HomeMy WebLinkAboutO-77-02AORDINANCE NO. 0-77-2A AN ORDINANCE AMENDING ORDINANCE NO. 0-77-2 OF THE CITY OF SEBASTIAN, THE RULF~ AND REGULATIONS FOR THE MUNICIPAL CEMETERY; PROVIDING AN EFFEL~ DATE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SEBASTIAN, FLORIDA, as follows: 1. The following rules and regulations are herewith established for the municipal cemetery of the City of Sebastian. (1) ~ne cemetery shall be open daily from 8:00 a.m. until 6 p.m. (2) All graves must be located by Sexton or person in charge (City Clerk). (3) (4) The vault company and/or contractor exercise care to protect all grave markers, monuments, shall be held liable for any damage incurred. as required. Graves must be at least five feet deep at lowest point. (grave digger) shall sprinklers, etc., and (5) The cemetery sexton or person in charge shall keep records (6) The vault company and/or contractor (grave digger) shall remove all dirt from adjacent grave markers, mont~nents, etc. as he completes closing of grave sites. Surplus dirt shall be hauled to spoil site as designated by sexton or person in charge. (7) The vault company and/or contractor (grave digger) shall exercise care in driving his vehicle from cemetery roads onto platted lots to haul fill and/or vault. Adequate protection by use of timbers, plywood and other approved devices shall be provided to adjacent grave sites. Vehicle shall remain in low gear while on platted grave sites and proceed slowly in and out to roadway. (8) The vault company and/or contractor (grave digger) shall remove his tent as soon as practicable after completion of cere~Dny and closing of grave site. (9) The vault company and/or contractor (grave digger) shall notify the City Clerk or other official of any problem that may be encountered. (10) The vault company and/or contractor (grave digger) shall be given a copy of this ordinance and be guided by all requirements therein. (11) The cemetery sexton or person in charge shall inspect and approve excavations and closing by vault company and/or contractor (grave digger) . (12) The cemetery sexton or person in charge shall not accept gratuities frc~ anyone. Any service that can be performed will be performed for all. (13) Lots or grave sites shall be used only for the burial of the human dead. Only one interment shall be made in a grave site except in the case of the follc~ing: a mother and infant; two children in one ooffin; one interment and one cremation; or two cremains. Two markers for this type burial will be permitted, provided they are placed side by side. No burials in vaults above ground shall be permitted, except (14) in a mausolea. (15) All interments in the cemetery shall be required to have a eoncrete vault or other permanent type grave liner installed before burial. All cremains must be placed in a suitable permanent type container. (16) All cemetery plat markers shall be either bronze, marble, or granite, and shall be flush with the ground. No permanent attachments shall be above the marker. No slabs of any kind will be permitted, ho~mver, to preserve the historic nature of unit 1 :of the sebastian cemetery, and where there are existing slabs and above ground markers, restoration of existing slabs and above ground markers will be permitted. Additional slabs and above ground markers will be permitted i n Unit 1 only where there are existing slabs and above ground markers and within the same family plot with the existing ones and with the approval of the Cemetery COnTnittee. (17) Before any markers shall be installed, a plan shall be presented for approval to the City Clerk' at the Sebastian City Hall. (18) All markers should have a concrete base - a minimum of 4" for a single stone and 6" or more for a double or larger stone. 2 (19) All such markers shall be installed within four months (120) days after burial. Where this regulation renders a hardship, or presents any special problems, i.e., an estate not settled, etc., special consideration will be given. Request for special consideration should be made in writing to the Chairman, Cemetery Cc~nit~, City Hall, P.O. Box 127, Sebastian, Florida 32958. (20) All markers shall be in a line consistent with each other. (21) Whenever a living memorial tree or shrub is desired, arrangements can be made with the City Clerk as to size, type and placement as designated by the Cemetery Committee. (22) No trees, plants or shrubs shall be planted, prUned, or removed except by the sexton or person in charge who shall have authority to do so upon any grave site when he may consider such a course necessary. (23) Enclosures of any nature such as fences, copings, hedges, ditches, etc. shall not be allc~ed around any grave sites. Grave mounds will not be permitted. (24) Artificial flc~er arrangements will be permitted to remain until they become faded or unsightly. Fresh flowers will remain until un- sightly. (25) No work of any kind may be done on grave sites unless approved by the Cemetery Con~ittee PRIOR to starting such work or installing markers. (26) No grave site owners shall allow interments on their grave sites for remuneration, nor shall any transfer of interest therein be valid except by written consent of the City of Sebastian. No lots shall be bought or sold for speculation. (27) An easement is reserved along all grave site lines for water, sprinkler system, etc. (28) Pauper grave sites and permanent markers for paupers may be permitted with authority of the Cemetery Cc~nittee. (29) No Sunday interments shall be permitted. (30) A fee of $10.00 per hour, or any portion thereof, shall be charged when a grave is opened or closed at any time other than during the r~gular work week. 2. A violation of any of the above rules and regulations shall be considered a violation of the ordinances of the City of Sebastian, and any person, business or corporation adjudicated in violation of said rUles and regulations shall, in addition to any penalty imposed by court not exceeding $500.00 fine and/or not exceeding 90 days i~priso~t, be denied the right to do further business in the cemetery of the City of Sebastian. 3. All prior cemetery ordinances and all other ordinances, or parts of ordinances in conflict with the above provisions are hereby rescinded. 4. This ordinance shall become effective immediately upon its passage.
