HomeMy WebLinkAboutO-81-03ORDINANCE NO, O"~81-3 AN ORDINANCE AMENDING SECTIONS 9-1 AND 9-2 OF CODE OF ORDINANCES BY ELIMINATING THE REQUIREMENT OF A PETITION SIGNED BY 15 ELECTORS IN ORDER TO QUALIFY AS A CANDIDATE FOR MAYOR OR CITY COUNCIL MEMBER; PROVIDING AN EFFECTIVE DATE. THE COUNCIL OF THE CITY OF SEBASTIAN HEREBY ORDIAINS: SECTION I. That Section 9-1 of the Code of Ordinances, City of Sebastian, Florida, is hereby amended to read as follows: Sec. 9-1. Candidates -- Declaration of intent; petition; form of ballot (A) At any regular or special election held in the city for the purpose of electing the elective officers of the city, the city council shall cause to be printed upon the official ballots to be voted at said election, the name of any qualified elector who has declared an intent to be a candidate for any such office and who has filed a written oath or affirmation as provided in Sec. 4.02 of the Charter and has paid a filing fee as prescribed in Sec. 9~2. (B) In addition to the names printed upon the ballot, and whether there be any names printed upon the ballot or not, there shall be printed under each office to be voted for at the election, blank lines in number according to the number of persons who may be elected to fill that office; provided, the supervisor of elections may provide voting machines for any election. SECTION II. That Section 9-2 of the Code of Ordinances, City of Sebastian, Florida, is hereby amended to read as follows: Sec. 9-2. Same-- Filing fee; forms The city clerk shall furnish oaths as prescribed in Sec. 9-1. Each candidate shall pay a filing fee of twenty-five ($25.00) to the city clerk at the time his written acceptance is filed with the city clerk. Such filing fee shall not be refundable and shall be deposited into the general funds of the city to help defray election expenses. The oath together with the filing fee and other forms or documents required to be filed by candidates under Florida law shall be filed with the city clerk, not less than forty- five (45) days prior to the election date. SECTION III. This Ordinance shall take effect immediately upon becoming law. SECTION IV. If any section, subsection, sentence, clause, phrase or word of this ordinance is for any reason held unconstitutional, or invalid, for any reason, such ruling shall not affect the validity or constitutionality of any of the remaining portions of this ordinance.
