BE IT O~NED BY THE MAYOR ~D CiTY COUNCIL OF T~ CITY OF SEB~TiAN, FL O~ID A: SECTION 1. Before ~y building or structure of whatsoever nature shall be erected or constructed within the corporate limits of the City of Sebastian, Florida, or any addition shall be made to ~y e~sting building or structure within the corporate limits of said City, the owner or contractor or person building or responsible for building such building or structure or m~ing such addition thereto shall apply for a permit from the City of Sebastian for such erection, construction or addition. No building or structure shall be erected in said City nor any addition made to ~ e~sting building or structure in said City unless a permit therefor has been granted as provided b y this Ordin~ce and no work shall be done in connection with any such building or addition unless such permit has been granted, providing~ however, that any person may have the permission of remodeling any building or structure without a permit as long as he initial floor space is not increased. ~1 applications for such permit shall be made to the City Clerk of said City and such applications shall be signed by the applicant and shall state the location of the proposed structure, building or addition, the owner and contractor or builder thereof, the distance of said building from the street, the character of the building and the material of which the walls and roof are to be constructed, the purpose for which the building is to be used and the appro~mate cost and dimensions thereof. The person applying for the permit shall submit a blueprint of the building with the application. A permit shall be req~ for the moving or demolition of any building. Upon receipt of the application for permit the City Clerk shall refer it to the City Building Inspector and no permit shall be issued until approved by the City Building Inspector. T'he City Building Inspector shall approve or reject the application for permit within three days following the submission of application for permit by the City Clerk. The Building Permit shall be issued by the City Clerk upon such approval. The following fees shall be paid to the City for the granting of each such permit: Building Permit: Less than 1000 sq. ft. Over 1000 sq. ft. Electrical Permit: Commercial Dwelling $10.00 1V~inimum One cent per sq. ft. $ 10.00 5.00 6.0O 4.00 Plumbing Permit: Septic Tank: SECTION 2. No permit shall be granted hereunder unless the building or structure to be erected, as described in the application for permit, on any lot facing a public street or any addition to an existing building or structure, when completed pursuant to such app~cation and permit, shall compare favorably as to appearance, construction and architecture with the buildings or structures of the most favorable appearance situated within 375 feet, or the length of one full block if longer, from the building, structure or addition to be constructed under the provisions of such application and unless said building, structure or addition conforms with other neighborhood improvements within such area and with the properly intended and planned appearance of the street upon which is situated the lot on which such structure, addition or improvements are to be constructed and within the distance hereinbefore stated. SECTION 3. No permit shall be granted for the construction or erection of any building, structure or addition thereto if such building when completed will constitute, in the opinion of the City Building Inspector, or City Council, a fire hazard. SECTION 4. No perlmit shall be issued hereunder for the construction or erection of any building, structure or addition thereto unless the sanitary facilities to be provided thereby shall meet the minimum requirements of the State Sanitary Code as issued and approved by the Florida State Board of Health. SECTION 5. No permit shall be issued hereunder for the construction or erection of any building, structure or addition unless the same shall meet the minimum requirements of the ~outhc~n Building Code as amended by the City of Sebastian. The B~12'~iii~-'C°~ as amer~ded by the City of Sebastian is hereby established and adopted as the official Building Code of the City of Sebastian. A copy of the ~_.~_0_._u.~h.ern Building Code. as amended by the City of Sebastian is on file in the office of the City Clerk of the City of Sebastian and for all intents and purposes made a part of this Ordinance. SECTION 6. Any person, firm or corporation who, as ov~ner, contractor, builder or otherwise constructs, participates in constructing or authorizes or directs the constructing 'of any building, structure or addition within the City of Sebastian without having first secured a permit, as herein provided, or who begins the work of constructing, erecting any building or structure, or making any addition to an existing structure or building without having first obtained such permit, shall upon conviction thereof, be punished by a fine not exceeding $500.00 or by imprisonment not exceeding sixty days, or by both such fine and imprisonment in the discretion of the Court trying such offender. Each day of violation of this Ordinance shall be deemed a separate offense. SECTION 7. Ali Ordinances and parts of Ordinances in conflict herewith are herebf repealed, and Ordinance Chapter No. 17-A is hereby specifically repealed. SECTION 8. This Ordinance shall be in full force and effect immediately upon its passage and its approval by the Mayor or upon its beco.rning a law without such approval. No building or structure shall be erected in said City nor any addition made to an existing building or structure in said City unless a permit therefor has been granted as provided by this Ordinance and no work shall be done in connection with any such building or addition unless such permit has been granted. Upon receipt of such application for permit, the City Clerk shall refer it to the next meeting of the City Council of said City and if a meeting is not to be held/within three days after the filing of such application, then the Clerk shall notify the Mayor or Acting Mayor of said City and a special meeting of the City Council shall be called within three days next after the filing of such application and thereupon such permit shall be granted or refused by said City Council within three days next after the date on which such application is filed. the granting of each such permit: L..
