VIOLATION 0F THIS 0~RD~INANCE.
BE IT 0RDAINED BY THE ~YOR AND CITY COUNCIL 0F THE CiTY
OF SEBASTIAN, FLORIDA:
Section 1. No person, firm or corporation shall
engage in, carry on, operate or manage within the corporate
limits of the City of Sebastian, Florida, any motor court
or tourist camp or trailer park unless a city license shall
have been procured from the Tax Collector of said City
attested in the name of the City Clerk of sai& City and as
hereinafter provided. ~
Section 2. All licenses herein provided 'to be paid
shall be due and payable on the 1st day of October of each
year and no license shall be issued for any fractional portion
of a year; provided, that any license may be issued for a
new business of the type herein described and which new
business shall begin its operation on or after the first
day of April, for the period beginning on or after the 1st
day of April and expiring the 30th day of the following
September, upon payment of one-half of the annual license
fee required to be paid by this Ordinance. All licenses
provided to be issued hereby shall expire at 12:00 o'clock
midnight of September 30 next following the date of issuance
of such license.
Section G. Any license issued hereunder may be
transferred with ~he approval of the City Council of said
City when there is a bona fide sale and transfer of the business
for which a valid current license has been duly issued by
said City. Upon the payieMt~L~o said City of a t~a~er fee
of fifty cents, but such transferred license shall not be
valid for any longer than or for any other location than that
for which it was originally issued.
Section 4. The license tax to be paid to said City
for the operation of any business, as defined in Section I hereof,
and for an annual period, shall be as follows:
The annual license fee for the.operation of
a motor court shall be $10.00.
The annual license fee for the operation of a
tourist camp shall be $10.00.
The annual license fee for the operation of a
trailer park shall be ~10.00.
Where any single business combines in its operation the
operation of a motor court, a tourist camp and a trailer
park, or any two such types of business, only one annual
license fee of $10.00 shall be required under the provisions
of this Ordinance.
Section $. For the purposes of this Ordinance,
the types of business herein required to be licensed are
defined as follows:
A motor court is any business or establishment
where two or more cottages or housing units
(not including the unit occupied by the operator
thereof as his personal residence) are offered
for use to the public by the day, night or week
in return for a fee or valuable consideration
and not as a part of the operation of a hotel
business for which a city license has been duly
issued.
A trailer park, under the provisions of this
Ordinance, is any business or establishment where
facilities are offered to the general public
for a fee or valuable consideration for the parking
of more than one trailer, house car or camp car
a~ which trailer, house car or camp car is
occupied by one or more persons for living
quarters.
A tourist camp, under the provisions of this
Ordinance, is any place of business or establish-
~ent where for a fee or valuable consideration
members of the general public are permitted to camp
or park motor vehicles thereon or thereat and in
connection therewith provide for themselves,
or have provided by the owner or operator of such
establishment, living quarters of any type;
provided, that provision for such use by not to
exceed a single person or single family shall not
be deemed to be a tourist camp.
Section 8. Any person, fi rm~ or corporation engaging
in or carrying on or operating or managing any business for
which license is required under the provisions of this 0rdin~nce
without first obtaining such license and thereafter maintain-
ing a valid current license for the operation of such
business in the manner provided in this Ordinance shall, ~pon
conviction thereof, be fined by a fine of not less than
~10.00 and not more than ~100.00 or by imprisonment not
exceeding 60 days or by both such fine and imprisonment in
the discretion of the Court trying such offender. Each day's
violation of the provisions of this Ordinance shall constitute
a separate offense.
Section 7. All licenses to be issued hereunder
shall be issued in form and manner, as provided generally
by the Ordinances of said City for the issuance of city
occupational licenses.
Section 8. All Ordinances or parts of Ordinances
in conflict herewith are hereby repealed.
Section 9. This Ordinance shall be in full force and
effect i~ediately upon its passage and approval by the Mayor
or Upon its becoming an Ordinance without such approval.
I hereby certify that the foregoing Ordinance was
duly passed by the City Council of the City of Sebastian,
