AN ORDINANCE AMENDING SECTION 14-2 OF THE
CODE OF ORDINANCES BY PROVIDING FOR TWO-
YEAR OCCUPATIONAL LICENSES; AMENDING SECTION
14-10 OF THE CODE OF ORDINANCES BY SETTING
DELINQUENCY DATE OF LICENSES TO BE ON OCTOBER
FIRST OF ODD NUMBERED YEARS; INCREASING
DELINQUENCY PENALTY TO $100.00; INCREASING OPERATING
BUSINESS WITHOUT LICENSE PENALTY TO $100.00; PRO-
VIDING A SEVERABILITY CLAUSE; PROVIDING AN EFFECTIVE
DATE.
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF
SEBASTIAN, FLORIDA., AS FOLLOWS:
SECTION I.
That Section 14-2 of the Code of Ordinances, City
of Sebastian, Florida, is hereby amended to read as follows:
Section 14-2. Two Year Term; One year licenses.
All licenses shall be due and payable on the first day
of October of each odd numbered year, and no license shall
be issued for any fractional portion thereof; except, that
any license may be issued after the first day of October
of each even numbered year, upon payment of one-half of the
two-year license fee required to be paid by this Chapter.
SECTION II.
That Section 14-10 of the Code of Ordinances, City
of Sebastian, Florida, is hereby amended to read as follows:
Section 14-10. Delinquency; penalties.
(a) All licenses shall be sold by the
City Clerk beginning September first of each odd numbered year
and shall be due and payable on October first of said year
and expire on September thirtieth of the next odd numbered
year. Those licenses not renewed by October first shall be
considered delinquent and subject to a delinquency penalty
of ten (10%) percent for the month of October, plus an
additional five (5%) percent penalty for each month of
delinquency thereafter until paid. However, the total
delinquency penalty shall not exceed fifty (50%) percent of the
occupational license fee for the delinquent establishment
or One Hundred ($100.00) Dollars, whichever is greater.
(b) Any person engaging in or managing
any business, occupation or profession,without first obtaining
a local occupational license, if required hereunder, shall
be subject to a penalty of One Hundred ($100.00) Dollars,
in addition to any other penalty provided by the Code.
(c) For the year 1981 only, those licenses
not renewed by November first shall be considered delinquent
and subject to the delinquency penalty provided in (a) above.
SECTION III.
Ail Ordinance or parts of Ordinances in conflict
herewith are specifically repealed.
SECTION iV.
This Ordinance shall take effect immediately upon
becoming law.
SECTION V.
If any section, subsection, sentence, clause, phrase
or word of this ordinance is for any reason held unconstitutonal
or invalid, for any reason, such ruling shall not affect the
validity or constitutionality of any of the remaining portions
of this ordinance.
I HEREBY CERTIFY that the foregoing Ordinance was
finally passed by the City Council of the City of Sebastian,
