VICKERS VICE CHAIRMAN FISCHER MR. GRAY MR. MCCOOL MR. LINDSEY ATTORNEY LULICH CHAIRMAN DEROBERTIS ALSO PRESENT: BRUCE COOPER, BUILDING OFFICIAL; BOB NICHOLSON, CODE ENFORCEMENT OFFICER; RICHARD TORPY, ACTING ASSISTANT CITY ATTORNEY. CHAIRMAN DEROBERTIS THANKED MR. GRAY AND MR. MCCOOL FOR SITTING ON THE BOARD UNTIL NEW MEMBERS COULD BE APPOINTED. APPROVAL OF MINUTES= MOTION BY MR. VICKERS, SECONDED BY MR. GRAY TO APPROVE THE MINUTES OF MEETING HELD 3/15/89 AS WRITTEN. CARRIED. OLD BUSINESS: CASE NO. 87-528 - BREVARD ROOFING, INC. ATTORNEY LULICH SWORE IN MR. COOPER. MR. HENRY TOLIVERT, BREVARD ROOFING, iNC. WAS NOT PRESENT AT THE MEETING. MR. COOPER NOTED THAT MR. TOLIVERT WAS iN VIOLATION OF ART. VII, SEC. 7-20, 7-90 - NO PERMIT PULLED FOR WORK AT 534 SW LAKE DR. AND FAILURE TO OBTAIN A CONTRACTOR LICENSE. MR. COOPER RECOMMENDED THAT A FINE OF $250.00 BE IMPOSED AND THE CASE BE CLOSED. MR. COOPER ALSO TOLD THE BOARD THAT HE WOULD BE FILING A COMPLAINT AGAINST MR. TOLIVERT WITH DPR. MOTION BY MR. LINDSEY, SECONDED BY VICE CHAIRMAN FISCHER THAT IN CASE NO. 87-528 - BREVARD ROOFING, INC. THAT A FINE BE IMPOSED FROM 5/11/89 THROUGH 5/17/89 AT $25.00 A DAY FOR A TOTAL OF $150.00. CARRIED. PAGE CODE ENFORCEMENT BOARD - REGULAR MEETING - 5/17/89 OLD BUSINESS cont. CASE NO. 86-89 - KIGHT ATTORNEY LULICH SWORE IN MR. KIGHT. MR. KIGHT HAD REQUESTED TO SPEAK TO THE BOARD AND GIVE A BRIEF RUN-DOWN OF THE CASE. ATTORNEY TORPY ADVISED MR. KIGHT THAT A FINE HAD BEEN IMPOSED ll/28/86 OF $25.00 A DAY. ON 3/24/87 A LIEN HAD BEEN LEVIED AGAINST HIS PROPERTY IN THE AMOUNT.OF $2,900.00. MR. KIGHT SAID HE UNDERSTOOD. NEW BUSINESS: CASE NO. 89-1400 - KIGHT ATTORNEY TORPY STATED THAT MR. KIGHT WAS IN VIOLATION OF ORD. 2OA-3.4 (D) (5) OF THE LAND DEVELOPMENT CODE. MR. COOPER SAID THAT ALL SINGLE FAMILY RESIDENCES IN THE RS- 10 ZONE REQUIRED A GARAGE OR CARPORT. A COMPLAINT WAS RECEIVED ON 1/3/89 THAT A GARAGE AT 1840 BARBER STREET HAD BEEN ENCLOSED. AT THE TIME NO PERMIT HAD BEEN PULLED FOR REMODELING. PHOTOGRAPHS TAKEN 4/14/89 WERE GIVEN TO THE BOARD FOR REVIEW. IT WAS NOTED THAT THE GARAGE WAS NOT ENCLOSED FOR THE PURPOSE OF LIVING AREA THAT ONLY THE GARAGE DOOR HAD BEEN REPLACED. MR. KIGHT EXPLAINED THAT HE HAD ORDERED A SPECIAL HINGE BUT THAT IT HAD NOT COME IN YET AND THAT HE WOULD BE USING LARGE BARN HINGES INSTEAD. MR. KIGHT APPLIED FOR AND RECEIVED A PERMIT TO REPLACE THE GARAGE DOOR ON 5/12/89. MR. COOPER RECOMMENDED THAT 14 DAYS BE GIVEN TO FIX THE GARAGE DOOR. PAGE 3 CODE ENFORCEMENT BOARD - REGULAR MEETING - 6/17/89 NEW BUSINESS cont. CASE NO. 89-1400 -KIGHT MOTION BY MR. LINDSEY, SECONDED BY VICE CHAIRMAN FISCHER THAT WITH REFERENCE TO CASE %89-1400 INVOLVING JONES EARL KIGHT, THAT THE BOARD FOUND THAT NO PERMIT HAD BEEN PULLED, THAT ORD. 20A-3.4 (D) (5) OF THE LAND DEVELOPMENT CODE REQUIRES A CARPORT OR GARAGE AND THAT THE GARAGE HAD BEEN ENCLOSED AND NO LONGER CAN BE UTILIZED FOR STORAGE OF A MOTOR VEHICLE. THE VIOLATION IN FACT DID OCCUR AND THE ALLEGED VIOLATOR COMMITTED THE VIOLATION, THAN AN 'ORDER OF ENFORCEMENT' IS WARRANTED. IF THE ORDER OF ENFORCEMENT IS NOT COMPLIED WITH BY JUNE 1, 1989, A FINE OF $25.00 PER DAY SHALL BE IMPOSED. CARRIED. THE BOARD BRIEFLY LOOKED OVER THE NEW FORMS THAT WILL BE USED BY CODE ENFORCEMENT. APPLICATION APPROVAL - BOARD MEMBERS AFTER REVIEWING THE APPLICATIONS OF JOAN KOSTENBADER AND DAMIAN GILLIAMS, THE FOLLOWING MOTIONS WERE MADE= MOTION BY MR. MCCOOL, SECONDED BY MR. VICKERS TO APPROVE THE APPLICATION OF JOAN KOSTENBADER. CARRIED. MOTION BY MR. GRAY, SECONDED BY MR. VICKERS TO APPROVE THE APPLICATION OF DAMIAN GILLIAMS AND TO RECOMMEND TO CITY COUNCIL THAT BOTH APPLICANTS BE APPOINTED TO THE CODE ENFORCEMENT BOARD. CARRIED.
