AN ORDINANCE CORRECTING THE LEGAL
DESCRIPTION IN ORD. No, 0-81-15 ANNEXING
A TRACT OF LAND LYING I'N SECTION 28 OF
THE FLEMING GRANT TOWNSHIP 31 SOUTH,
RANGE 38 EAST. SAID LAND LYING WEST
OF ROSELAND ROAD (SR S05) AND RUNNING
TO THE SHORES OF THE SEBASTIAN RIVER;
CONTAINING 15.7 ACRES, MORE OR LESS.
WHEREAS, the sole owners of that certain parcel
of property described hereinafter did petition the
City of Sebastian to voluntarily annex this property; and
WHEREAS, the City Council found and determined
that the petition bore the signatures' of all owners of
property in the area proposed to be annexed; and
WHEREAS, the City Council found and determined
that the area proposed to be annexed was contiguous to
the City of Sebastian, and would not result in the creation
of an enclave; and
WHEREAS, the City Council found and determined
that the area proposed to be annexed constitutes a reasonably
compact addition to the incorporated territory of the City
of Sebastian; and
WHEREAS, the City Council found and determined
that the annexation of said property was in the best interests
of the City of Sebastian; 'and
WHEREAS, Ordinance no. 0-81-15 as originally
adopted on August 10, 1981, and recorded in the public
records on August 17, 1981, contained a typographical
error in the range number of the legal description of
said property; and
WHEREAS, the City Council hereby determines that
the following described property is the correct legal
description of the property annexed the City of Sebastian
on August 10, 1981 by Ordinance No. 0-81-15.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL
OF THE CITY OF SEBASTIAN, FLORIDA, AS FOLLOWS:
SECTION I.
That the following described property, now lying
and being in the unincorporated area of Indian River County,
Florida, is hereby annexed to the City of Sebastian,
Florida, and the boundary lines of said City are hereby
redefined to include said property, which is described as
follows:
All that certain parcel of land lying in Section
28 of the Fleming Grant Township 31 South, Range
38E, more particularly described as follows:
More fully described in Schedule "A"' attached.
SECTION II.
This Ordinance shall take effect immediately
upon becoming law, and said property shall be subject to
all laws, ordinances and resolutions now in force, or here-
after adopted, by the City of Sebastian, in accordance
with Florida law.
SECTION Ill.
A copy of this Ordinance shall be filed with the
Clerk of the Circuit Court of Indian River County and the
Florida Department of State.
I HEREBY CERTIFY that the foregoing Ordinance
was finally approved and passed by the City Council of
