STILWELL SAID THE CONTRACT WAS DONE UNDER ATLANTIC IRRIGATION. HE HAD CROSSED OUT AUTOMATIC RAIN AND WRITTEN IN ATLANTIC IRRIGATION WHICH WAS DONE AFTER THE FACT AS ADVISED BY MR. COOPER. MR. COOPER NOTED THAT AUTOMATIC RAIN iS NOT LICENSED IN SEBASTIAN. MR. MOSBY ASKED WHAT THE AFPILIATION WAS BETWEEN AUTOMATIC 'RAIN AND ATLANTIC IRRIGATION. MR. STILWELL SAID THAT WHEN THE WORK WAS DONE THAT THE CHECK IS SENT TO JOHN OLIVIA (ATLANTIC IRRIGATION) AND THEY SEND BACK A CHECK FOR OUR LABOR, AUTOMATIC RAIN. MR. STILWELL SAID THAT IT WAS A LIMITED PARTNERSHIP. MR. COOPER ASKED IP HE WAS STILWELL SR., MR. BTILWELL SAID YES, THAT STILWELL JR. WAS AN EMPLOYEE OF AUTOMATIC R'AIN~ SEBASTIAN CONSTRUCTION BOARD - 12/10/91 HEARING VIOLATION - STILWELL cunt MR. STILWELL SAID THAT WORKMANS COMP IS CARRIED ONLY IN BREVARD COUNTY FOR AUTOMATIC RAIN. MR. COOPER NOTED THAT THERE ARE TWO DIFFERENT THINGS INVOLVED. MR. STILWELL ACTING AS A CONTRACTOR WITHOUT A LICENSE AND ATLANTIC IRRIGATION ACTING AS A LICENSED CONTRACTOR HIRING AN UNLICENSED SUB-CONTRACTOR. FINDING OF FACTs MOTION BY MR. NEUBERGER, SECONDED BY MR. HANEY THAT WK= FIND MR. STEPHEN STILWELL GUILTY OF THE CHARGES OF VIOLATION TO THE SEBASTIAN CITY CODE OF ORDINANCES ARTICLE 7-99(A) NOT LICENSED. MOTION CARRIED. MOTION BY MR. NEUBERGER, SECONDED BY MR. HANEY THAT SINCE THE BOARD HAS UNANIMOUSLY FOUND MR. STILWELL GUILTY OF VIOLATING THE~SEBASTIAN CITY CODE OF ORDINANCES, ARTICLE 7-99(A), NOT LICENSED, FEEL THAT A FINE OF $250.00 BE LEVIED. MOTION CARRIED. MR. STILWELL SAID THAT HE WAS PLANNING TO TAKE THE TEST AND OBTAIN HIS LICENSE. THE BOARD REQUESTED THAT JOHN OLIVIA BE IN ATTENDANCE AT THE JANUARY MEETING. SECONDARY MOTION BY MR. NEUBERGER, SECONDED BY MR. MOSBY THAT THE FINE PREVIOUSLY LEVIED FOR VIOLATION OF SEBASTIAN CODE OF ORDINANCES BE PAID PRIOR T0.HIS BEING CONSIDERED FOR A LICENSE IN THE CITY OF SEBASTIAN. MOTION CARRIED.. RELIABLE SOLAR/GREG R. MCTAGGART 518 SAUNDERS ST. CHAIRMAN CAREY SWORE IN MR. MCTAGGART. MR. MCTAGGART TOLD THE BOARD THAT HE HOLDS A SOLAR CONTRACTORS LICENSE IN BREVA~D COUNTY. MCTAGGART WAS BEFORE THE BOARD AT THEIR NOVEMBER MEETING TO OBTAIN A LICENSE THROUGH LETTER OF RECIPROCITY. LICENSE WAS PENDING FOR PROOF OF WORKMANS COMPENSATION. A DISCUSSION FOLLOWED. MOTION BY MR. DERNBACH, SECONDED BY MR. HANEY TO FIND ~REG MCTAGGART GUILTY OF VIOLATING SEBASTIAN CODE OF ORDINANCE ?- 99(A), ACTING AS AN UNLICENSED CONTRACTOR AND FIND HIM GUILTY OF VIOLATING SEBASTIAN CODE OF ORDINANCE 7-20, NO"BUILDING PERMIT, THESE VIOLATIONS HAVING TAKEN PLACE ON OCTOBER 28, 1991 AT ~18 SAUNDERS STREET. MOTION CARRIED. MOTION BY MR. NEUBERGER, SECONDED BY MR. MOSBY THAT SINCE MR. MCTAGGART HAS DULY BEEN FOUND GUILTY BY THIS BOARD OF VIOLATIONS OF ARTICLES 7-99(A) AND 7-20 SEBASTIAN CODE O.F ORDINANCES THAT WE FiNE HIM $250.00 ON EACH CHARGE, THE TOTAL OF $500.00 TO BE PAID PRIOR TO LICENSING IN THE CITY OF SEBASTIAN. THE WORDING OF THE MOTION WAS DISCUSSED BY THE BOARD. MR. MOSBY WITHDREW HIS SECOND. MR. NEUBERGER AMENDED HIS MOTION. MR. NEUBERGER ADDED TO HIS MOTION, SECONDED BY MR. MOSBY TO BE PAID PRIOR TO LICENSING OR WITHIN 90 DAYS. MOTION CARRIED. MR. HANEY VOTED NAY. DISCUSSION~ FULL SERVICE PROCTORED PROGRAM/BLOCK.~EXAM .THE!.BOARD TABLED THIS DISCUSSION UNTIL THE JANUARY MEETING TO GIVE THE BOARD SECRETARY MORE TIME IN WHICH TO :OB~TAIN MORE INFORMATION AND TALK TO SOME OF THE SURROUNDING AREAS AND GET THEIR OPINION IN THE MATTER.. THERE WAS A BRIEF DISCUSSION CONCERNING THE STATE NOW REQUIRING A RAIN SENSOR ON ALL NEWLY INSTALLED AUTOMATIC iRRIGATION SYSTEMS. HANEY RE'GISTERED THE SCORES IN THE SCORE BOOK. TH~R.E BEING NO FURTHER BUSINESS, THE MEETING ADJOURNED AT 9330 P.M.
