IN THE CITY COUNCIL CHAMBERS. K. NAPPY, ~ECRETARY SEBASTIAN CONSTRUCTION BOARD NOTE: IF ANY PERSON DECIDES TO APPEAL ANY DECISION MADE ON THE ABOVE MATTERS, HE/SHE WILL NEED A RECORD OF THE PROCEEDINGS, AND FOR SUCH PURPOSES, HE/SHE MAY NEED TO ENSURE THAT A VERBATIM RECORD OF THE PROCEEDINGS IS MADE, WHICH RECORD INCLUDES THE TESTIMONY IN EVIDENCE ON WHICH THE APPEAL IS BASED. CECRLE VICE CHAIRMAN MOSBY CHAIRMAN SMITH ABSENT: NONE ALSO PRESENT: GEORGE BONACCI, BUILDING OFFICIAL APPROVAL OF MINUTES: REGULAR MEETING - 10/8/96 MOTION BY VICE CHAIRMAN MOSBY, SECONDED BY MR. HERBIG TO APPROVE THE MINUTES OF 10/8/96. MOTION CARRIED. OLD BUSINESS: NONE NEW BUSINESS: BLOCK EXAMS: HERAN, DEAN C./RESIDENTIAL CONTRACTOR VICE CHAIRMAN MOSBY SAID THAT HE HAD SOME QUESTIONS FOR THE APPLICANT. CHAIRMANSMiTH SWORE IN MR. HERAN. VICE CHAIRMAN MOSBY ASKED MR. HERAN IF HE WAS AN AMERICAN CITIZEN. MR.HERAN SAID NO BUT THAT HE WAS A U.S. PERMANENT RESIDENT, THAT HE DiD PAY TAXES. THE ONLY THING HE COULDN'T DO WAS VOTE. MOTION BY VICE CHAIRMAN MOSBY, SECONDED BY MR CECRLE TO RECOMMEND APPROVAL THAT MR. HERANTAKE THE BLOCK EXAM FOR RESIDENTIAL CONTRACTOR. ROLL CALL WAS TAKEN. MOTION 6-0. MORRISON, JAMES M./PLUMBING CONTRACTOR MOTION BY VICE CHAIRMAN MOSBY, SECONDED BY MR. HEARNE TO RECOMMEND THE APPROVAL OF JAMES MORRISON TO TAKE THE BLOCK EXAM FOR THE PLUMBING CONTRACTOR. VZOZ,~TZON REOPENING OF CASE: SCOTT HAUSHEER 1528 GLENTRY LANE THIS CASE WAS ORIGINALLY HEARD AT THE MEETING HELD 7/9/96 AT WHICH TiME HE WAS FOUND IN VIOLATION OF SEBASTIAN CODE OF ORDINANCES 26-171(a), UNLICENSED CONTRACTOR, 26-172(1), WILLFUL DISREGARD OF THE BUILDING CODES. MR. BONACCI GAVE BRIEF SUMMARY OF THE CASE. MR. HAUSHEER EXPLAINED THAT HE THOUGHT THE MEETING WAS ON THE 11TH AND WHEN HE GOT TO THE COUNCIL CHAMBERS THERE WAS A P & Z MEETING GOING ON. BECAUSE OF SOME OF THE CIRCUMSTANCES OF THE CASE HE ASKED THAT IT REOPENED. MR. BONACCi TOLD THE BOARD THAT THE CASE WAS NOT AS CUT AND DRY AS IT LOOKED IN THE BEGINNING. HE STATED THAT THE HOME OWNER PULLED THE PERMIT STATING HER SON-IN-LAW WAS GOING TO DO THE WORK. FOR MATTER OF RECORD, HER SON-IN-LAW LIVES IN MARYLAND. MR. HAUSHEER TOLD THE BOARD THAT HE HAD JUST MOVED HERE FROM CALIFORNiA AND THAT IN THAT STATE IF A HOMEOWNER PULLED THE PERMIT ANYONE COULD BE USED TO DO THE WORK. THE QUESTION WAS ASKED AS TO HOW MRS. MOODY CONTACTED HIM. HE TOLD THE BOARD THAT HE HAD PUT AN ADD IN THE PAPER TO DO MAINTENANCE WORK AND SHE HAD HIRED HIM TO PUT A CEILING FAN IN HER HOUSE. WHEN SHE ASKED HIM TO DO THE SHED MR, HAUSHEER TOLDHER THAT IF SHE PULLED THE PERMIT HE WOULD SUPPLY THE PLANS. HE SAID HE DID TELL HER THAT HE WAS NOT LICENSED. HE STOPPED WORKING ON THE SHED WHEN SHE DID NOT PAY HIM. MOTION BY VICE CHAIRMANMOSBY, SECONDED BY MR. HOLDRIDGE TO FIND MR. HAUSHEER IN VIOLATION OF SEC. 26-171(A), UNLICENSED CONTRACTOR AND IN VIOLATION OF 26-172(1), WILLFUL DISREGARD OF THE BUILDING CODES. ROLL CALL WAS TAKEN. MOTION CARRIED 6-0. P~B 3 SEBRHTZJLN CONSTRUCTION BOARD - REGUZdLR N~ETZNG - 11/12,/,96 VIOLATION HEARING/SCOTT HAUSHEER cont. MOTION BY VICE CHAIRMAN MOSBY, SECONDED BY MR. HERBIG TO RECOMMEND THAT WE REDUCE THE FINE OF $500.00 DOWN TO $100.00 FOR VIOLATING SEC. 26-171(a), AND RECOMMEND THAT WE NOT IMPOSE A FINE ON WILLFUL DISREGARD OF THE BUILDING CODES, SEC. 26-172(1). ROLL CALL WAS TAKEN. MOTION CARRIED 6-0. BUILDING OFFICIAL,NATTERS~ NONE APPOINTMENT OF FOUR BOARD MEMBERS POSITIONS OPEN: GENERAL CONTRACTOR HARV CONTRACTOR ALTERNATE CONCERNED CITIZEN REGULAR MEMBER THE BOARD RECEIVED 5 APPLICATIONS. ALTERNATE CONCERNED CITIZEN INTERVIEWS THE BOARD SPOKE TO MR. PAQUETTE AND MR. NICHOLINI. VICE CHAIRMANMOSBY NOMINATED MR. PAQUETTE. CLOSED. NOMINATIONS WERE MOTION BY VICE CHAIRMAN MOSBY, SECONDED BY MR. HEARNE TO RECOMMEND TO CITY COUNCIL THAT PIERRE PAQUETTE BE APPOINTED TO THE ALTERNATE CONCERNED CITIZEN POSITION ON THE CONSTRUCTION BOARD. MOTION CARRIED... IT WAS RECOMMENDED THAT SINCE MR. NICHOLINI WAS A RETIRED HARV CONTRACTOR AND THERE WAS AN OPENING ON THE BOARD FOR THIS PARTICULAR CONTRACTOR, MR. BONACCI WOULD DO A MEMO TO CITY COUNCIL RECOMMENDING MR. NICHOLINI BE APPOINTED ~THIS POSITION. A RECESS WAS TAKEN AT 7:45 P.M. MEETING WAS REOPENED AT 7:50 P~ WITH ALL PRESENT. SINCE CHAIRMAN SMITH APPLYING TOBE REAPPOINTED TO THEiBOARD, HE STEPPED DOWN AND ViCE CHAIRMAN. MOSBY CHAIRED THIS~RTION OF THE MEETING. PA(aK SBBASTIAM C~ONSTRUCTTOM BOARD - RBOULAR MBRTXNG - 3. t/12/96 THE BOARD INTERVIEWED JERRY SMITH; FRANK GARLAND AND BOB TOMLINSON. MR. CECRLE NOMINATED JERRY SMITH FOR REAPPOINTMENT TO THE REGULAR POSITION. NOMINATIONS WERE~CLOSED. MOTION BY MR. HEARNE, SECONDED BY MR. HERBIG TO RECOMMEND TO CITY COUNCIL THE REAPPOiNTMENT OF JERRY SMITH TO THE REGULAR MEMBER POSITION. MOTION CARRIED. CHAIRMAN SMITH RESUMED CHAIRING THE MEETING. VICE CHAIRMAN MOSBY, SECONDED BY MR. HEARNE TO RECOMMEND TO CITY COUNCIL THE APPOINTMENT OF LOUIS NiCHOLiNI TO THE HARV POSITION. MOTION CARRIED. SINCE THERE WERE NO APPLICATIONS FROM A GENERAL CONTRACTOR IT WAS SUGGESTED THAT THIS POSITION BE CHANGED TO REGULAR MEMBER. MR. HEP, BIG NOMINATED MR. GARLAND, MR. HEARNE NOMINATED MR. TOMLINSON. NO ACTION WAS TAKEN ON EITHER APPLiCANT. VICE CHAIRMAN MOSBY FELT THAT NEITHER OF THE APPLICANTS HAD THE BACKGROUND TO SERVE IN THE GENERAL CONTRACTOR POSITION. VICE CHAIRMAN MOSBY EXCUSED HIMSELF FROM THE MEETING. DXSCtISSXOM~ ARTICLE VI, CONTRACTORS, SECTION 26 SEBASTIAN CODE OF ORDINANCES THE BOARD SECRETARY ASKED IF A MASTER CAN PULL PERMITS. SHE EXPLAINED THAT IN THE PAST THEY COULD NOT, PROBLEM BEING THAT IT WAS NOT IN WRITTEN IN THE CODES. MR. BONACCi SAID THAT ALL THE MASTER WAS LACKING WAS THE BUSINESS PORTION OF THE TEST. HE DID NOT FEEL THAT THIS MADE FOR A BETTER CONTRACTOR. THE IMPORTANT THING WAS THE KNOWLEDGE OF THE TRADE. MR. BONACCI SAID THAT ANYONE WHO HAS A MASTER LICENSE;' STARTING TOMORROW WILL BE ABLE TO PULL A PERMIT UNTIL CITY COUNCIL APPROVES THE CHANGES TO THE CODES. PAGE 5 SEBASTIAN CONSTRUCTION BOARD - RR~JLARMRET~HG - 11/12/96 THE BOARD SECRETARY ALSO ASKED IF THE BOARD WAS GOING TO REQUIRE STATE REGISTRATION FOR DRYWALL. MOTION BY MR. CECRLE, SECONDED BY MR. HEARNE THAT WE NOT REQUIRE STATE REGISTRATION FOR DRYWALL MOTION CARRIED. IT WAS ASKED HOW LONG A PERSON MAY STAY IN THE INACTIVE STATUS BEFORE HE MUST ACTIVATE HIS LICENSE. MOTION BY MR. CECRLE, SECONDED BY MR. HEARNE THAT AFTER A LICENSE HAS BEEN INACTIVE FOR A LIMIT OF THREE YEARS THAT HE MUST COME BACK BEFORE THE BOARD TO ACTIVATE HIS LICENSE. MOTION CARRIED. THERE BEING NO FURTHER BUSINESS, MEETING ADJOURNED AT 9:00 P.M.
