O-00-01 AN ORDINANCE OF THE CITY OF SEBASTIAN, INDIAN RIVER COUNTY, FLORIDA, AMENDING CODE OF ORDINANCES CHAPTER 2 TO ESTABLISH A CITY-WIDE TRAVEL POLICY; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABiLiTY; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, only the City Council has the authority to institute a travel policy governing elected officials and charter officers; and WHEREAS, it is desirable that any such travel policy complement and work in concert with a travel policy for general employees; and WHEREAS, most, but not all, of the provisions of the state policy on travel expenses are suitable to the City of Sebastian. NOW, THEREFORE, BE iT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SEBASTIAN, INDIAN RIVER COUNTY, FLORIDA, as follows: Section 1. That section 2-34 of the Code of Ordinances, City of Sebastian, Florida is hereby amended to read as follows: Sec. 2-34. In addition.. Shereto, council members shall be reimbursed for their actual and necessa~ travel_ e~penses in a.ccordance with section 2-78, Section 2. That the Code of Ordinances, City of Sebastian, Florida is hereby amended by adding a Chapter 2, Article IIi, Division 3, Travel Expenses, beginning with a section to be numbered 2-75, which said section shall read as follows: Sec. 2-75. Provision to sunersede state law. Section.! 12,061, Florida Statutes. shall govern travel..for the city, ~x~e~l~ for the following, orovisions: a .....Meal allowance - Class A and Class B travel, as defined in the city's travel oolicy, shall be reimbursed for meals acco.rding to the followin~ schedule: i, Breakfast $ 6.00 ii. Lunch ...... $10.00 iii~ Dinn{,r $18,00 b, ..~.er Diem - Seventy dollars ($70.,00). Section 3. That the Code qfOrdinances, City of Sebastian, Florida is hereby amended by adding a section to be numbered 2-76, which said section shall read as follows: Sec. 2-76. Generally. The city will pay the reason_able travel ~xpenses of th~. city council members, c~h~a_rter officers, and employees in connec.fion with autho_rizcd city Section 4. That the Code of Ordinances, City of Sebastian, Florida is hereby amended by adding a section to be numbered 2-77, which said section shall read as follows: Sec. 2-77. Travel authorization and reimbursement. Persons shal!~obtain authorization to travel, except for~emergencies as set forth in the tra¥~l policy, as follows: .... a City Council - Council members shall obtain a~tthorization travel prior to any travel at a regular city council meeting. Such authorization shal!be by majority vote of the council m0mbers in attendance. Appointment by the council of a member__~to be the City's representative to a committee or agency shall be deemed to Re authorigation to attend meetings of said committee or agency b, Charter Officers - Chi~rter officer~ shall obtain prior approval the city council, for any travel which is to be reimburse~l by the city. c. General~Employees - EmplQyees shall obtain prior approva[.~f their depar[ment head (if applicable] and the city manager four any trave_l..that is to~ reimbursed bv the city. Section 5. That the Code of Ordinances, City of Sebastian, Florida is hereby amended by adding a section to be numbered 2-78, which said section shall read as follows: Sec. 2-78. Travel nolicv. A travel policy shall ,.be adopted by resgJution an.d .updated from time to. time as necessarv~ All council meml;>er~, charter officers and employees shall abide hy and conform t0 the policy aod procedures adopted in the l[rovel policy. CONFLICT. All ordinances or parts of ordinances in conflict herewith Section 6. are hereby repealed. Section 7. SEVERABILITY. In the event a court of competent jurisdiction shall hold or determine that any part of this Ordinance is invalid or unconstitutional, the remainder of the Ordinance shall not be affected and it shall be presumed that the City Council of the City of Sebastian did not intend to enact such invalid or unconstitutional provision. It shall further be assumed that the City Council would have enacted the remainder of this Ordinance without said invalid or unconstitutional provision, thereby causing said remainder to remain in full force and effect. Section 8. EFFECTIVE DATE. This Ordinance shall take April 1, 2000. The foregoing Ordinance was moved for adoption by Councilmember A~x~,~ The motion was seconded by Councilmember · _ . and, upon being put to a vote, the vote was as follows: Mayor Chuck Neuberger Councilmember Joe Barczyk Councilrnember Walter Barnes Councilmember Ben A.
