A RESOLUTION OF THE' CITY OF SEBASTIAN, INDIAN RIVER
COUNTY, FLORIDA, DESIGNATING THE COMMUNITY
DEVELOPMENT DEPARTMENT AS THE ADMINISTRATIVE
AUTHORITY TO RECEIVE, REVIEW AND PROCESS FINAL PLATS OR
REPLAT SUBMITTALS; DESIGNATING THE CITY MANAGER OR
DESIGNEE AS THE ADMINISTRATIVE OFFICIAL RESPONSIBLE FOR
APPROVING, APPROVING WITH CONDITIONS, OR DENYING A
PROPOSED PLAT OR REPLAT; AND GRANTING AUTHORITY TO
ACCEPT DEDICATIONS MADE VIA PLAT IN ACCORDANCE WITH
FLORIDA STATUTE §177.071; PROVIDING FOR CONFLICTS,
SCRIVENERS ERRORS, AND PROVIDING FOR EFFECTIVE DATE.
WHEREAS, Article XIX, Land Development Code of Sebastian, Florida, sets forth the
current process for receiving, reviewing and approving final plats and replats, pursuant to Chapter
177 of the Florida Statutes; and
WHEREAS, currently, the Sebastian City Council approves all plats and replats within
the City of Sebastian's jurisdictional boundaries; and
WHEREAS, on June 20, 2025, an amendment to § 177.071, Florida Statutes, was signed
into law by Governor DeSantis with an effective date of July 1, 2025; and
WHEREAS, § 177.071, Florida Statutes, as amended, removes the authority of local
governing bodies to approve final plats and replats and places the approval of same in the hands
of an administrative authority designated by the local governing body; and
WHEREAS, §177.071, Florida Statutes, as amended, also calls for the local governing
body to designate an administrative authority to receive, review, and process plats and replats; and
WHEREAS, to comply with the amended § 177.071, Florida Statutes, the Sebastian City
Council hereby officially designates the Community Development Department as the
administrative authority to receive, review, and process plat and replat submittals; and
WHEREAS, §177.071, Florida Statutes, as amended, also calls for the local governing
body to designate an administrative officer to be responsible for approving, approving with
conditions or denying a proposed final plat or replat; and
WHEREAS, to comply with amended § 177.071, Florida Statutes, the City Manager or
designee shall be designated as the administrative officer.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF SEBASTIAN, INDIAN RIVER COUNTY, FLORIDA, THAT:
SECTION 1: ADOPTION OF RECITALS. The recitals contained in the Whereas Clauses
above are hereby adopted as the true and correct legislative intent of the Sebastian City Council.
SECTION 2. DESIGNATION. The Community Development Department is hereby designated
as the administrative authority pursuant §177.071, Florida Statutes and the City Manager or
designee is designated as the administrative official responsible for approving, approving with
conditions, or denying a final plat or replat.
SECTION 3. CONFLICTS. All Resolutions or parts of Resolutions in conflict herewith are
repealed.
SECTION 4. SCRIVENER'S ERRORS. Sections of this resolution may be renumbered or re -
lettered and corrections of typographical errors which do not affect the intent may be authorized
by the City Manager, or the City Manager's designee, without need of further action of the City
Council by filing a corrected copy of same with the City Clerk.
SECTION 5. EFFECTIVE DATE. This Resolution shall take effect upon its adoption.
The foregoing Resolution was passed for adoption by Council Member McPartlan , was
seconded by Council Member �Tnnaa and upon being put to a vote, the vote was as
follows:

The Mayor thereupon declared this Resolution duly passed and adopted this 25thday of
February 2026.
