HomeMy WebLinkAboutO-00-11ORDINANCE NO. 0-00- AN ORDINANCE OF THE CITY OF SEBASTIAN, INDIAN RIVER COUNTY, FLORIDA, AMENDING SECTION 20A-3.14 IN, INDUSTRIAL DISTRICT, OF THE LAND DEVELOPMENT CODE OF THE CITY OF SEBASTIAN; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City has received an application to allow a club lodge in an area zoned IN -Industrial District, which is not currently an allowed use but is recommended as an allowed use in the proposed Land Development Code modification under consideration; and WHEREAS, a public hearing was held before the Planning and Zoning Commission on April 20, 2000, and in the interest of fairness that body recommends approval of the Land Development Code amendments previously recommended for the Industrial District pending adoption of the entire modified Code; and Wlt-EREAS, the City Council upon due public hearing has considered the same and found said amendments to be in the best interest of the citizens of Sebastian; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THt; CITY OF SEBASTIAN, iNDIAN RIVER COUNTY, FLORIDA, as follows: Section 1. That section 20A-3.14 of the Land Development Code, City of Sebastian, Florida is hereby amended to read as follows: Section 20A-3.14. IN, Industrial District. INTENT~ The intent of the IN district is to ~rovide a management framework for imolementin~ Comprehensive Plan obiectives and rmlicies for limited industrial develooment on land desimnated IN on the Future La/id MaD. All develoDmenLin~he IN district shall comnlv with the Comprehensive Plan. r~erformance criteria in Chanter III. as well as other applica.b.[~. development regulations~ Salvalte yards and junkvards are deemed to generate highly extensive adverse imoacts for the urban area and shalLno~ be nermitted uses in the City limits of Sebastian. Such activities are more appropriately locattd near major regional transoortation facilities. PERMITTED USES. Utilities. In the Industrial District any use is oermitted either indoors or ou;doors, but in conformance with the armlicable t)erformance standards. The reouirement shall not aoolv to airfields for the ouLsi.de storaee of aircraft. Section 2. CONFLICT. All ordinances or parts of ordinances in conflict herewith are hereby repealed. Section 3. SEVERABILITY. In the event a court of competent jurisdiction shall determine that any part of this Ordinance is invalid or unconstitutional, the remainder of the Ordinance shall not be affected and it shall be presumed that the City Council did not intend to enact such invalid or unconstitutional provision. It shall further be assumed that the City Council would have enacted the remainder of this Ordinance without said invalid or unconstitutional provision, thereby causing said remainder to remain in full force and effect. Section 4. EFFECTIVE DATE. This Ordinance shall take effect following its adoption by the City Council. 4 ,~e foregoing Ordinance was moved for adoption by ,Cou, ncilmember f-~'~,,( .
