HomeMy WebLinkAboutO-80-18 ORDINANCE NO, O~O-t~l~ AN ORDINANCE CREATING ARTICLE III OF CHAPTER 27 OF THE CODE OF ORDINANCES PROHIBITING THE USE OF INDIVIDUAL WATER OR SEWAGE DISPOSAL SYSTEMS AND/OR SEPTIC TANKS IF A CENTRAL WATER TRANSMISSION AND DISTRIBUTION SYSTEM OR SEWAGE TRANSMISSION AND COLLECTION SYSTEM IS AVAILABLE WITHIN THE CITY; PROVIDING FOR NOTIFICATION PROCEDURE; PROVIDING FOR MANDATORY WATER CONNECTIONS AND SEWER CONNECTIONS; PROVIDING FOR PENALTIES FOR THE VIOLATION OF SUCH PROVISIONS; PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED by the City Counci. 1 of the City of Sebastian, Flor:ida, as follows: SECTION I. That the Code of Ordinances, City of Sebastian, Florida, is hereby amended by adding an Article to Chapter 27 to be numbered Article III, Sections 27-40 through 27-44 which Article reads as follows: ARTICLE III. WATER AND SEWER HOOK-UPS Sec. 27-40. Prohibition - sewage. The use of indi- vidual sewage disposal systems and/or septic tanks, grease traps and dry wells by any person in the area where central sewage collection service is available is hereby prohibited. Sec. 27-41. Prohibition - water. The use of individual water systems, other than for irrigation purposes, by any person in the area where water dis- tribution service is available is hereby prohibited. Sec. 27-42. Connection required. Ail persons owning improved property fronting on a street wherein either sewer collection service or water distribution service is available shall connect the improvements upon such premises to the central system within 60 days of noti- fication by the city that such a system is available. Sec. 27-43. Notice; time for compliance. Ail entities providing central water and/or sewer service to residents within the city, shall notify both the city and the individual residents in writing when such a system becomes available. Upon receipt of said notification the city shall notify all residents fronting on streets wherein such water distribution and sewer collection service shall become available and shall give said persons 60 days from said notification to connect to the system. Sec. 27-44. Penalties. Any person convicted of violating this section, by failure to connect to the system after having received proper notification thereof, shall be punished by a fine of up to Five Hundred Dollars ($500.00). Each day suah a condition exists s~all be considered a separate violation. SECTION II. This Ordinance shall become effective immediately upon its passage. SECTION III. If any section, sub-section, sentence, clause, phrase, or portion of this ordinance is for any reason held invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a separate, distinct and independent provision and such holding shall not affect t~e validity of the remaining portions hereof.
