HomeMy WebLinkAbout07151987SEBASTIAN CODE ENFORCEMENT BOARD - REGULAR MEETING - JULY 15, 1987 - 2:00 P.M. MEETING WAS CALLED TO ORDER BY CHAIRMAN BLOME AT 2:00 P.M. ROLL CALL: PRESENT: MR. GRAY MR. FISCHER MR. MCCOOL ATTORNEY LULICH CHAIRMAN BLOME ABSENT: VICE CHAIRMAN O'CONNOR, EXCUSED ALSO PRESENT: BRUCE COOPER, BUILDING OFFICIAL/CODE ENFORCEMENT OFFICER, RAY THOMPSON, CODE ENFORCEMENT, TOM PALMER, CITY ATTORNEY. APPROVAL OF MINUTES: CHAIRMAN BLOME ASKED IF THERE WERE ANY ADDITIONS OR CORRECTIONS TO THE MINUTES. ATTORNEY PALMER STATED THAT THERE WAS ONE MINOR CORRECTION - PAGE TWO, FOURTH PARAGRAPH FROM THE BOTTOM, LAST WORD IS SPELLED MOOT. MOTION BY MR. MqCOOL, SECONDED BY MR. FISCHER TO APPROVE MINUTES OF 5/20/87 AS READ WITH CORRECTION. CARRIED. OLD BUSINESS: CASE NO. 87-205 - DUBUQUE MR. THOMPSON STATED THAT ALL THE REQUIREMENTS HAD BEEN MET. ATTORNEY ASKED IF HE HAD PERSONALLY INSPECTED IT. MR. THOMPSON SAID YES. MOTION BY MR. GRAY, SECONDED BY MR. MCCOOL TO CLOSE CASE NO. 87-205, DUBUQUE. CARRIED. CASE NO. 87-383 - ETIENNE ATTORNEY PALMER STATED THE MINUTES REFLECTED THAT THIS CASE HAD BEEN CARRIED OVER TO THIS MEETING ON THE ASSUMPTION MRS. ETIENNE WOULD COMPLY IN REGARDS TO THE UNLICENSED VEHICLE. MR. THOMPSON TOLD THE BOARD HE CHECKED THIS A.M. AND THERE WAS STILL NO LICENSE TAGS ON THE CAR, NO BATTERY ALONG WITH OTHER PARTS REMOVED. ATTORNEY PALMER SUGGESTED THE BOARD ISSUEA LETTER GIVING HER 10 DAYS TO COMPLY OR A SET FINE WOULD COMMENCE AND THAT IT WAS UP TO HER TO NOTIFY .~R. THOMPSON SHE HAD COMPLIED. MR. THOMPSON STATED THE CAR MUST BE ROAD WORTHY AND LICENSED. ATTORNEY PALMER ADDED THAT IF NOT ROAD WORTHY, THE CAR BE REMOVED FROM THE PROPERTY. SEBASTIAN CODE ENFORCEMENT BOARD - JU~ ~. 1987 - 2:00 P.M. CASE NO. 87-383 - ETIENNE continued ATTORNEY LULICH ASKED IF A FINDING OF FACT WAS BEING MADE. ATTORNEY PALMER NOTED THAT AT THE LAST MEETING THE VIOLATION WAS NOT DISPUTED. ATTORNEY LULICH SWORE IN MR. THOMPSON. .ATTORNEY PA~ME~ ASKED MR~ THOMPSON IF HE HAD GONE OUT THIS A.M. AND INSPECTED THE ETIENNE PROPERTY AND IF IT WAS HIS OBSERVATION THERE WAS A VEHICLE ON THE PROPERTY THAT WAS NOT ROAD WORTHY OR LICENSED. MR. THOMPSON SAID YES. AFTER A BRIEF DISCUSSION, CHAIRMAN BLOME ASKED IF THE BOARD WAS READY TO MAKE A RULING. MOTION BY MR. GRAY, SECONDED BY MR. FISCHER THAT CASE NO. 87-383, AFTER A FINDING OF FACT, WAS STILL IN VIOLATION OF A JUNK OR UNLICENSED VEHICLE, AND THAT THE BOARD GIVE MRS. ETIENNE TEN (10) DAYS TO EITHER LICENSE OR RID THIS VEHICLE ON THE PROPERTY, AND IF NOT DONE, THERE BE A FINE OF $25.00 A DAY IMPOSED. ATTORNEY PALMER ASKED THE MOTION BE AMENDED TO INCLUDE NOT ONLY LICENSED BUT ROAD WORTHY AND THAT MRS. ETIENNE HAVE THE BURDEN OF ESTABLISHING COMPLIANCE AND IF NOT GIVEN AND VERIFIED FINE WILL AUTOMATICALLY COMMENCE AND THAT THE TIME WILL RUN FROM THE RECEIPT OF THE LETTER. MR. GRAY AMENDED HIS MOTION, MR. FISCHER SECONDED. ATTORNEY LULICH ASKED FOR A FINDING OF FACT THAT THE VEHICLE IS NOT ROAD WORTHY. ATTORNEY PALMER RECOMMENDED THAT THE FINDING OF FACT - THE MOTOR VEHICLE IS INCAPABLE OF LOCOMOTION UNDER ITS OWN POWER AND NOT LICENSED. ROLL CALL: AYES: MR. GRAY MR. FISCHER MR. LINDSEY MR. MCCOOL CHAIRMAN BLOME NAYS: NONE CARRIED. MOTION BY MR. GRAY, SECONDED BY MR. LINDSEY THAT THE FINDING OF FACE IN CASE NO, 87-383 BE VEHICLE NOT ROAD WORTHY OR LICENSED. CARRIED. BOARD ATTORNEY REQUESTS AND REPORTS: ATTORNEY LULICH ASKED THAT THE BOARD INSTRUCT HIM TO MEET WITH THE NEW BUIDLING OFFICIAL TO GO OVER FORMS AND PROCEDURES OF THE CODE ENFORCEMENT BOARD. THE BOARD FELT THIS WOULD BE A GOOD IDEA. SEBASTIAN CODE ENFORCEMENT ~OARD - JULY 15~ 1987 CHAIRMAN BLOME WELCOMED MR. COOPER TO THE BOARD MEETING. HE ALSO THANKED MR. GRAY FOR RECONSIDERING HIS RESIGNATION AND STAYING ON AS A BOARD MEMBER. MR. FISCHER ASKED THE STATUS ON THE CHURCH LOCATED ON BOB CIRCLE. MR. THOMPSON STATED THE BUILIDNG WAS TO BE VACATED AS OF TODAY. ATTORNEY PALMER ASKED THAT THE BUILDING BE POSTED IMMEDIATELY. HE FELT THAT IF THE BUILDING WAS SALVAGABLE THERE IS NO POINT IN TEARING IT DOWN. PUBLIC INPUT: COUNCILMAN METCALF STATED THAT IN REGARDS TO THE BUDGET HEARINGS, THE CONSUMER AFFAIRS BUDGET, AS OF RIGHT NOW, HAD BEEN APPROVED.
