An Ordinance Imposing a License Tax on the Owners or
~eepers of Dogs within the Corporate Limits of the City of
Sebastian, Florida; Requiring the Vaccination of Dogs within the
Corporate Limits of Sebastian, Florida; and Prescribing Penalties
for the Violation thereof.
Be It Ordained by the ~.~ayor and City Council of the City
of Sebastian, Florida:
Sec. 1. That on and after the first day of October, 1948,
it shall be unlawful for any person, firm or corporation to own,
Keep, maintain or harbor any dog within the limits of the City of
Sebastian, Florida, without first having obtained therefor a
license from the City Clerk of said City, which said license shall
be in force until and including the 30th day of September succeeding
its issuance.
Sec. 2. A fee of One Dollar ($1.00) shall be paid to the
City Clerk of said City for each dog so licensed, who shall keep a
record of the ownership, name, breed, color and sex of each dog so
licensed, together with such other information as may be necessary
for identifying the dog so licensed, and every dog so licensed
shall wear a metal tag bearing the name of the municipality and the
number of the license issued for said dog for the current year.
Sec. 3. lWo license shall be issued for any dog until
evidence has been produced to the City Clerk satisfactory to him,
showing that said dog has been inoculated against rabies within
a period of one (1) year prior to such application. The certifi-
cate of any person licensed to practice medicine or veterinary ~
medicine in the State of Florida may be accepted as evidence of
such inoculation.
Sec. ~. It shall be the duty of the Chief of Police or
any police officer of the City of Sebastian, Florida, or anyone
acting under their direction to take up and impound any dog that
may be found roaming or running at large within the corporate
limits of the City of Sebastian, Florida, on and after the first
day of October, 1948, without a license tag thereon, as herein pro-
vided, and all such dogs shall be impounded under this ordinance,
and it shall be the duty of the officer impounding such dog to
notify the owner of such dog, if he be known, of the impounding,
and if the owner of said dog desires to have said dog released, he
may do so by payment of One Dollar (~l.00) pound fees, plus One
Dollar ($1.00) per day for the feeding of said dog for each day
said dog has been so impounded and upon paying the regular fee for
license and inoculation of said dog.
Sec. 5. All dogs impounded under this ordinance, which
shall not be claimed within seventy-two (72) hours after being so
impounded, shall be immediately~~ by Chief of Police or
any policeman or anyone acting under their direction.
Sec. 6. Any person violating any of the provisions of
this ordinance by keeping or permitting to be kept within the cor-
porate limits of the City of Sebastian, Florida, any dog without
havin~ complied with the requirements of this ordinance, shall,
upon conviction, be fined by a fine not exceeding Five Hundred Dol-
lars ($500.00) or imprisonment not exceeding sixty (60) days, either
one or both at the discretion of the court trying the offender.
Sec. 7. All ordinances and parts of ordinances in con-.
fltct herewith are hereby repealed.
Sec. 8. This ordinance shall be in full force and effect
immediately upon its passage and approval by the Mayor, or upon its
becoming a law without such approval.
