Cecile called the meeting to order at 7:16 pm, The Pledge of Allegiance was said. ~ PRESENT: VC Thomas Cecde Michael Herbig Michael Holdfidge Pierre Paquette EXCUSED ABSENCE: ALSO PRESENT: Chmn. Jerald Smith John F. Heame, Sr. (Mr. Heame passed away on Oct. George Bonacci, Building Director Ann Brack, Recording Secretary A~P~OVAL ,OF MINUTES: MOTION by Holdridge/Herbig i'd like to make a motion to approve the minutes from the meeting of September sm, 1998. A voice vote was taken. 4 - 0 motion carries. ANNOUNCEMENTS~. For the record, the Secretary announced that Chron. Smith has an excused absence. (On October 14~ a phone call was received from Mr. John Hearne~S wife that he had passed away.) N~=W BUSINESS;. BLOCK EXAM: Foss, Wayne M./Painting Mr, Wayne Foss was present and was sworn in at 7:17 pm. Mr. Hoidddge asked about the applicant's credit report, and Mr, Foss informed the Board that he has no credit accounts, CONSTRUCTION BOARD MINUTES OF REGULAR MEETING OF OCTOBER 13, 1998 MOTION by Holdddge/Paquette I'd like to make a motion of allowing Mr. Wayne Foss to take the Block .~.for painting contractor. Roll call: Michael Herbig - yes Pierre Paquette - yes The vote was 4 - 0. Motion carded. VC Thomas Cecrle - yes Michael Holdridge - yes BOARD MATTERS: Mr. Herbig noted that several months ago, there was discussion on Iowedng the passing grade on tests from 75 to 70. He asked what the outcome of that was. A note was to be made to see if Kathy has followed up on this, and if so, provide more information for the next meeting, and to also check with other Counties to see what grade score averages they use. On the issue of changing the November meeting from the 10t~ to the 17th, consensus was 4 - 0 in faVor of the change to the 17~. RECORD SCOldS,iN ,sc.o.i~I~I~OOK; VC Cecrle and Mike Herbig recorded the scores in the scorebook. MINUTES TO PU-RL!~.: Mr. Gary Gehrke, a licensed framer/carpenter in the City of Sebastian was Present. He noted that he has been licensed here since about 19~1., was grandfathered in: in: 1991. He indicated that he used to do 40 to 50 houses a year in Sebastian, and he neW.can no longer run his business in the City because of illegal workers doing work .here, and nothing is being done about it. He indicated that it includes framing, roofing, d~3~vall, electrical. He noted an ad in the paper of an out-of-state contractor that is atNe~sil3g for framers, no license necessary. He also indicated that three people/crews in SebaStian were "busted" for not carrying workmen's comp, by representatives from the Workmen's Compensation Department, and the City did nothing about it. Mr. Geh.rke then described an event which took place about three (3) weeks ego, requiring him to "fix" a house already built. After meeting with a building inspector, who told him that Code Enforcement was called on this house a few days eadier, .and there was an illegal crew working on it. That crew has since disappeared. After inquiring with Ms. Nappi, he found out that his name was listed on the permit as the framer/carpenter, but he stated that he never worked on it. She advised him to write a letter stating that he did not build this house. Mr. Gehrke then noted that on this permit, the builder put down his own name as the framer/carpenter. CONSTRUCTION BOARD MINUTES OF REGULAR MEETING Of OCTOBER 13, 1998 Discussion proceeded between Mr. Gehrke and Mr. Bonacci, Building Director. They pretty much disaggreed with each other's views. Mr. Bonacci indicated, that he doesn't have staff to police every contractor doing work in Sebastian, and indicated ti3at Mr. Gehrke is the only one to complain in this city for the past fourteen (14) yeers.~ Mr. Bonacci indicated that the City is not in the tax business, not into checking books or payroll. He denied that the Workmen's Comp. Dept. ever notified the City of the three (3) people that were "busted". He also noted that the City is not in the insurance business. He also indicated that if workmen's compensation, exemption, or taxes are involved, the State takes care of it. He noted that historically speaking, roofers get paid by the square, and drywall men get paid by the board. Mr. Gehrke noted, that according to the rules of the Construction Board, .and other rules, that is illegal, and they are supposed to get paid by the hour. Mr. Bonacci agreed, but asked how he is going to scrutinize every house that goes up. He then indicated that Mr. Gehrke has a problem with contractors in town, and he is trYing to shove it off on ate Building Department. Mr. Bonacci then stated that if Mr. Gehrke has a legitimate complaint, heshould bring it to the office, and he will go out and look at it. He then noted that if Mr. Gehrke~.calls in a complaint, then Code Enforcement will go out and. check it. Mr. Gehrke noted that he has already done this, Mr. Bonacci was going to make a couple of calls, and then never celled them. Mr. Bonacci responded that Kathy Nappi made the calls, but they never came in. He then invited Mr. Gehrke to come into the office to discuss this issue. He again stated that Gary is the only person in years and years to complain. Mr. Gehrke indicated that Sebastian will tum into another Palm Bay in ten (10) years at this rate. He thanked the Board for their time and left the meeting. VChmn. Cecrle noted that there are people that occasionally slip through eurflngers, and that may happen anywhere. Mr. Bonacci repeated that'Mr. Gehrke is the only person'to make this complaint, in ten (10) years. He also noted that there.is no way unlicensed electricians - the 0nly one who might pull it would be an owner-builder. Mr. Holdddge noted that there are people paid piece-work, whether or not they are doing it asa 1099, he doesn't know. He knows of' two contractors who are electricians. He also noted that he could pay his men piece, work, but he would still withhold taxes and pay for workmen's compensation. Mr. Bonacci then noted that he can not scrutinize every contractor that is out l~ere, he would need a task force of r~ty (50) people. CONSTRUCTION BOARD MINUTES OF REGULAR MEETING OF OCTOBER 13, 1996 Mr. Hoidridge then noted that there are a lot of people that am working 1099, and it's becoming worse and worse. Mr. Bonacci noted that he could not control it. Mr'. Holdddge reiterated that there are people paying worker's comp, 109~ them out, and he has a time competing against them, Mr. Bonacci noted that when he does an inspection, he cannot be Uncle Sam or' the police - he doesn't want to be either one. Mr. Paquette suggested that this might be mom prevalent in roofing. Mr. Bonaccl noted that no one would work on a hot roof for $10/hour. He alsoindiceted that he thinks that Mr. Gehrke's problem is that he is asking for a higher rate than the norm. He mentioned John Hanna, Dicky (Ricky) Anderson, George Byrd .(Boyd), they are licensed. He then noted that he won't go out on every job and ask for Social Security numbers and identification and everything else, he doesn't have the time, and he doesn't have the manpower. He also noted that he really doesn't cam, that his interest is whether it is safe, is it done to code, bottom line. A few other comments were made. VChmn. Cecrle adjourned the meeting at 7:36 pm.
