HomeMy WebLinkAbout11041981_SEBASTIAN CO~STRUCTION BOARD MEETING NOVEMBER 4, 1981 ARTHUR MAYER, BUILDING OFFICIAL, STATED THAT A LICENSED CONTRACTOR IS NOT ALLOWED TO DO THE ELECTRICAL, PLUMBING OR AIR CONDITIONING HIMSELF AND HE FELT AN OWNER BUILDER SHOULD NOT BE ALLOWED EITHER. JIM HARRIS SUGGESTED THAT A;;OWNER BUILDER THAT CANNOT DO ANYTHING PHYSICALLY HIMSELF SHOULD SUB IT ALL OUT TO A LICENSED SUB CONTRACTOR ONLY. HE INDICATED THAT THE OWNER BUILDER SHOULD BE REQUIRED TO FILL OUT THE PERMIT FORM INDICATING WHAT SUB CONTRACTORS WILL BE USED AND IF THEY DON~ T, THEY SHOULD BE FINED. IF A SUB CONTRACTOR MAKES A CHANGE, THE BUILDING OFFICIAL SHOULD BE NOTIFIED OF THE CHANGE, SO IT CAN BE DOCUMENTED. JIM HARRIS, FELT THAT AN OWNER BUILDER SHOULD BE RESPONSIBLE FOR WHAT EVERYHE DOES HiMSELF~ NO MATTER WHAT THE PERCENTAGE IS. THE CONSTRUCTION BOARD REVIEWED THE BUILDING PERMIT FORM THAT IS PRESENTLY BEING USED. MOTION BY JOHN CALMES, SECONDED BY HUSTON TRIPP, THAT THE OWNER BUILDER' .MUST SUB PLUMBING, AIR CONDITIONING AND ELECTRIC, ~UNLESS HE CAN SHOW ENOUGH KNOWLEDGE TO THE SATISFACTION OF THE BUILDING OFFICIAL AND THE CONSTRUCTION BOARD. ALL OTHER WORK MUST BE SUBED OUT TO LICENSED TRADES. OWNER MUST OCCUPY HOUSE FOR ONE YEAR BEFORE THE SALE, RENT OR LEASE AND THAT THE OWNER BUILDER BE LIMITED TO ONE HOUSE PER YEAR. AFTER A VERY LENGTHY DISCUSSION, THE ORIGINAL MOTION WAS WITHDREW BY JOHN CALMES ~ECOND WITHDREW BY HUSTON TRIPP. MOTION BY JOHN CALMES, SECONDED BY HUSTON TRIPP, THAT THE OWNER BUXLDER WILL BE PERMITTED TO BUILD A SINGLE FAMILY DWELLING. HE 'MUST USE LICENSED SUB.~ODNTR~CTORS FOR PERMITTING TRADES, UNLESS HE CAN SHOW ~ IS KNOWLEDGEABLE TO THE SATISFACTION OF THE THE BUILDING OFFICIAL OR THE CONSTRUCTION BOARD. ALL OTHER WORK NOT DONE BY OWNER MUST BE DONE BY LICENSED SUB CONTRACTORS. OWNER MUST OCCUPY HOUSE FOR ONE YEAR FROM THE DATE OF THE CERTIFICATE OF OCCUPANY IS ISSUED BEFORE HE CAN SELLi RENT,OR LEASE AND IS LIMITED TO ONE HOME PER FAMILY UNIT. CARRIED. ED PALUCH REPORTED THAT HE HAD A LETTER FROM THE DEPARTMENT OF REGULATION REGARDING A COMPLAINT FILED AGAINST MR. LORNE CUMBY WITH THE CHARGES BEING ABANDONING A JOB. MR. LORNE CUMBY, CONTRACTOR, PULLED A PERMIT, EXCAVATED THE GROUND, PUT IN A SLAB AN~ STOPPED. THE CONSTRUCTION HAS BEEN STOPPED ABOUT 9 MONTHS. AFTER SPEAKING WITH THE STATE ON NOVEMBER 3, 1981, IT WAS INDICATED THAT MR. CUMBY DENIED THE CHARGES AGAINST HIM AND THAT A PRELIMINARY HEARING WAS SET FOR OCTOBER 2 , 1981 AND THEY HAD NO!'~RECORD OF MR. CUMBY APPEARING AT THE MEETING. THE BOARD STATED THAT THEY WERE GOING TO PROSECUTE AND THAT THE CASE WAS NOT CLOSED. ARTHUR MAYER, BUILDING OFFICIAL, STATED THAT MR. CUMBY WAS PRESENT AND THAT HE WANTED TO GET ANOTHER BUILDING PERMIT FOR ANOTHER. STRUCTURE AND HE FELT THAT HE SHOULD BRING THIS BEFORE THE BOARD FOR THEIR OPINION.TO SEE IF A PERMIT SHOULD BE ISSUED OR NOT. MR. CUMBY STATED THAT HE HAS SPOKEN TO HiS ATTORNEY AND HIS ATTORNEY STATED THAT HIS LICENSE iS UNDER INVESTIGATION BUT THAT IT WAS STILL VALID. HE STATED THAT HE DID NOT ABANDON THE JOB AND THAT THE LAND HAS BEEN SOLD AND ALL THE BILL HAVE BEEN PAID. SEBASTIAN CONSTRHCTZON BOARD - .NOVEMBER '4, 1981 MR. CUMBY EXPLAINED THAT HE DID NOT OWN THE. PROPERTY AND THAT HE WAS THE CONTRACTOR ON THE PERMIT. HE INDICATED THAT A BUILDING WAS TO BE BUILT AND THAT THE FINANCING HADEFALLEN THROUGH. MR. CUMBY STATED THAT HE WAS IN TALLAHASSEE AND HE WOULD GIVE MR. ARTHUR MAYER A COPY OF THE!SIGNED AFFIDAVIT. ARTHUR MAYER, BUILDING OFFICIAL, EXPLAINED THAT A RETAINING WALL WAS TO BE PUT UP AND SINCE THE JOB HAS COME TO A COMPLETE HAULT, 2.THESE WALLS HAVE NOT BEEN PUT UP AND THE SURROUNDING PROPERTY IS BEGINNING TO ERODE. IT WAS A UNANIMOUS VOTE,. THF&T'.~MR. CUMBY WOULD NOT BE ISSUED A BUILDING. PERMIT UNTIL THE CONSTRUCTION BOARD HAS HEARD FROM THE STATE. THE BOARD GAVE ARTHUR MAYER THE AUTHORITY TO ISSUE MR. CUMBY A BUILDING PERMIT WHEN HE WAS SATISFIED WITH THE RESULTS FROM THE STATE. ARTHUR MAYER STATED THAT HE WOULD TRY TO HAVE AVDEFIN1TE ANSWER FOR MR. CUMBY BY NOVEMBER 6TH OR ~TH. ED PALUCH, READ A LETTER FROM DAVID HINES, STATING THAT HE IS RESIGNING FROM THE SEBASTIAN CONSTRUCTION .BOARD, EFFECTIVE NOVEMBER 4, 1981, DUE TO HIM TAKING A GOVERNMENT JOB IN ANOTHER AREA. ED PALUCH STATED THAT HE HAS AN APPLiCATiON' FROM CHRIS KIRRIE, TO FILL THE POSITION OF DAVID HINES. HE REPORTED THAT MR. KIRRIE HAS SERVED ON THE BOARD IN THE PAST. IT WAS A UNANIMOUS VOTE BY THE SEBASTIAN' CONSTRUCTION BOARD TO .ACCEPT ERIS KIRRIE TO FILL THE POSiTiON OF DAVID HINES AS A PLUMBING CONTRACTOR, TO SERVE ON THE SEBASTIAN CONSTRUCTION BOARD FOR A PERIOD OF TWO YEARS. Schnitker; in response to your letter concernin$ thebids for repairing Saint Willianm Mission and the indication of some responsibility by this office, X hereby claimno responsibility for the failure of this pre-constructed, pre-enzineered building by Aluminum Construction. The structure and beam was not constructed und~rmy direct supervision, but as a factory-~built pre-engineered item. There is,no prOblem wi~h their en~ineering design, but the factory that Aluminum Construction hired to build this pre- engineered building, built a defective beam, that in no way could properly be inspected by myself. I further inform you that I do not carry any professional liability insurance and have not done so in the IasC. eight (8) years .and have never had a claim in prior years of the.--total fourteen (l&) years as operating as an Architect. . I feel I took reasonable good care in assisting St. Helen Parish and St. Williams }~ssion. to attain a lov cost, temporary recreation building facility. The minimak fee that we billed for this service ia testimony to the sincere efforts to assis, t Saint Williams Hission, Father O'Haire and indirectly the Parish of Saint Helen Church.
