There was much diec~eien at this l~int, quite r~ely at that, Ed Sch~cker felt that this viol&tien of a c~ntract is n~t a mstter of ours, as this was ~ot a ~ violmtt~. It is amtter of ~ificati~ ~en t~ buil~r ~ ~ ~t ~c~nts. This hearing t~ was tutmed over te hear the c~mmm~ts of tbs other Board Cliff Hoose asked David Hines that the specification ~32, in the contract, called for yellow paint? Yes, was the reply. Whe painted it White? Johnny Presley. O~ who'l orders? Nine (David Hines) O~ my orders, which I ~ot ap] orders fro~ tJMm (Pl~m~os) Cliff ~ose then David if these people asked him te l~lnt it white end Dmwid smid, "Yes." The Pisano's, ~O DaVid has a co~trmct with, have already clo~ed on the house and now, Mr. & Mrs. Joh~ Pism~o, who David doesn't have a contract with, are making the o~plaints. Mr. & Mrs. John Pisarm say that they are going back to Ft. with nothing good to say about Sebastian or this Board. The~ ere very bitter about us. They threaten to go to the City Council, which is their perrogatlve, and get the newspapers in. Ed Paluch felt that they have a le~itimate deviation of contrm~t to to the courts with. We, the Board, are mainly concerned .with ~ vio- lations and not quality co~plaintm. Mrs. John Pisano then asked what are the duties of this R~ard? Ed Paluoh said that their duties were not to act as a Smmll Claims Comrt, which he felt was taking place this date. Our dut~ are to enforce blmeprint "HOME OF PELICAN ISLAND" specifications, quality of the materials in the construciton of the home, etc. David Hines said that he would paint the facia board, if he is given a letter from the John Pisano'sstating that he will not be responsible for the gutters, should any paint get in them. Jim Harris questioned our authority in suspending or revoking David's license merely for the color of facia board. After much discussion, Cliff Hoose made the motion that w~ recoBuuer,2t that Mr. & Mrs. John Pisano bring this matter to the SR~ll Claims Court. Ed Paluch seconded that motion. The above motion was then m~ended to.- Mr. & Mrs. Pisano should Present this matter first to the City C°%u~Cil ar~, if they receive no satiafactio~ there, ~hey should then proceed to Smell Claima Court. ~d Paluch seconded that motion, which Cliff Moose ma~e. All in favor, no~e opposed.
