MR. BALLOUGH AGAIN ASKED IF MR. DICKEY WAS APPLYING FOR SOLE PROPRIETORSHIP AND MR. DICKEY REPLIED YES. CARRIED. COMPLAINT - CHARLES GIFFORD VS JOSEPH KUNDROT, ATLANTIC POOL & SPA MR. BALLOUGH STATED THAT HE AND HECTOR FRANCO, BUILDING OFFICIAL VISITED THE GIFFORD RESIDENCE. VICE CHAIRMAN CAREY ASKED IF BOTH PARTIES WERE PRESENT. MR. GIFFORD WAS PRESENT BUT NO ONE REPRESENTING ATLANTIC POOL & SPA WAS PRESENT. THE BOARD SECRETARY STATED THAT SHE HAD SENT LETTERS TO BOTH PARTIES REQUESTING THEY ATTEND THE MEETING. SEBASTIAN CONSTRUCTION BOARD - REGULAR MEETING - AUGUST 13, 1985 MR. BALLOUGH STATED THAT THE POOL WAS VERY'MUCH LIKE WHAT WAS DESCRIBED IN MR. GIFFORD'S LETTER. THERE WAS APPARENT EFFORT BY THE POOL COMPANY, AFTER THE POOL WAS DONE, THEY CAME BACK AND POURED A PAD FOR THE DIVING BOARD WHICH WASN'T FINISHED. THE DIVING BOARD WAS NOT FINISHED. THE CRACKS THAT WERE POINTED OUT IN THE LETTER WERE APPARENT IF YOU KNEW WHERE TO LOOK. THEY WEREN'T SOMETHING DRASTIC BUT YOU COULDN'T TELL THEY LEAKED BY LOOKING AT IT. MR. BALLOUGH TALKED TO THE ROOL COMPANY, A MAN NAMED MIKE. HE WAS ASKED TO COME THE THE MEETING SO THE BOARD COULD HEAR WHAT HE HAD TO SAY ABOUT IT. HE OFFERED TO ATTEND THE MEETING AND BY THE TIME HE MADE THE MEETING HE PROMISED THE CORRECTIONS WOULD BE MADE. MR. GIFFORD: THEY CAME OUT YESTERDAY AND DID THE CHATTAHOOCHEE WORK ON THE DIVING BOARD AREA. IT WAS THE SECOND BAD THEY ~OURED. THE FIRST ONE THEY RIBBED OUT. IT WASN'T TIED INTO THE DECK AT ALL. I MENTIONED THE LEAK AND HE TESTED IT_AND SAW IT WAS LEAKING. THAT'S ALL HE SAID. HE DIDN'T SAY HE'D COME BACK OR ANYTHING ELSE. MR. BALLOUGH: WAS IT BART OF THE CONTRACT THAT HE ATTACH THE DIVING BOARD? MR. GIFFORD: IT WAS IN THE ORIGINAL PLANS. MR. BALLOUGH: WAS THE PAD I SAW THE ONE HE CHATTAHOOCHEED? MR. GIFFORD: YES. MR. BALLOUGH: DID HE FINISH IT? MR. GIFFORD: YES. MR. BALLOUGH: IS PAD OK WITH YOU? MR GIFFORD: YES. MR BALAOUGH: DIGGING IT UP. DIVING BOARD? IT LOOKS PRETTY DEEP, I COULDN'T REALLY TELL WITHOUT SO WHAT IS LEFT IS THE CRACK AND ATTACHING THE MR. GIFFORD: YES AND FIXING THE LEAK. IT'S BEEN LEAKING SINCE ABOUT SIX .MONTHS AFTER IT WAS PUT IN. FROM WHAT THE GUY SAID YESTERDAY THEY MIGHT HAVE TO TAKE SOME OF THE TILE OUT OF THE CORNER THERE AND CUT OUT SOME OF THE (INAUDIBLE). WHETHER IT GETS DONE OR NOT. I'VE BEEN AFTER THEM FOR A YEAR AND A HALF NOW TO GET THE DIVING BOARD DONE. THAT'S BEEN SITTING THERE LIKE YOU SAW IT FOR SIX MONTHS. VICE CHAIRMAN CAREY: IS THE DIVING BOARD COMPLETE NOW? MR. GIFFORD: NO. THE DIVING BOARD HASN'T BEEN PUT BACK IN. THEY JUST CAME AND DID THE STONE WORK YESTERDAY. IT'S STILL GOT A FORM AROUND IT. VICE CHAIRMAN CAREY: DID HE GIVE YOU ANY INDICATION WHEN HE WOULD COME BACK? THE POOL IS STILL LEAKING? SEBASTIAN CONSTRUCTION BOARD - REGULAR MEETING - AUGUST 13, 1985 MR. GIFFORD: YES. HIS WORKERS SAW THAT YESTERDAY. YESTERDAY AND SAW IT WAS STILL LEAKING. HE TESTED IT MR. BALLOUGH: THIS (INAUDIBLE) IS A SLOW PROCESS BUT WHAT. WE' RE TRYING TO DO rS SAVE YOU THE EXPENSE AND AGGREVATION OF PURSUING THIS THROUGH THE COURTS. THIS IS NOT A QUICK FORM OF REMEDIES. NONE THE LESS IT IS ONE THAT. WILL (INAUDIBLE). I'LL CALL THEM AGAIN IF IT'S THE PLEASURE OF THE BOARD AND FOLLOW UP ON IT AND FOLLOW UP WITH A LETTER AND PERHAPS WE'LL ASK~/YOU BOTH TO COME AGAIN AND IF SOMETHING ISN'T DONE BY THAT POINT, THEN WE HAVE CAUSE PROBABLY TO GO TO STRICTER ACTION. RIGHT NOW IT'S A MATTER OF SATISFYING A CONTRACT AGREEMENT BETWEEN A CONTRACTOR AND A OWNER. IT'S ALMOST - IT'S A LITTLE STICKY AREA, BUT IF IT PLEASES YOU, WE'LL CONTINUE WHAT WE' VE BEEN DOING AND MAYBE BE ABLE TO NUDGE THEM OUT THAT WAY. IF IT GETS TO BE A PROBLEM THERE'S RECOURSE AT THIS LEVEL. IF THAT SUITS YOU MAYBE WE CAN DO THAT. MR. GIFFORD: OK. THANK YOU. VICE CHAIRMAN CAREY ASKED MR. BALLOUGH TO FOLLOW UP ON THIS PROBLEM AND TO SEND THEM A LETTER REQUESTING THEM TO BE AT THE NEXT REGULAR MEETING ON 9/10/85. HE WANTED MORE ACTION ON THIS IS BEFORE THAT TIME IF WE CAN GET IT. VICE CHAIRMAN CAREY ASSURED MR. GIFFORD THAT THE BOARD WOULD FOLLOW UP ON THIS MATTER. ROUGH DRAFT - ELECTRICAL CODE VICE CHAIRMAN CAREY FELT THAT WITH MR. TRIPP AND MR. HOFFMAN NOT BEING PRESENT AT THE MEETING THAT MAYBE THE BOARD WOULD LIKE TO TAKE A COPY AND DISCUSS IT AT A WORKSHOP MEETING ON 8/26/85 AND AT THAT TIME THE BOARD WILL BE MORE PREPARED. MOTION BY MR. MOLER, SECONDED BY MR. DOMINIX TO TABLE DISCUSSION OF THE ROUGH DRAFT ON THE ELECTRICAL CODE UNTIL THE NEXT WORKSHOP MEETING. CARRIED. DAVE MILLER - BUILDING DEPARTMENT - PULLING PERMITS MR. MILLER STATED ONE OF THE AREAS OF CONCERN WAS FENCING. ANYONE CAN PUT UP A FENCE AND THEY DON'T HAVE TO LICENSED OR HAVE INSURANCE. THE FENCE ORDINANCE IS SO VAGUE THAT WHEN AN INSPECTOR GOES OUT TO INSPECT OR APPROVE A FENCE, HE HAS TO USE HIS OWN JUDGMENT INSTEAD OF A CONCRETE ORDINANCE TO GO TO. MR. MOLER FELT IT WASN'T ANYTHING FOR THE BOARD TO DEAL WITH. IT IS SOMETHING THAT WOULD BE CREATED AND ADOPTED BY THE CITY COUNCIL. IT IS SOMETHING TO BE REVIEWED AS PART OF THE SITE..PLAN APPROVAL PROCESS. EXISTING FENCE ORDINANCE INTO THE RECORD. SEBASTIAN"CONSTRUCTION BOARD - REGULAR MEETING - AUGUST 13, 1985 THE BOARD SECRETARY WAS REQUESTED TO WRITE A LETTER TO THE CITY COUNCIL STATING THAT WE NEED STRICTER REGULATION ON FENCING. VICE CHAIRMAN CAREY SAID HE WOULD CHECK WITH THE NEARBY COUNTIES TO SEE IF THEY LICENSE FENCE PEOPLE. OTHER AREAS OF CONCERN ARE SATELLITE DISKS, FLAG POLES AND WATER SOFTNERS, ALL OF WHICH NEED TO HAVE PADS POURED. NONE OF THESE ARE LICENSED OR NEED PERMITS PULLED. SIGNS WERE ALSO DISCUSSED. ALTHOUGH THERE IS A SIGN ORDINANCE, A LICENSE IS NOT NEEDED TO PULL A PERMIT. THE ABOVE MENTIONED WILL ALSO BE MENTIONED IN THE LETTER TO THE CITY COUNCIL. ALUMINUM SUB-CONTRACTORS - MR. TRIPP DUE ~0 AN'EMERGENCY.SITUATION IN HIS FAMILY, MR. TRIPP WAS NOT PRESENT. MOTION BY MR. MOLER, SECONDED BY MR. DOMINIX TO'TABLE THE DISCUSSION ABOUT ALUMINUM SUB-CONTRACTORS, WHETHER OR NOT THEY CAN PULL PERMITS UNTIL THE NEXT MEETING. CARRIED. THERE WAS A SHORT DISCUSSION ON BILLY ADAMS, ALUMINUM, AS TO HOW HIS ORIGINAL LICENSE READ. MOTION BY MR. MOLER, SECONDED BY MR. DOMINIX TO TABLE THE DISCUSSION ON BILLY ADAMS ORIGINAL LICENSE. CARRIED. MOTION BY MR. PALMER TO ALLOW ALL ORIGINAL ALUMINUM SPECIALTY CONTRACTORS TO PULL PERMITS FOR STRUCTURAL ALUMINUM CONSTRUCTION.(GRANDFATHERED) DISCUSSION - MR. BALLOUGH MENTIONED THAT WE DO NOT KNOW WHAT THEY WERE ORIGINALLY GRANDFATHERED IN TO DO. MR. MOLER FELT WE NEEDED A NEW MOTION ON THIS MATTER - WE STILL NEED TO HEAR WHAT MR. TRIPP HAS TO SAY. MR. PALMER WITHDREW HIS MOTION. MOTION BY MR. PALMER, SECONDED BY MR. MOLER TO ALLOW THE FOUR ORIGINAL ALUMINUM CONTRACTORS TO PULL PERMITS UNTIL THE BOARD GETS MORE INFORMATION AT THE NEXT MEETING. SEBASTIAN CONSTRUCTION BOARD - REGULAR MEETING - AUGUST 13, 1985 RE: AN ORDINANCE OF THE CITY OF SEBASTIAN, FLORIDA ADDINGA NEW SECTION 7-17 TO THE CODE OF ORDINANCES, AND THEREBY ADDINC LOCAL REQUIREMENTS FOR FOUNDATIONS AND TIE DOWN FOR ALL PERMENANT BUILDINGS, INCLUDING RESIDENCES: PROVIDING AN EFFECTIVE DATE. MOTION BY MR. MOLER, SECONDED BY MR. DOMINIX TO ADD TO PARAGRAPH (~), SEC. 7-17 'OR PRE-CONSTRUCTED UTILITY SHEDS" AT THE END OF THE SENTENCE - "NO IMBEDDED SCREW TYPE EARTH ANCHOR SHALL BE USED TO ANCHOR ANY BUILDING EXCEPT A MOBIL HOME, HOUSE TRAILER". CARRIED. MOTION BY MR. MOLER, SECONDED BY MR.BAfJITU6~~ TO SEND TO CITY COUNCIL COMMENTS CONCERNING NEW ORDINANCE, SEC 7-17, RECOMMEND THE CITY COUNCIL APPROVE WITHNOTED CHANGES. CARRIED. RE: AN ORDINANCE OF THE CITY OF SEBASTIAN, FLORIDA, AMENDING SECTIONS 7-135, 7-136, 7-137 AND 7-139 IN ARTICLE IX OF CHAPTER 7.OF THE CODE OF ORDINANCES AND THEREBY DELETING FROM SAID ARTICLE IX REFERENCES TO MODULAR HOMES, AND THEREBY DELEtiNG CERTAIN EXISTING PROVISIONS WHICH ARE CONTAINED IN APPENDIX H TO THE STANDARD BUILDING CODE: PROVIDING AN EFFECTIVE DATE. MOTION BY MR. MOLER, SECONDED BY MR. PALMER TO RECOMMEND TO CITY COUNCIL THAT THE AMENDMENTS TO SEC. 7-135, 7-136, 7-137 AND 7-139 OF ARTICLE IX, CHAPTER 7 BE ADOPTED AS WRITTEN. CARRIED. MR. NEUBERGER BROUGHT UP THE SUBJECT OF LAKE DOLORES AND THE PERMIT FEE FOR A MOBILE HOME. HE THOUGHT OUR LOCAL FEE WAS $5.00. HE NOTED THAT THIS ENTAILS'~'SIX INSPECTIONS. MR. DOMINIX MENTIONED THAT IF THEY ARE INSTALLING MODULAR HOMES IN A TRAILER PART, WE SHOULD LOOK INTO IT. MOTION BY MR. BALLOUGH TO SUGGEST TO THE BUILDING OFFICIAL THAT HE BRING THE PERMIT FEES FOR MOBILE HOMES IN LINE WITH THOSE IMPOSED ON SINGLE FAMILY CONSTRUCTION. MR. MOLER DID NOT THINK THE BUILDING OFFICIAL COULD DO IT ON HIS OWN. MR. BALLOUGH SAID HE THOUGHT IT SAIDIT IN THE STANDARD BUILDING CODE WHICH WAS ADOPTED AS A FLORIDA STATUTE. MR. NEUBERGERSAID IT ALSO' GIVES HIM THE AUTHORITY TO SET BUILDING FEES. VICE CHAIRMAN CAREY SUGGESTED THATAT OUR. NEXT MEETING WE. HAVE .A.LOOK AT THE BUILDING FEES FOR:BREVARD. COUNTY. SEBASTIAN CONSTRUCTION BOARD - REGULAR MEETING - AUGUST 13, 1985 MR. MOLER: LET THE BUILDING OFFICIAL KNOW WE THINK THE FEE IS TOO LOW PRESENTLY AND TO ASK HIM FOR A RECOMMENDATION AS TO WHAT HE THINKS IT SHOULD BE AND ASK HIM TO ADOPT THAT AND IT IT NEEDS TO GO TO CITY COUNCIL FOR APPROVAL, ASK HIM TO TAK~IT TO COUNCIL. IF HE HAS THE POWER TO DO IT ON HIS OWN, LET HIM. MR. BALLOUGH FELT SURE THE BUILDING OFFICIAL HAS THE PREROGATIVE TO MAKE THE FEE DECISION. VICE CHAIRMAN CAREY ASKED IF MR.
