ROMANO SAID HE DID THE SPA WALL AND SHOT THE BENCH~ PUT THE TILE ON THE POOL~ POURED THE DECK AND DID THE TOPPING. C,J.
