MEETING WAS CALLED TO ORDER BY CHAIRMAN GEORGE LA PORTE AT 2:00 P.M.
PRESENT: CHAIRMAN GEORGE LA PORTE, MARTIN LEWIS, GEORGE McCLEARY, ELIZABETH O'CONNOR,
JAMES FLOYD, CHARLES GRAY, BOARD ATTORNEY GREGORY GORE, CITY ATTORNEY THOMAS PALMER.
MOTION BY MR. McCLEARY, SECONDED BY MR. LEWIS, TO APPROVE THE MINUTES OF THE MEETING
OF JANUARY 8, 1986. CARRIED.
STATUS OF CASE NO. 85-5 - KEPPLER ~ ATTORNEY PALMER ADVISED THAT HE HAS DETERMINED
THAT THE DATE OF SUBMITTAL OF MR. KEPPLER'S APPLICATION TO THE DEPARTMENT OF ENVIRON-
MENTAL REGULATIONS WAS JUNE 1~, 1985. EVERYTHING IS GOING ALONG ON A MUTUALLY AGREE-
ABLE BASIS AND THE CITY SHOULD SOON BE RECEIVING A FORMAL APPLICATION FOR A WATER
AND SEWER FRANCHISE. ATTORNEY GORE WILL CALCULATE THE AMOUNT OF THE FINE.
MOTION BY MR. LEWIS, SECONDED BY MR. McCLEARY, THAT IN CASE NO. 85-5, ELLIOT KEPPLER,
THE ENDING DATE OF FINE IMPOSED BE JUNE 18, 1985 - TIME OF APPLICATION TO DER - AND
THE TOTAL AMOUNT OF THE FINE BE DETERMINED BY ATTORNEY GORE BASED ON THE BEGINNING
DATE OF THE FINE AS RECORDED IN THE MINUTES.
MOTION AMENDED BY MR. LEWIS, SECONDED BY MR. McCLEARY, TO ADD: INSTRUCT ATTORNEY
GORE TO PREPARE AN ENFORCEMENT DOCUMENT AND SUBMIT TO CHAIRMAN FOR SIGNATURE AND
RECORDING.

NAYS: NONE. CARRIED.
ATTORNEY PALMER MENTIONED THAT HE RECEIVES COPIES OF NOTICES SENT TO ALLEGED
VIOLATORS BY THE CODE ENFORCEMENT OFFICERS AND HE IS PLEASED TO SEE THAT SO FEW COME
BEFORE THE BOARD. THIS LED TO A BRIEF DISCUSSION AS TO WHY CERTAIN FLAGRANT VIOLA-
TIONS SEEM TO GO UNNOTICED. IT WAS AGREED THAT MR. CLOUTIER, MR. FRANCO AND CHIEF
'NAPPI WOULD BE INVITED TO ATTEND THE NEXT MEETING.
CASE NO. 86-1 - FISCHER - ATTORNEY PALMER ADVISED THAT MR. FISCHER'S FENCE WAS
APPROVED BY THE PLANNING AND ZONING COMMISSION.
MOTION BY MR. LEWIS, SECONDED BY MRS. O'CONNOR, THAT CASE NO. 86-1 - FISCHER - BE
CLOSED. CARRIED.
CASE NO. 86-3 - BRICKER - CHAIRMAN LA PORTE STATED THAT AN ORDER OF ENFORCEMENT WAS
ISSUED, AND THE CAR HAS BEEN REMOVED. HOWEVER, IN THE ORDER OF ENFORCEMENT THE
FINE LEVIED WAS NOT CORRECT AND IT WAS AGREED THAT ATTORNEY GORE SHOULD FIND OUT
FROM CHIEF NAPPI THE DATE THE CAR WAS REMOVED AND BRING BACK TO THE NEXT MEETING.
CASE NO. 85-12 - TAYLOR - AN ORDER OF ENFORCEMENT WAS ISSUED BY ATTORNEY GORE AND
SENT TO THE ADDRESS ON LOUISIANA AVENUE BY CERTIFIED MAIL. CHAIRMAN LA PORTE SUG-
GESTED SENDING A COPY TO HIS NEW ADDRESS SINCE THE MATTER HAS NOT BEEN CORRECTED.
IT WILL BE BROUGHT UP AT THE NEXT MEETING.

ATTORNEY GORE ADVISED THAT HE HAS WRITTEN A LETTER TO CHIEF NAPPI RELATIVE TO THE
COMPLAINT RECEIVED ON LIN-MARC KENNELS INFORMING HIM THAT THE BOARD HAS NO JURIS-
DICTION UNLESS A COMPLAINT IS RECEIVED FROM A RESIDENT.
