CAPP, SECONDED BY VICE CHAiRM;%N DERNB'ACH TO ACCEPT THE MINUTES FROM THE LAST SCHEDULED MEETING. MOTION CARRIED. PAGE 2 SEBASTIAN CONSTRUCTION BOARD - REGULAR MEETING - 10/13/92 VIOLATION HEARINGS BOB FERRIS/BOB FERRIS DRYWALL 33d WATERCREST ST. ATTORNEY PETER GIANINO REPRESENTED MR. FERRISo MR. COOPER WENT OVER THE CASE FOR THE BOARD. THERE WAS NO ACTIVE LICENSE FOR MR. FERRIS. AT THE. TIME MR. GIANINO TOLD THE BOARD THAT HE DiD NOT UNDERSTAND WHY MR. FERRIS WAS BEING BROUGHT BEFORE THE BOARD SINCE MR. FERRIS REGISTERED HIS STATE CERTIFICATION THE VERY NEXT DAY. CHAIRMAN LAMAN SWORE IN MR. FERRIS. MR. FERRIS TOLD THE BOARD THAT HE DID NOT REALIZE THAT HE HAD TO REGISTER HIS STATE CERTIFICATION WITH THE CITY BEFORE STARTING TO WORK. THE BOARD SECRETARY VERIFIED THAT EVEN THOUGH MR. FERRIS WAS A CERTIFIED RESIDENTIAL CONTRACTOR THAT HIS STATE LICENSE SHOWED HIM QUALIFYING BOB FERRIS DRYWALL, INC.. MOTION BY MR. CAPP, SECONDED BY MR. NEUBERGER THAT NO ACTION BE TAKEN AT THIS TIME AGAINST BOB FERRIS. MR. NEUBERGER FELT THAT TAKING NO ACTION SHOULD BE WHERE A PENALTY WAS CONCERNED. MR. NEUBERGER WITHDREW HIS SECOND, MR. CAPP WITHDREW HIS MOTION. FINDINGS OF FACT MOTION BY MR. NEUBERGER, SECONDED BY MR. CAPP THAT WE FIND BOB FERRIS DRYWALL NOT GUILTY OF VIOLATION OF 7-100(1). MOTION CARRIED. JAMES MARTIN/INDIAN RIVER HOMES 414 TOLEDO STREET MR. MARTIN WAS NOT PRESENT AT THE MEETING. MR. COOPER TOLD THE BOARD THAT THIS MATTER WAS BROUGHT BEFORE US DUE TO THE USE OF AN UNLICENSED SUB-CONTRACTOR. PAPER WORK WAS REQUESTED FROM MR. MARTIN ON THE INDIVIDUAL. MR. MARTIN PROVIDED US WITH A W-4 FORM BUT REFUSED TO GIVE THE PAGE 3 SEBASTIAN CONSTRUCTION BOARD - REGULAR MEETING - 10/13/92 OTHER INFORHATION REQUESTED. JAMES AND NYRA ENLOW, OWNERS OF THE MODULAR UNDER CONSTRUCTION WERE PRESENT. CHAIRMAN LAMAN SWORE IN MR. AND MRS. ENLOW. MR. ENLOW TOLD THE BOARD THAT THERE WERE SO MANY PEOPLE WORKING ON THEIR HOUSE THAT THEY WERE CONCERNED iF THE PEOPLE WERE LICENSED AND CAPABLE OF DOING THAT KIND OF WORK. -, MOTION BY MR. CAPP, SECONDED BY MR. NEUBERGER THAT WE ~ WITHDRAW THIS CASE AGAINST JAMES MARTIN FROM TONIGHTS CONSTRUCTION BOARD MEETING AND ALSO SUBPOENA HIM ALONG WiTH HAVING THE ATTORNEY PRESENT FOR OUR NEXT REGULAR SCHEDULED CONSTRUCTION BOARD MEETING ALONG WITH T~E REQUIRED RECORDS, REQUESTED RECORDS. MR. COOPER STATED THAT ALL PAYROLL RECORDS WOULD BE REQUESTED. MR. CAPP ALSO SUGGESTED CANCELLED CHECKS BE REQUESTED.. MOTION CARRIED. DISCUSSION: KAI E. LARSEN/MARINE CONSTRUCTION/DREDGING THE BOARD SECRETARY NOTED THAT ON THE STATE REGISTRATION, HE WAS LICENSED AS A REGISTERED MARINE SPECIALTY CONTRACTOR BUT THE NAME OF HIS COMPANY WAS LARSEN DREDGING. MOTION BY VICE CHAIRMAN DERNBACH, SECONDED BY MR. CAPR THAT IF MR. LARSEN CAN PROVE EXPERIENCE IN THE. DREDGING CATEGORY PREVIOUS TO 1990, THAT WE GRANDFATHER HIM IN FOR A DR'~DGI'NG LICENSE. MOTION CARRIED. APPOINTMENT OF BOARD MEMBERS CHARLES C. NEUBERGER, JR. MOTION BY MR. CAPP, SECONDED BY VICE CHAIRMAN DERNBACH TO REAPPOINT CHUCK NEUBERGER, ELECTRICAL CONTRACTOR. MOTION CARRIED. KELLEY BE REAPPOINT~D TO THE CONSTRUCTION BOARD. MR. CAPP FELT THAT BILL'S ATTENDANCE RECORD WAS VERY POOR. MR. NEUBERGER AGREED. ROLL CALL: AYE: VICE CHAIRMAN DERNBACH NAY: MR. NEUBERGER MR. CAPP CHAIRMAN LAMAN MOTION FAILED. THE FOLLOWING APPLICANTS WERE PRESENT AT THE MEETING. PERSON WAS ASKED TO SPEAK TO THE BOARD. EACH JERALD SMITH, RICHARD GREBE, TRUMAN SMITH AND N~RA.~ENLOW'. MOTION BY MR. CAPP, SECONDED BY MR. NEUBERGER THATi'¥THE BOARD ACCEPT JERALD E. SMITH, SR. TO BE A REGULAR MEMBER'OR THE cONSTRUCTION BOARD. MOTION CARRIED. MOTION BY MR. NEUBERGER, SECONDED BY MR. CAPP TO RECOMMEND MR. TRUMAN SMITH AS THE ALTERNATE CONCERNED CITIZEN ONe.THE CONSTRUCTION BOARD. MOTION CARRIED. MOTION BY MR. NEUBERGER, SECONDED BY MR. CAPP THAT WE NOMINATE MRS. ENLOW. MOTION CARRIED. SCORES WERE REGISTERED IN THE SCORE BOOK BY VICE CHAIRMAN DERNBACH AND MR. CAPP. MR. COOPER TOLD THE BOARD THAT THE CITY COUNCIL WOULD BE AIRING THE FINAL ADOPTION OF OUR TECHNICAL CODES TOMORROW NIGHT. THERE BEING NO FURTHER BUSINESS, MEETING ADJOURNED AT 9:00 P.M.
