AND SIX A.M. P~LO~ING THE VIOLATIONS AND PIMNALTT~.S TItEREOF WHEREAS, it is necesaary for the protection o£ the safety, life and general welfare for the inhabitants of the City of Sebastian, Florida, that the regulations of the parking of vehicles between the hour's of two {2) A.M. and six (6) A, M., be regulated to prevent any-Personal damage to the safety, life and general welfare of the inhabitants of Sebastian, Florida. NOW THEREFORE BE IT ORDAINED BY THE CiTY COUNCIL OF THE CITY OF SEBASTIAN' FLORIDA: SECTION I DEFINITION OF WORDS AND. PIIRASES: The following words and pb_rases when used in this ordinance, shall for the purposes of this ordinance have the meaning respectfully described to them in this article. (a) VEHICLE. Every device in, upon, or by which any person or property is or may be transported or drawn upon a highway, except devices moved by huron power or used exclusively upon stationary rails or tracks. (b) POLICE OFFICER. Every officer of the municipal police department or any officer authorized to direct or regulate traffic or to make arrests for violations of traffic regulations. (c) STREETS. Any and all streets and alleyways located within the City limits of the City of Sebastian, Florida. SECTION II It shall be unlawful for any person to park a vehicle on any street within the City limits of Sebastian, Florida, between the hours of two (2) A. M, and six A, M,, of any day when in the discretion of the POlice Office,,of the City of Sebastian, said parking of vehicle interferes with the safety of the general in- habitants of the City of Sebastian, Florida. VOCIELLIr & VOC~rL~,£ v£RO r,£AC~, ~mz~A SECTION III When the parking of said vehicle interferes with the safety of the general inhabitants of the City of Sebastian, and the Police Officer has determined that. said vehicle interferes with the general welfare and safety of the inhabitants, he shall make every effort to notify the owner or driver of said vehicle, giving to the owner or driver the opportunity to remove said vehicle from said parking location. If the owner and/or driver refuses to remove said vehicle from said location after notification by the police officer, he shall be deemed in violation of this ordinance. SECTION IV If every reasonable means has been taken by the Police Officer to notify the owner and/or driver of the vehicle in violation of. this ordinance, and ii is im- possible for the Police Officer to notify said owner and/or driver, the Police Officer shall cause the vehicle to be removed from the location interfering with the safety of the general inhabitants of the City of Sehastiam -~"' SECTION V The Chief of Police of the City of. Sebastian shall make every effort to determine in what areas and what streets the parking of vehicles would interfere with the safety of the general inhabitants of the City of Sebastian, and shall, from time to time, report these areas to the City Council. The Chief of Police, with the approval of the City Council, shall from time to time, designate by proper notice the no parking of vehicles, in these areas between the hours, of two (2) A.M. and six (6} A. N[., of any day. SECTION VI Any person violating any provision of this ordinance shall be penalized by an amount not to exceed _Twen~ Five Dollars ($25.00), or by imprisonn~ent not exceeding five (5) days, or by bottL SECTION VII Any ordinance in conflict herewith are repealed.
