The Pledge of Allegiance was said, ROLL CALL: PRESENT: EXCUSED ABSENCE: Chmn. Cecrle Meredith Fox Michael Herbig Andrew AIIocco Louis Nicolini ALSOPRESENT: Michael Holdddge Pierre Paquette(a) Scott Taylor(a) George Bonacci, Building Department Director Richard Schofield, Building Inspector Gerry Kubes, Administrative Secretary Ann Brack, Recording Secretary Councilman Barczyk was present in the audience. /~p,,~,,p~OVAL OF MINUTES: (10/12/99) MOTION by Holdddge/Fox I'd .like to make a motion that we accept the minutes of the meeting for October 12, '99. A voice vote was taken. 7 - 0 motion carried, ANNOUNCEMENTS: The secretary noted that Louis Nicolini has been excused from tonight's meeting, and Scott Taylor and Pierre Paquette will be voting, OLD BUSINESS: None NEW BUSINESS.' EXPERIOR EXAM: 1. SCHNEIDER, DONALD W. / BUILDING CONTRACTOR Mr. Donald Schneider was present and was sworn in by the Chairman at 7:04' P.M. CONSTRUCTION BOARD MINUTES OF REGULAR MEETING OF NOVEMBER 9, 1999 Mr. Schneider was asked for information on his expedenca in the States of Washington and idaho. His answers were satisfactory. MOTION by Holdddge/Herbig I'd like to make a motion that Donald William Schneider be eligible to take the Expedor Exam for Building Contractor. Roll call: Michael Herbig - yes Scott Taylor(a) - yes Pierre Paquette(a) - yes Chmn. Cecrle - yes Michael Holdridge - yes Andrew AIIocco - yes Meredith Fox - yes The vote was 7 - 0. Motion carried. 2. BRISTER, JR., MARION E. I SIGNS - NON-ELECTRICAL Mr. Marion Bdster, Jr. was present and was sworn in by the Chairman at 7:06 P.M. MOTION by Holdridge/Fox I'd like to make a motion that Madon E. Bdstar, Jr. be eligible to take the' Experior Exam for signs with electrical. Discussion: Mr. Bdster commented that he has applied for the eleqtdcal test, not non- electrical. The Board discussed this issue, and the motion was amended to reflect this change. 3. HOLMES, D. BRiAN I SIGNS NON,ELECTRICAL Mr. Bdan Holmes was present and was sworn in at 7:10 P.M. Issues were discussed between Mr. Holmes and Board members. MOTION by Herbig/AIIocco I'd like to make a motion for D. Bdan Holmes be allowed to take the Experior Exam for Signs Non-Electrical. Roil'call: Chmn. CONSTRUCTION BOARD MINUTES OF REGULAR MEETING OF NOVEMBER 9, 1999 4. BOUCHER, JEFFREY J, I IRRIGATION Mr. Jeffrey J. Boucher was not present and it was determined to hold this application until the end of the meeting in case he arrives late. $. KERSHAW III, OLAND J..I TILE & MARBLE Mr. Oland Kershaw, III, was present and wasswom in by the Chairman at 7:14 P.M. Mr. Kershaw, III was asked to explain his experience, which he did. MOTION by AIIocco/Holdridge I'd like to make a motion that Mr. Kershaw be allowed to take the Expeder Exam for Tile and Marble, Specialty contractor. Roll call: The vote was Michael Herbig - yes Scott Taylor(a) - yes Pierre Paquette(a) - yes Chmn. Cecrle - yes Michael Holdridge - yes Andrew AIIocco - yes Meredith Fox - yes 7 - 0. Motion carried. 6. RESLOW, ROBERT I PAINTING Mr. Robert Reslow was present and was sworn in by the Chairman at 7:18 P.M. Questions were asked by Board members about some of the back-up forms attached to his application. Mrs. Jan Reslow was present and was sworn in by the Chairman at 7:18 P.M~, and gave information about these forms. MOTION by Herbig/Fox I'd like to make a motion that Robert Reslow be allowed to take the Experior Painting Exam. Cecrle - yes - yes Michael Herbig - yes - yes Andrew AIIocco - yes - yes CONSTRUCTION BOARD MINUTES OF REGULAR MEETING OF NOVEMBER 9, 1999 At this point Chmn. Cecrle again celled for Jeffrey Boucher, Jr., and since, no one responded, his application will be sent back to the secretary for further action. VIOLATION HEARINGS: ALL INDIAN RIVER FENCE CO. I KEVlN PETERS Mr. Kevin Peters was present and was swom in by the Chairman at 7:22, along with Richard Schofleld, Building Inspector, Gerry Kubes, Secretary, and George Bonacci, Building Department Director. Chmn. Cecrle noted that this first violation took place at 856 Tulip Ddve, Sebastian, for placing a six (6) foot fence in the front yard of the property. Mr. Bonacci gave staff presentation, noting that All Indian River Fence applied for a fence permit, and when reviewed by Mr. Schofield, it was discovered that a Mx (6) foot fence was to be installed in the secondary front yard of a comer property.at the above address. Mr. Schofield telephoned the applicant and left a message that the permit was on hold. Mr. Bonacci noted that he spoke to Mr. Peters in. the office, informing that this fence needed to be moved back or reduce the height to four (4) feet. He stated that Mr. Peters said he would take care of it dght away, but as of October 25, 1999, it wasn't done. There was discussion between Mr. Peters and Mr. Bonacci. Mr. Peters argued that he has done other fences on corner properties in this same manner, and he's never been brought before the Board before. He did agree ,{hat he installed the subject fence without a permit. A break was taken from 7:30 to 7:39 to give staff time to produce copies of.the survey and fence drawing, as submitted by Kevin Peters. Mr. AIIocco asked for a copy of a survey of this property. Chmn. Cecrle called the meeting back to order at 7:39 P.M. and all members previously present were present. Chmn. Cecrle suggested that if the permit had been picked up before installing the fence, this issue could have been cleared up before installation. There was further discussion. Ms. Fox asked Mr. Peters if he was told that a six (6) foot fence could not be placed in a secondary front yard when he filled out the application for the permit. Mr. Peters respondad that he could not recall. 4 CONSTRUCTION BOARD MINUTES OF REGULAR MEETING OF NOVEMBER 9, 1999 MOTION by AIIocco/Fox I'd like to make a motion that we find Mr. Peters in violation of erecting the fence without a permit. MOTION by Fox/Taylor I would like to make a motion that we find Kevin Peters, All Indian River Fence, in violation of building outside of the Code requirements which would be four (4)feet rather than six (6) feet as was installed, and that he bring this matter into compliance within thirty (30) days or a fine of not more than ten dollars ($10) per day. AMENDMENT by Fox/Taylor I am going to amendthat motion that if, after the thirty;day period the fence is not brought into compliance, he will be fined the full five hundred dollars ($500). The next issue for Mr. Peters was erecting fences without a permit at four (4) locations - 671 Jordan Ave., 117 Joy Haven Dr., 619 E, embter St., and 105 Mr. Bonacci gave staff presentation and gave information frOm the memo from Gerry Kubes, Administrative Secretary in charge of permitting, indicating that four (4).permits were applied for by Mr. Peters on July 19, 1999; 'Mr. Peter's check for sixty dollars ($60) was sent back from the bank, and this permit was put on hold. The appliCant came to the .Building Department on August 13, 1.999 and paid seventy dollars ($70) to cover permit cost and return check fee. Mr. Bonacci then noted that upon inspection, it was discovered that all four of these fences were already installed. There was discussion, and Mr. & Mrs. Joyce, 117 Joy Haven Dr. were present and'Mrs. Joyce was sworn in by the Chairman. (Mrs. Joyce forgot her glasses!) Mrs. Joyce also noted that the workmanship is shoddy, as verified by Don of Poly Vinyl, the manufacturer of the fence. On questioning by Mr. Paquette(a), Mr. Peters agreed that workers were on the job-site on approximately July 9, 1999. Mr. Peters could not determine a completion date on this job. He admitted that he is in violation of starting the fence without a permit. Mr. Bonacci commented that the workmanship issue is a private issue between Mr. Peters and Mr. & Mrs. Joyce. Chmn. Cecrle determined that all four fences mentioned above were installed before the permits were picked up. Mr. Holdddge asked how much time was spent on this case by city employees in dealing with this violation. A value of five hundred dollars ($500) was suggested. Mr. Paquette noted that the permits only cost fifteen dollars ($15) each, and it is important for Mr. Peters to have more respect for the Building Department and apply for the permits before starting a job. At this point, Mr. Bonacci recommended that All Indian River Fence have their license suspended for a pedod of six (6) months, with no permits, and at the end of that time, they may erect fences and start anew. He noted that if they are found to be installing fencing in Sebastian without a permit during this time, they will be brought backbefore this Board and given a heavier fine. Mr. Peters noted that he has contracts to fill, and he would apply for permits when he was ready to do the jobs. Ms. Fox asked Kevin Peters if he agreed that the fencing was at least started, if not finished, at the four addresses listed above, prior to getting the permits. Mr. Kevin Peters agreed with Ms. Fox's statement. MOTION by Herbig/Taylor I'd like to make a motion that we find All Indian River Fence Company, Kevin Peters, qualifier, in violation of having no permit (Section 26-172(1).) on 117 Joy Haven, 619 Sembler, 105 Lancaster, and 671 Jordan Avenue, and with said violation, I'd like to impose a $200 (two-hundred dollar) fine per address. There was discussion. BUILDING OFFICIAL, MATTERS: None BOARD MATTERS: Mr. AiIocco asked again for a Land Development Code book. Mr. Bonacci noted..that members of this Board do not get these books issued; The secretary notad that she .would check into it. City Councilman, Joseph Barczyk, commented that the new Code books should be out in January, 2000. ATTORNEY MATTERS: None RECORD.SCOt,ES IN SCOREBOOK: Pierre Paquette(a) and Meredith Fox recorded the scores in the.sOorebook. There was no input from the public. Mr. Holdddge mentioned that some new building codes are coming into effect, and Mr. Bonacci expanded on this subject. Mr. Holdridge also noted that in action by the Senate, State Contractors .will not be eliminated. This issue was discussed. Mr. Taylor asked how to remedy a situation where a contractor's license is suspended for a time, but he has contracts to fill during that suspension. Mr. Bonacci explained that this contractor can either hire another contractor to do the jobs, or he can approach the customer, be honest, and ask for postponement of the jObs. CONSTRUCTION BOARD MINUTES OF REGULAR MEETING Of NOVEMBER 9, 1999 There was discussion about whether or not any of these fence cases might come back before this Board, and Mr. Bonacci indicated that he was unsure. There was discussion about whether or not this Board could hear a case on"shoddy workmanship", :and it.was suggested that there is a phrase in the SBBC that applies to this subject. Chmn. Cecrle adjourned the meeting at 8:35 P.M.
