ATTORNEY JIM WILSON REPRESENTED MR. ZIMILINOHAUS. IT WAS NOTED THAT MR. ZIMILINGHAUS WAS SWORN IN AT THE JULY MEETING. KEN E. WATERS OF WATERS ELECTRiC'WAS SWORN IN BY CHAIRMAN. LAMAN. COOPER'S UNDERSTANDING FROM THE INITIAL INVESTIGATION ON THE JOBS DONE AT 929 FULTON WAY AND 39 RIVER OAK DR. WAS 'THAT MR. WATERS HAD TALKED TO MR. ZIMILINGHAUS TO WORK OUT AN AGREEMENT TO POSSIBLY HAVE MR. ZIMILINGHAUS UNDER WATER'S EMPLOYMENT. IT WAS NOTED AT THIS TIME BY MR. WATERS THAT THERE WAS NO EXCHANGE OF MATERIALS. MR. WATERS WAS NOT AWARE OF THE CONSTRUCTION OF THE TWO HOMES AND THAT MR. ZIMILINGHAUS WAS DOING THE WORK UNTIL .MR. COOPER TALKED WITH HIM. MR. WATERS SAID THAT IN THE BEGINNING IT WAS HIS INTENTIONS FOR BERNIE TO REPRESENT HIS COMPANY~ BUT BERNIE MADE SOME ASSUMPTIONS AND WENT AHEAD AT THE TIME. HE SAID HE GAVE BERNIE A COPY OF HIS PROPOSAL AND A COPY OF THE INSURANCE USED, HE THOUGHT HE HAD MADE IT CLEARiTHAT BERNIE WAS NOT TO APPLY OR SIGN FOR PERMITS IN BEHALF"~OF~ WATERS ELECTRIC. MR. COOPER ASKED IF THE BUSINESS DEAL HAD NOT BEEN CONSUMMATED WHY BERNIE HAD INSURANCE FORMS AND BLANK ORDER FORMS. MR. WATERS SAID IT WAS HIS UNDERSTANDING THAT BERNIE WAS TALKING TO SOME BUILDERS AND BERNIE WANTED THEM TO KNOW THAT THEY WOULD BE DEALING WITH A LEGITIMATE CONTRACTOR AND THAT MR. WATERS'ASSUMED BERNIE WOULD GIVE THESE TO THE BUILDERS AND THAT HE (WATERS) WOULD COMPLETE ANY CONTRACT THAT WOULD BE PERFORMED. HE SAID THAT AT THIS POINT~ BERNIE. WOULD BE ~IN SOME TYPE OF SALES AND THAT HE WOULD HAVE BEEN AN EMPLOYEE OF HIS. MR. COOPER ASKED MR. WATERS IT HE KNEW THAT BERNIE DID NOT HOLD A CURRENT LICENSE OR CERTIFICATE. MR. WATERS SAID HE KNEW THAT BERNIE WAS TRYING TO GET HIS MASTERS LICENSE. MR. WATERS NOTED THAT HE NEVER GAVE BERNIE ANY MATERIALS. MR. WATERS SAID THAT BERNIE DID TRY TO CALL HIM~ BUT DE DID NOT RETURN THE CALL. THEREFORE, BERNIE OBVIOUSLY TOOK THINGS IN HIS OWN HANDS AND WENT ABOUT BUSINESS. WATER':S.NAME BUT BERNIE TESTIFIED THAT HE ACTUALLY SIGNED THEM UTILIZING MR. WATER'S NAME. MR. HANEY ASKED W I tAT MR. WATER'S POLICY WAS ON A DRAW OR PAYMENT SCHEDULE. MR. WATERS SAID HE ALLOWED HIS PEOPLE TO PiCK UP CHECKS BUT THAT HE SIGNED AND CASHED HIS OWN.CHECKS. MR. COOPER ASKED THAT EVEN THOUGH.:THERE WAS NO CONTRACT~ HOW WOULD BERNIE HAVE BEEN PAID? MR. WATERS SAID THEY.~ULD HAVE SPLIT THE PROFITS. MRS. ENLOW NOTED"THAT THE CHECK MADE OUT TO WATERS WAS SIGNED BY BERNIE AND ASKED WHAT HAPPENED TO THE MONEY. MR. WATERS. SAID IT WAS USED TO PAY THE EXPENSES UP TO THAT POINT. JIM HARRIS OF FASHION HOMES WAS SWORN IN BY CHAIRMAN LAMAN. MR. COOPER ASKED JIM IF BERNIE HAD CONTACTED HIM ABOUT THE JOB AT 39 RIVER OAK DR. HE SAID YES AND THAT HE HAD ALSO TALKED TO KEN WATERS IN FRONT OF CiTY HALL FOR A COUPLE OF MINUTES. HE SAID HE THOUGHT BERNIE: HAD AUTHORIZATION TO SIGN. MR. COOPER NOTED THAT JIM'S OFFICE HAD ISSUED A CHECK FOR $1,700.00 THAT WAS GIVEN TO BERNIE. ATTORNEY WILSON ASKED MR. WATERS ABOUT THE CHECK iSSUED TO HIM AND SIGNED BY BERNIE. MR. WATERS SAID HE DID NOT FEEL BERNIE TRIED TO,STEAL.THE MONEY, THAT IT WAS USED TO PAY THE BILLS AND LABOR"ON THE JOB. CHAIRMAN LAMAN SWORE IN GEORGE LEKANIDES AND BILL LAVERECK OF L & L BUILDERS. MRS. ENLOW ASKED IF THEY ONLY DEALT WITH BERNIE ON THE JOB AT 39 RIVER OAK DR. MR, LEKANIDES SAID HE KNEW WATERS ELECTRIC AND THAT BERNIE HAD A PROPOSAL THAT HE GAVE THE BOARD TO LOOK AT. CHAIRMAN LAMAN NOTED THAT BERNIE'S PHONE NUMBER WAS ~SO ON THE PROPOSAL. HILLARD DID NOT FULFILL HIS RESPONSIBILITIES IN A POOL REPAIR ON A POOL THAT HE HAD iNSTALLED THERE. MR. COOPER ASKED MR. HILLARD IF HE HAD CONTRACTED MR. ROMANO TO SOME OF THE WORK. MR. HILLARD SAID YES AND THAT HE (ROMANO) HAD SHOT THE TANK, POURED THE DECK, DID THE COOL DECK AND MARCITE. THE BOARD SECRETARY TOLD THE BOARD THAT MR. ROMANO WAS LICENSED TO DO GUNITE ONLY. MR. BONACCI NOTED THAT THE ONLY REAL VIOLATION WITH THE. POOL WAS THE HANDRAIL. MR. HILLARD SAiD HE THOUGHT MR. ROMANO'S LICENSE COVERED ALL THE THINGS THAT HE DID. (MR, HILLARD DID THE TILE WORK.) MR. SHE HAD A COPY OF HIS SEBASTIAN CITY OCCUPATIONAL LICENSE WHICH SHOWED: CONCRETE: PLACING & FINISHING (GUNITE). CHAIRMAN LAMAN SAID MR. EOMANO COULD APPEAL THE BOARD,~S FINDINGS. MR. NEUBERGER ASKED THE BOARD SECRETARY TO CONTACT LINDA JONES, INDIAN RIVER COUNTY AND REQUEST A COPY OF THEIR. COUNTY ORDINANCE REGARDING A FLAT FEE'OF $500.00 FOR A CODE VIOLATION. BILL VERNON~ SUPERVISOR WITH CITY OF VERO BEACH TOLD THE BOARD THAT PRESENTLY THEY USE THE BLOCK EXAM FOR ADVANCEMENT IN THE BUILDING/MAINTENANCE DIVISION. HE REQUESTED THAT THE CREDIT REPORT BE WAIVED AND THAT THE INSURANCE BE WAIVED SINCE THESE MEN ARE COVERED UNDER THE CITY'S INSURANCE. THE BOARD RECOMMENDED THAT MR. VERNON WRITE A LETTER TO MR'. COOPER AND THAT THIS TOPIC BE PUT ON THE SEPTEMBER AGENDA. THE BOARD SECRETARY REQUESTED THAT SINCE SHE DOES IN-HOUSE LETTERS OF RECIPROCITY THAT SHE BE PERMITTED TO DO CHANGE OF STATUS IN-HOUSE ALSO.
