ATTORNEY TORPY TOLD THE BOARD THAT IF PROPER NOTICE HAS BEEN GIVEN AND THE PERSON DOES NOT APPEAR BEFORE THE BOARD!'THAT THE BOARD PROCEED WITH THE CASE. HE FELT THAT WHEN THE BOARD KEEPS CONTINUING CASES IT PUTS THE CITY INTO A STALEMATE POSITION. MR. NiCHOLSON GAVE A RUN DOWN ON THE CASE. MR. BONACCI GAVE SPECIFIC DETAILS TO THE BOARD. VICE CHAIRMAN DERNBACH NOTED THAT THE VIOLATIONS IN THIS CASE HAD BEEN DISPOSED OF, THAT THE BOARD WANTED TO SEE WHA~ DATE JOHN FINNIGAN JR. PULLED HIS LICENSE FROM AETNA TO SEE IF THE CONTRACT WAS SIGNED AFTER THAT DATE AND IF MR. FINNIG-AN HAD BEEN ACTING AS A CONTRACTOR WITHOUT A LICENSE~ THE BOARD SECRETARY TOLD THE BOARD THAT JOHN FINNIGAN CEASED QUALIFYING AETNA IN JUNE OF 1991. (CORRECT DATE IS JULY, 1991.) ATTORNEY TORPY WITHDRAW THIS CASE FROM BEFORE THE BOARD, RENOTICE iT AND BRING IT BACK BEFORE THE BOARD WITH THE APPROPRIATE DOCUMENTATION TO CLEAR UP THE CON~USION. SAID THAT AT THIS TIME THE CITY WAS GOING TO TONY IACOVIELLO 908 LANCE STREET MR. IACOVIELLO WAS NOT PRESENT AT THE MEETING. MR. NICHOLSON GAVE A RUN DOWN OF THE CASE. CHAIRMAN TOLD THE BOARD THAT THE NOTICE OF HEARING. WAS DELIVERED TO THE HOUSE, THEY WOULD. NOT ACCEPT IT AND THAT HAD BEEN MAILED BACK TO THE CITY UNOPENED. FINDINGS OF FACT MOTION BY MR. THE PERSON WORKING ON THAT JOB, TO AVOID BEING CITED AS AN UNLICENSED CONTRACTOR SAID THAT THEY WERE WORKING AS AN EMPLOYEE FOR.INDIAN RIVER HOMES. IT IS THEN THE CITY'S RESPONSIBILITY TO INvEBTISA~~. AND MAKE SURE THAT PERSON IS AN EMPLOYEE. THIS CAN BE DONE THROUGH THE RECORDS OF AN EMPLOYEE. IN THIS CASE, THIS HAS ~ NOT BEEN DONE. MOTION CARRIED. ATTORNEY MATTERS: ATTORNEY TORPY STATED THE IMPORTANCE OF HAVING A CITY OFFICIAL TO TESTIFY iN A CASE, THEN THE CASE SHOULD BE CONTINUED. IT IS ALSO IMPORTANT THAT ALL TESTIMONY SHOULD BE SWORN' TESTIMONY. ATTORNEY TORPY SAID HE WOULD BE DISCUSSING BOARD PROCEDURE WITH MR. COOPER.
