CALL TO ORDER ROLL CALL A'PPROVAL OF MINUTES - REGULAR MEETING - 10/9/90 OLD BUSINESS: VIOLATION HEARING CONTINUED VON REISEN, ALAN ATTORNEY MATTERS: BUILDING OFFICIAL MATTERS: NEW BUSINESS: BLOCK EXAM - SEBASTIAN SMITH, DAVID T./TILE & MARBLE REAGAN, WILLIE C./RESIDENTIAL CONTRACTOR MURPHY JR., JOHN F./DRYWALL BLOCK EXAM - GAINESVILLE AUTRY, DAVID K./GENERAL CONTRACTOR ACTIVATE LICENSE SILVA, SCOTT/ROOFING UNLIMITED SEBASTIAN CONSTRUCTION BOARD REGULAR MEETING NOVEMBER ~ 1990 ' 7:30 P.M. MEETING WAS CALLED TO ORDER BY ACTING CHAIRMAN DERNBACH AT 7:30 P.M. ROLL CALL: PRESENT: MR. KELLEY MR. NEUBERGER MR. CAPP ACTING CHAIRMAN DERNBACH ABSENT: CHAIRMAN CAREY - EXCUSED MR. HANEY - EXCUSED VICE CHAIRMAN LAMAN - UNEXCUSED ALSO PRESENT: GEORGE BONACCI - CHIEF BUILDING INSPECTOR APPROVAL OF MINUTES MOTION BY MR. CAPP, SECONDED BY MR. NEUBERGER TO ACCEPT THE MINUTES OF THE OCTOBER 9, 1990 MEETING. CARRIED. OLD BUSINESS VIOLATION HEARING CONTINUED - ALAN VON REISEN MR. VON REISEN WAS PRESENT AT THE MEETING. MR. DAVE PATTY WAS ALSO PRESENT AND ASKED TO APPROACH THE MIC. ACTING CHAIRMAN DERNBACH ASKED MR. PATTY IF HE STILL WAIVED HIS RIGHTS AS TO THE NOTIFICATION OF HEARING AND HE SAID THAT HE DID. MR. PATTY WAS SWORN IN. MR. CAPP NOTED THAT AT THE LAST MEETING MR. PATTY WAS ASKED TO BRING IN SOME OF HIS WORK RECORDS. MR. PATTY SAID THAT HE DiD NOT HAVE ANY PAPERWORK REGARDING THE WORK DONE AT 1225 BEVAN. MR. & MRS. BRADY OF 1225 BEVAN WERE PRESENT AT THE MEETING AND WERE SWORN IN. PAGE 2 SEBASTIAN CONSTRUCTION BOARD - 11/13/90 VON REISEN, ALAN cont MR. BRADY SHOWED A COPY OF THE CONTRACT BETWEEN HE AND HIS WIFE AND ABC POOLS. DPI, DAVE PATTY, INC., A SWIMMING POOL PROPOSAL FOR MR. CHARLES BRADY SR., 1225 BEVAN, SEBASTIAN, FLORIDA. IT WAS SIGNED BY DAVE PATTY. THERE WAS ALSO A CANCELLED CHECK MADE PAYABLE TO DPI FOR $1620.00. MR. BRADY TOLD THE BOARD THAT DIGGING THE HOLE WAS AS FAR AS DPI HAD GOTTEN WHEN A STOP WORK ORDER WAS POSTED. ANOTHER POOL CONTRACTOR COMPLETED THE POOL. THE CHECK WAS FOR DPI TO START THE POOL. THE MONEY WAS REFUNDED. IT WAS NOTED THAT FINDING OF FACTS: MOTION BY MR. CAPP, SECONDED BY MR. KELLEY THAT WE FIND MR. PATTY, HE DID VIOLATE CITY OF SEBASTIAN CODE 7-20, NO PERMIT, 7-99(A), NO LICENSE, 7-100(1), VIOLATION OF BUILDING CODE. THE BOARD SECRETARY NOTED THAT IN THE FINDING OF FACT THAT IT NEEDED TO BE MORE SPECIFIC. MR. KELLEY WITHDREW HIS SECOND. MR. CAPP WITHDREW HIS MOTION. MOTION BY MR. CAPP, SECONDED BY MR. KELLEY THAT WE HAVE FOUND THAT MR. PATTY HAS VIOLATED CITY OF SEBASTIAN CODES 7-20, NO PERMIT, 7-99(A), NO LICENSE, 7-100(1), VIOLATION OF BUILDING CODE, WHICH OCCURRED AT 1225 BEVAN IN THE CITY OF SEBASTIAN ACTING AS AN UNLICENSED POOL CONTRACTOR. ROLL CALL: AYES: MR. KELLEY MR. NEUBERGER MR. CAPP ACTING CHAIRMAN DERNBACH NAYS: NONE CARRIED. MOTION BY MR. NEUBERGER, SECONDED BY MR. CAPP THAT THE FINDING BY THE BOARD BE SENT TO DPR FOR ENTRY IN MR. PATTY'S RECORD - IF HE iS DULY LICENSED HE MUST BE REGISTERED WITH THE STATE.. CARRIED. MEETING REOPENED AT 8:00 P.M. WITH ALL PRESENT. MOTION BY MR. CAPP SECONDED BY MR. NEUBERGER THAT NO ACTION BE TAKEN AGAINST ALAN VON REISEN REGARDING THE POOL. AT 1225 BEVAN. CARRIED. MR. VON REISEN REQUESTED THAT A LETTER BE SENT TO CHET BUSH, BUILDING OFFICIAL IN'BREVARD COUNTY SHOWING THE OUTCOME OF THE MEETING. NEW BUSINESS BLOCK EXAM - SEBASTIAN SMITH, DAVID T./TILE & MARBLE REAGAN, WILLIE C./RESiDENTIAL CONTRACTOR MURPHY JR., JOHN F./DRYWALL MOTION BY MR. NEUBERGER SECONDED BY MR. KELLEY TO ACCEPT THE APPLICATIONS OF DAVID SMITH, WILLIE REAGAN AND JOHN MURPHY JR. FOR THE BLOCK EXAM IN SEBASTIAN. CARRIED. BLOCK EXAM - GAINESVILLE AUTRY, DAVID K./GENERAL CONTRACTOR MOTION BY MR. CAPP, SECONDED BY MR. NEUBERGER THAT WE ACCEPT THE APPLICATION TO ACTIVATE HIS LICENSE. CARRIED. MR. PURKHISER WAS SWORN IN. IT WAS NOTED THAT MR. PURKHISER'S COMPANY WAS CALLED J & D ROOFING. A BRIEF DISCUSSION FOLLOWED. FINDING OF FACTS: MOTION BY MR. CAPP, SECONDED BY MR. KELLEY THAT JAMES PURKHISER WAS FOUND IN VIOLATION IN THE CITY OF SEBASTIAN CODES ON THE DATE OF 8/11/90 AT APPROXIMATELY 1:00 P.M., HE WAS FOUND IN VIOLATION OF SEC. 7-99(A), NO LICENSE, SEC. 7- 100(1.), VIOLATION OF BUILDING CODE, SEC 7-20, NO PERMIT AT 307 BAYHARBOR, CiTY OF SEBASTIAN. ROLL CALL: AYES: MR. KELLEY MR. NEUBERGER MR. CAPP ACTING CHAIRMAN DERNBACH NAYS: NONE CARRIED. MOTION BY MR. NEUBERGER, SECONDED BY MR. CAPP THAT THE FINDINGS OF THE BOARD BE SENT TO DPR AS AN ENTRY INTO MR. PURKHiSER'S RECORDS. CARRIED. MOTION BY MR. CAPP, SECONDED BY MR. NEUBERGER THAT NO FURTHER ACTION BE TAKEN AGAINST JAMES PURKHISER AT THIS TIME REGARDING A HOUSE AT 307 BAYHARBOR TERRACE, LOT 14, BLOCK 308, CITY OF SEBASTIAN. CARRIED. KELLEY THAT IN THE CASE OF PRE-FAB FACTORY MADE THROUGH INDUSTRY STANDARD TYPE UTILITY SHEDS, THE INSTALLER, IF HE IS A DISTRIBUTOR INSTALLING THIS FACTORY PRODUCT SHOULD NOT NEED A COMP CARD TO DO THE INSTALLATION BUT HE DOES HAVE TO PULL THE PERMITS AND ABIDE BY THE LOCAL TIE DOWN REGULATIONS. CARRIED. IT WAS ALSO NOTED THAT A CERTIFICATE OF INSURANCE BE SUBMITTED WITH THE PERMIT APPLICATION. SCORES WERE REGISTERED IN THE SCORE BOOK BY MR. NEUBERGER AND MR. KELLEY.
