AN ORDINANCE AMENDING SECTION VIII OF
ORDINANCE 202, AS AMENDED, THE ZONING
ORDINANCE OF THE CITY OF SEBASTIAN BY
STATING A PURPOSE; REQUIRING A SEVENTY-
FOUR FOOT FRONT YARD ON PROPERTY
ABUTTING FELLSMERE ROAD (SR 512)
REQUIRING OPEN AREA
, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF
SEBASTIAN, AS FOLLOWS:
SECTION I.
That Section VIII of Ordinance 202 of the City
of Sebastian, the same being the Zoning Ordinance, is hereby
amended to read as follows:
Section VIII - C-1 RESTRICTED COMMERCIAL DISTRICT
A. PURPOSE;
This district is designed to provide adequate
space in appropriate and highly accessible locations suitable
for accomodating limited commercial development of iow
intensity, such as offices, financial institutions, medical
clinics, limited personal services and selected retail trade.
The principal purpose of such retail trade establishments
should be to serve the recurring household needs of the
occupants or employees of other structures within the sur-
rounding neighborhood or area as opposed to a citywide or regional
market. Such commercial uses should' be relatively small scale
and should generate only light traffic and have small employee
requirements. In addition, use of buildings and land may be
permitted for community facilities and utilities necessary to
serve the distr.ict or the general welfare of the community.
B. USES PERMITTED
in this district a building or premise may be
used only for the following Peruposes; site plan review as
provided in Section XII, is required for all uses in this
district.
C. LIMITATION OF USES:
Except for automobile parking lots, drive-in
banks, and those listed in special exceptions, all activities
of permitted uses, including sale, display, preparation,
and storage shall be conducted entirely within a completely
enclosed building.
D. SPECIAL EXCEPTIONS:
The following uses may be permitted by the
City Council after site plan approval and recommendations have
been received from the Planning and Zoning Commission:
1. Marinas with a height limit of thirty-five
C35) feet.
2. Drive-in businesses,
3. Gasoline Service staiions.
4. Child nurseries.
S. Veterinary hospitals, boarding kennels,
provided activities are carried on within sound proof, air-
conditioned buildings and no outside animal runs are permitted..
6. Crematory.
7. Lumber yards with no outside storage.
E. BUILDING HEIGHT LIMIT:
No building or structure shall exceed thirty-
five (35) feet in height.
F. FRONT YARD: Except for property fronting on
Fellsmere Road (SR-512), there shall be a front yard having a
depth of not less than ten (10) feet, measured from the street
side property line to the front line of the building. For
property fronting on Fellsmere Road (SR-512), there shall be
a front yard having a depth of not less than seventy-four
(74) feet, measured from the highway side property line to
the front line of the building.
G. REAR YARD:
O feet.

H. SIDE YARD:
1, Commercial uses - no side yard is required
except when'the lot is adjacent to a residential district
and in that event a ten {10} foot side yard is required.
2. Residential uses - ten {10} feet.
I. PARKING REGULATIONS:
Off-street parking spaces shall be provided
in accordance with the requirements for specific uses as
set forth in Section XIII of this Ordinance. Off=street
parking may be located in the front yard except that no
parking space shall be permitted within ten {10) feet of
the street side property line.
J. OPEN AREA:
Every lot in this district shall have a minimum
of fifteen percent (1S%) of the total parcel area set aside
or open landscaped area. Ail landscaped areas shall be
planted and maintained in lawn)sod or natural foliage. And
no part of any open area shall be used for driveways or
parking area.
K. REFUSE COLLECTION:
Facilities for the collection and removal of
solid wastes shall be provided.
SECTION II
All Ordinance or parts of Ordinances in conflict
herewith are specifically repealed.
SECTION III.
This Ordinance shall take effect immediately
upon becoming law.
SECTION IV.
If any section, subsection, sentence, clause,
phrase or work of this ordinance is for any reason held
unconstitutional or invalid, for any reason, such ruling shall
not affect the validity or constitutionality of any of the
