BLOME~ VICE CHAIRMAN O'CONNOR, MR. MCCLEARY, BOARD ATTORNEY GORE, CHAIRMAN LEWIS. ALSO PRESENT: TOM PALMER, CITY ATTORNEY, ROGER CLOUTIER, BUILDING OFFICIAL, VICE MAYOR ROTH. MOTION BY MR. MCCLEARY, SECONDED BY VICE CHAIRMAN O'CONNOR TO APPROVE THE MINUTES OF 3/12/86. CARRIED. MR. GRAY, MEMBER OF THE BOARD WAS SITTING IN THE AUDIENCE DUE TO THE EXPIRATION OF HIS TERM - 3/9/86. A LETTER APPOINTING HIM TO FILL THE UNEXPIRED TERM OF MR. POPOW HAD NO START OR STOP DATE ON IT. CHAIRMAN LEWIS ASKED VICE MAYOR ROTH TO CHECK TO SEE THE LENGTH OF TERM MR. GRAY WAS APPOINTED FOR. IF THE TERM HAS EXPIRED, HE WILL HAVE TO WRITE A LETTER TO THE CITY COUNCIL REQUESTING TO BE RE- APPOINTED. OLD BUSINESS: CASE NO. 86-6 - JUDSON ATTORNEY PALMER AND CHIEF NAPPI LOOKED AT THE SITUATION AND BECAUSE THE VEHICLE WAS BEHIND A FENCE AND HARD TO SEE DECIDED NOT TO PROCECUTE THE CASE. MOTION BY MR. MCCLEARY, SECONDED BY MR. BLOME TO CLOSE CASE NO. 86-6. CARRIED. NEW BUSINESS: CASE NO. 86-8 ~ KREJCI AS EARLIER STATED BY ATTORNEY PALMER, THE CAR WAS BEING REMOVED FROM THE PROPERTY UNDER ITS OWN POWER. MOTION BY MR. BLOME, SECONDED BY MR. MCCLEARY TO CLOSE CASE NO. 86-8. CARRIED. OLD BUSINESS continued: MR. CLOUTIER TOLD THE BOARD MRS. NAPPI WAS BEING TRANSFERRED TO THE BUILDING DEPARTMENT AND WOULD BE HANDLING BOTH THE CODE ENFORCEMENT AND CONSTRUCTION BOARDS AND THAT HE WOULD HANDLE ALL OF THE COMPLAINTS FOR THE CODE ENFORCEMENT BOARD. BOARD ATTORNEY REQUEST AND REPORTS: ATTORNEY GORE PRESENTED THE CERTIFCATION OF FINES ON ELLIOTT KEPLER AND EVERETT TAYLOR AND ASKED IF THE BOARD WANTED TO REVIEW THESE AND ANY OTHERS BEFORE THEY ARE SENT OUT. CHAIRMAN LEWIS STATED HE FELT THE BOARD SHOULD REVIEW THE FINAL ORDER IMPOSING FINES. ATTORNEY GORE THE BOARD THE FINE FOR MR. KEPLER WAS $2900. AND THAT THERE HAD BEEN ALOT OF PROBLEMS. MR. TAYLOR'S FINE IS ALMOST $2475., A MATTER OF NOT MOVING A BOAT. CODE ENFORCEMENT BOARD - APRIL 9, 1986 - 2:00 P.M. ATTORNEY GORE NOTED THIS IS THE FIRST TIME THE BOARD HAS EVER IMPOSED A CERTIFICATION OF FINE TO BE RECORDED AND THAT HE WOULD NEED A LEGAL DESCRIPTION. A LENGTHY DISCUSSION FOLLOWED. ATTORNEY GORE INFORMED T~E~..~HAD BEEN RETAINED BY THE CITY OF FELLSMERE AS ATTORNEY FOR THEIR CODE ENFORCEMENT BOARD AND WOULD SEND THEM A COPY OF OUR RULES AND REGULATIONS. THE FACT THAT NO BOARD MEMBER SHOULD MAKE A COMPLAINT WAS DISCUSSED. ATTORNEY PALMER SAID IT WOULD BE A COMPROMISING VOTE. CASE NO. 85-5 - KEPLER MOTION BY VICE CHAIRMAN O'CONNOR, SECONDED BY MR. BLOME TO ACCEPT CERTIFICATION OF FINE WITH THE ADDITIONAL LEGAL DESCRIPTION NECESSARY. ROLL CALL: AYES: MR. FLOYD MR. BLOME VICE CHAIRMAN O'CONNOR MR. MCCLEARY CHAIRMAN LEWIS NAYS: NONE CARRIED. CASE NO. 85-12 - TAYLOR MOTION BY VICE CHAIRMAN O'CONNOR, SECONDED BY MR. BLOME TO ACCEPT CERTIFICATION OF FINE WITH THE ADDITIONAL LEGAL DESCRIPTION NECESSARY. ROLL CALL: AYES: MR. FLOYD MR. BLOME VICE CHAIRMAN O'CONNOR MR. MCCLEARY CHAIRMAN LEWIS NAYS: NONE CARRIED. CASE NO. 86-7 - VORRATH IT WAS QUESTIONED AS TO WHETHER OR NOT THIS CASE HAD BEEN CLOSED. THE BOARD WAS INFORMED THAT THE TURKEYS ARE STILL THERE. A FOLLOW UP WAS ASKED FOR. MEETING ADJOURNED AT 2:45 P.M. MEETING OF THE CODE ENFORCEMENT BOARD APRIL 9, 1986 - 2:00 P.M.
