HomeMy WebLinkAboutORD #202-6 - e -~'e \. r\' lJr. 1,(J-t- Rr:-/.I /) /) 'Ill ORDINANCE NO.~O~- 6_ I ~ AN ORDINANCE AMENDING SECTION XIII(F)(2) OF ORDINANCE 202, AS AMENDED, OF THE CITY OF SEBASTIAN, THE SAME BEING THE ZONING ORDINANCE OF THE CITY, BY ALLOWING POROUS PARKING SURFACES UNDER CERTAIN CONDITIONS, SETTING FORTH APPLICATION REQUIREMENTS AND PROCEDURES; PROVIDING A SEVERABILITY CLAUSE AND AN EFFECTIVE DATE. THE COUNCIL OF THE CITY OF SEBASTIAN, FLORIDA, HEREBY ORDAINS: SECTION I. That Section XIII(F) (2) of Ordinance 202~ as amended, of the City of Sebastian, Florida, the same being the Zoning Ordinance of the City, is hereby amended to read as follows: SECTION XIII - OFF-STREET PARKING AND LOADING REGULATIONS F. Design Standards: 2. Surfacing Requirements for Parking and Loading Spaces. In all zoning districts, surfacing of all off-street parking areas and drives, except within RS zoning districts having single family uses exclusively, shall be as follows: 1. Nonporous Surfaces. All parking areas and approaches thereto shall require a minimum sur- facing material of four (4) inches reinforced concrete, or six (6) inches of lime rock, after compaction or a comparable material with one (1) inch minimum asphaltic topping except as other provided herein. 2. Porous Surfaces. The use of porous parking surfaces suitable for use on specific sites within the City of Sebastian and so demonstrated by the land owner or his designated agent may be approved by the Planning and Zoning Commission upon recommendation of the City Engineer, as an alternative to the surface requirements of sub- section (1) above, subject to the following requirements. The consideration, approval and use of porous paving shall be limited to places of worship, establishments which have parking needs not on a daily basis, business endeavors uSIng valet parking, or sites located east of Indian River Drive. e e . a. Ap lication Re uirements and Su ortive In. ormation. In addition to other re- quirements of this Chapter, the application for site plan approval which incorporates the use of porous parking or loading surfaces shall include the following information and/or requirements which shall be certified by a Florida registered engineer. (1) A cross section of the structual section to be used on the parking area certified as appropriate based on natural characteristics of the site, traffic generating characteristics, anticipated surface water run-off, and durability and porosity of proposed surface. (2) Detailed drainage plan with run-off and percolation calculations. (3) Percolation tests in appropriate areas and location of tests on site to describe any varied soil permability conditions present on site. (4) Location of ground water, date of soil boring(s) and estimated location of the ground water table during wettest season. (5) Soil logs and description of existing soils on parking area to a depth of five (5) feet below the bottom of the structural section or to the water table. (6) Description of the traffic generating characteristics of the site including frequency of use, turnover, and type of vehicles using surface. (7) Test profile of proposed construction material including soil density, stability of materials and water absorption. The load bearing capacity of the proposed im- proved surface shall not be less than fifty (50) pounds per square inch Florida bearing capacity or its equivalent for a depth of not less than eight (8) inches. (8) Maintenance program shall be submitted as a written statement and shall be directed toward achieving and maintainig orderly and neat appearance of grassed areas in perpetuity. Such program shall legally bind the applicant and successors in owner- ship to the continued maintenance of such areas including replacement of dead or unsightly sod or other plant material as well as the repair of surface damage or clogging of subsurface base. This legal instrument shall be submitted in a form which shall be approved by the City Attorney prior to receipt of any City approval of the project. b. Surface Types. Porous surfaces shall be of the following types as approved by the Planning and Zoning Commission: -2- ,e e . ()) Commercially marketed porous parking blocks, or other types of porous pavement may be approved by the Planning and Zoning Commission following favorable recommendation by the City Engineer. (2) For places of worship or other land uses generating highly infrequent traffic, as determined by the City Engineer, sod may be placed on a stable sub-grade, upon approval by the Planning and Zoning Commission. Such approval shall be granted only for projects generating very limited traffic. Similarly, such approval shall be conditioned on stipulated traffic generation rates specified in the application. Subsequent change in traffic generation shall constitute grounds by which the City Engineer may request review by the Planning and Zoning Commission in order to determine if the increased traffic generation rates warrant improve- ments to the parking surface. c. Continuing Maintenance. A continuing maintenance program shall be required to be carried out by the land owner in all cases where a porous surface is approved by the Planning and Zoning Commission. Such maintenance program shall include maintenance provision cited in Section 20A-8.5 (E)(2)(a)(8). Violation of such maintenance program shall be subject to penalties as provided in Section 20A-l.lO of this Code. d. Procedure and Review. Proposals for use of a porous surface shall be reviewed in accord with the site plan review procedures described in Article X of this Code. The City Engineer shall provide detailed comments concerning such proposals to the Planning and Zoning Commission prior to consideration by the Board. SECTION II. If any section, subsection, sentence, clause, phrase or word of this ordinance is for any reason held unconstitutional or invalid, for any reason, such ruling shall not affect the validity or constitutionality of any of the remaining portions of this ordinance. SECTION III.
