NAPPI, SECRETARY SEBASTIAN CONSTRUCTION BOARD NOTE: IF ANY PERSON DECIDES TO APPEAL ANY DECISION MADE ON THE ABOVE MATTERS, HE/SHE WILL NEED A RECORD OF THE PROCEEDINGS, AND FOR SUCH PURPOSES, HE/SHE MAY NEED TO ENSURE THAT A VERBATIM RECORD OF THE PROCEEDINGS IS MADE, WHICH RECORD INCLUDES THE TESTIMONY IN EVIDENCE ON WHICH THE APPEAL IS BASED. SEBASTIAN CONSTRUCTION BOARD REGULAR MEETING NOVEMBER 1.~ 1989 - 7:30 P.M. MEETING WAS CALLED TO ORDER BY CHAIRMAN CAREY AT 7:30 P.M. ROLL CALL: PRESENT: MR. NEUBERGER MR. CAPP' MR. DERNBACH CHAIRMAN CAREY ABSENT: VICE CHAIRMAN LAMAN - EXCUSED ALSO PRESENT: BRUCE COOPER, BUILDING OFFICIAL; GEORGE BONACCI, CHIEF BUILDING INSPECTOR; CHARLES NASH, CITY ATTORNEY. APPROVAL OF MINUTES MOTION BY MR, CAPP, SECONDED BY MR. DERNBACH TO APPROVE MINUTES OF REGULAR MEETINGS HELD 9/12/89, 10/10/89 AND SPECIAL MEETING HELD 9/22/89 AS WRITTEN. MOTION CARRIED. OLD BUSINESS: DISCUSSION: ORDINANCE FOR UNLICENSED CONTRACTORS MR. COOPER ASKED THAT THE DISCUSSION FOR PENALTIES FOR USING UNLICENSED CONTRACTORS BE MOVED TO THIS DISCUSSION. MR. COOPER REQUESTED THAT ALL SPECIALTY CONTRACTORS BE BLOCK AND ASSOCIATES TESTED. ATTORNEY NASH SAID THE CITATION PROCESS WOULD BE BROUGHT UP AT A FUTURE DATE. MR. COOPER TOLD THE BOARD THAT HE JUST WANTED TO GET THE NEW ORDINANCE IN USE AND THAT WHERE CITATIONS WERE CONCERNED THAT THEY WOULD BE BROUGHT BACK AT A LATER DATE. ATTORNEY NASH SAID HE WOULD RECOMMEND TO CITY COUNCIL NOT TO ALLOW CITATIONS AT THE PRESENT TIME. MR. COOPER SAiD HE WOULD RECOMMEND IT STILL BE PURSUED TO FIND OUT FROM THE COUNTY WHAT CAN BE DONE. PAGE 2 IT WAS NOTED THAT EXISTING LICENSED SPECIALTY CONTRACTORS WOULD BE GRANDFATHERED IN AND NOT BE REQUIRED TO TAKE THE BLOCK EXAM. ON PAGE 9, "ADVERTISING", OF THE PROPOSED ORDINANCE, MR. NEUBERGER ASKED IF THE STATE LICENSE NUMBER SHOULD ALSO BE SHOWN. ATTORNEY NASH SAID THAT EITHER THE LOCAL NUMBER OR STATE REGISTRATION SHOULD BE SHOWN. MOTION BY MR. DERNBACH, SECONDED BY MR. CAPP TO RECOMMEND TO CITY COUNCIL TO ADOPT PROPOSED ORDINANCE TO REPLACE EXISTING ORDINANCE ON THE BOOKS, INCLUDING THE ADDING OF STATE REGISTRATION NUMBER WHEN ADVERTISING. MOTION CARRIED. RECESS WAS TAKEN AT 9:10 P.M. REOPENED AT 9=30 P.M. WITH ALL PRESENT WITH THE EXCEPTION OF ATTORNEY NASH WHO WAS EXCUSED FROM THE MEETING. NEW BUSINESS CHANGE OF CORPORATION BIEBER, WALTER/GLASS & GLAZING MOTION BY MR. CAPP, SECONDED BY MR. NEUBERGER TO APPROVE APPLICATION FOR CHANGE OF CORPORATION. MOTION CARRIED. CHANGE OF INDIVIDUAL TO CORPORATION KING JR., THOMAS P./TILE INSTALLATION STADELMAN, THOMAS/DRYWALL SUB-CONTRACTOR MOTION BY MR. DERNBACH, SECONDED BY MR. CAPP TO APPROVE CHANGE OF STATUS. MOTION CARRIED. LETTER OF RECIPROCITY ACKERMAN, JOSEPH B./ALUMINUM UNLIMITED MUELLER, JAMES D./ALUMINUM UNLIMITED MOTION BY MR. NEUBERGER, SECONDED BY MR. CAPP TO ACCEPT LETTERS OF RECIPROCITY. NEUBERGER, SECONDED BY MR. CAPP TO ACCEPT APPLICATIONS. MOTION CARRIED. LEDFORD, MARK J./LAWN SPRINKLERS THERE WAS A BRIEF DISCUSSION ON MR. LEDFORD'S CREDIT REPORT. MR. LEDFORD WAS NOT PRESENT AT THE MEETING. MOTION BY MR. NEUBERGER, SECONDED BY MR. CAPP TO TABLE MR. LEDFORD'S APPLICATION UNTIL THE MEETING OF 12/12/89 AND REQUEST MR. LEDFORD APPEAR BEFORE THE BOARD. MOTION CARRIED. COMPLAINTS AGAINST CONTRACTORS FiGUEIREDO, ANTERO/SUN LIGHT HOMES, INC. MR. COOPER TOLD THE BOARD THAT SUN LIGHT HOMES HAD UTILIZED UNLICENSED SUB-CONTRACTORS WHO WERE IN THE PROCESS OF BEING LICENSED. HE STATED THAT HE WAS NOT ASKING FOR DISCIPLINARY ACTION. MR. FIGUEiREDO SAID THEY HAD WORKED FOR HIM FOR 5 YEARS AND DID NOT REALIZE THEY NEEDED TO BE LICENSED IN SEBASTIAN. IN REGARDS TO DOUBLE R, CARPENTRY, MR. COOPER ASKED THAT IT BE PURSUED AT THE DECEMBER MEETING. PAGE FIGUEIREDO, ANTERO/SUN LIGHT HOMES cont MOTION BY MR. NEUBERGER, SECONDED BY MR. DERNBACH THAT THE BOARD FIND MR. FIGUEIREDO GUILTY OF USING UNLICENSED SUBS. MOTION CARRIED. MOTION BY MR. DERNBACH, SECONDED BY MR. CAPP, THAT IN VIEW OF THE FINDING OF FACTS BY THIS BOARD, THAT MR. FIGUEIREDO BE PUT ON PROBATION FOR 90 DAYS WITH THE UNDERSTANDING THAT ANY VIOLATION THAT WOULD COME BEFORE US DURING THAT TIME WOULD BE IN CONJUNCTION WITH THIS AND A $600.00 FINE BE IMPOSED TO THiS VIOLATION AND THE NEW VIOLATION, WHATEVER THE BOARD DECIDES AT THAT TIME. MOTION CARRIED. PHILIPSON, BTEVEN/STEVEN PHILIPSON PROPERTIES MR. COOPER STATED THAT MR. PHILIPSON WAS FOUND IN VIOLATION OF SEC. 7-20, CODE OF ORDINANCE - NO PERMIT FOR ELECTRICAL OR PLUMBING OR REMODELING AND SEC. 7-99, CODE OF ORDINANCE - WORKING IN A CAPACITY OF A TRADE THAT HE DOES NOT HOLD A CURRENT CERTIFICATE OF COMPETENCY. MOTION BY MR. NEUBERGER, SECONDED BY MR. DERNBACH THAT STEVEN PHILIPSON IS FOUND GUILTY OF THE VIOLATION OF SECTIONS 7-20 AND 7-99, CODE OF ORDINANCES AND IS FINED $500.00, SUSPENDED, AND BE PUT ON PROBATION FOR SIX MONTHS. MOTION CARRIED. DISCUSSION: TRADES LICENSED BY BOARD A SPECIAL MEETING TO BE HELD 11/30/89, 7:00 P.M. WAS SCHEDULED BY THE BOARD. CHAIRMAN CAREY ASKED THAT ALL BOARD MEMBERS START ARRIVING AT ALL MEETINGS AT 7:00 P.M. TO GO OVER THE APPLICATIONS. MR. CAPP AND MR. DERNBACH REGISTERED SCORES IN THE SCORE BOOK. THERE BEING NO FURTHER BUSINESS, MEETING ADJOURNED AT 11~00 P.M.
