AN ORDINANCE OF T]ffE CITY OF SEBASTIAN, INDIAN
RIVER COUNTY, FLORII)A, REWRITING CITY CODE
CILa. PTER 20A, T]~E LAND DEVELOPMENT CODE;
PROVIDING FOR CONFLICTS; PROVIDING FOR
SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE
DATE.
WltEREAS, pursuant to Florida Statutes every municipality is required to adopt land
development regulations consistent with and in implementation of comprehensive Growth
Management Plan updates very five years; and
WItEREAS, the City of Sebastian adopted such updates to its Comprehensive Plan in
January 1999; and
WI:IEREAS, the City Council has determined that the required adoption of such land
development regulations is an opportune time to revise the Land Development Code; and
WItEREAS, the City Council upon due public hearing has considered the proposed
revised Land Development Code and found it to be in the best interest of the citizens of
Sebastian;
NOW, TItEREFORE, BE IT ORDAINED BY ~ CITY COUNCIL OF ~
CITY OF SEBASTIAN, INDIAN R/VER COUNTY, FLORIDA, as follows:
Section 1. That Chapter 20A, The Land Development Code, referenced as
Chapter 54 of the Code of Ordinances of the City of Sebastian, is hereby supplanted,
amended, and revised as to read as set forth in Exhibit "A" attached hereto.
Section 2. CONFLICT. All ordinances or parts of ordinances in conflict
herewith are hereby repealed.
Section 3. SEVERABILITY. In the event a court of competent jurisdiction
shall determine that any part of this Ordinance is invalid or unconstitutional, the remainder of
the Ordinance shall not be affected and it shall be presumed that the City Council did not
intend to enact such invalid or unconstitutional provision. It shall further be assumed that the
City Council would have enacted the remainder of this Ordinance without said invalid or
unconstitutional provision, thereby causing said remainder to remain in full force and effect.
Section 4. EFFECTIVE DATE. This Ordinance shall take effect following its
adoption by the City Council, however, all active applications for matters regulated under the
previous Land Development Code pending as of May 24, 2000, shall be processed to
completion in accordance with the pre-existing land development regulation provisions.
