That it shall be unlawful for the owner or person having custody or control of any female dog, or bitch, to permit any such dog to run at large within the City of Sebas- tian, Florida, while such dog, or bitch, is in heat. Section 2. The owner or person having custody or con- trol of any such dog described in Section 1 hereof shall keep such dog, or bitch, securely confined or restricted upon the premises of the owner or custodian of such dog during the period of time that such dog, or bitch, is in heat. Section 3. If any female dog, or bitch, shall be found running at large in the City of Sebastian contrary to the provisions of this Ordinance, then it shall be the duty of the Chief of Police or any police officer of the City of Sebastian, Florida, or anyone acting under their direction, to take up and impound such dog and the owner or custodian thereof shall be required to pay a fee of Two Dollars (i~2.00) as a pound fee, plus the additional sum of One Dollar (~1.00) for each twenty-' four (24) hour period that said dog shall be impounded in order to secure the release of said dog. The officer impounding such dog shall notify the owner thereof promptly upon such impounding and if such owner shall be known to the officer. If any dog so impounded shall not be claimed by the owner or custodian thereof and the fees herein provided paid within seventy-two (72) hours after such dog shall be impounded, then the Chief of Police or the police officer impounding such dog., shall be authorized to dispose of such dog. Section 4. Any person violating any of the pro- visions of this Ordinance by keeping or permitting to be kept within the corporate limits of the City of Sebastian, Florida, any dog without having complied with the requirements of this Ordinance, shall, upon convictio~, be fined by a fine not ex- ceeding Five I-iundred Dollars (~500.00) or imprisonment not ex- ceeding sixty (60) days, either one or both at the discretion of the court trying the offender. Section 5. All Ordinances and parts of Ordinances in conflict herewith are hereby repealed. Section 6. Th~s Ordinance shall be in full force and effect immediately upon its passage and approval by the Nayor, or upon its becoming a law without such approval.
