AN ORDINANCE AMENDING SEC. 7-92 OF THE CODE
OF ORDINANCES BY PROVIDING FOR REIMBURSEMENT
OF EXPENSES FOR MEMBERS OF CONSTRUCTION
BOARD; CREATING SEC. 7-92.1 OF THE CODE BY
PROVIDING FOR ADMINISTRATION TO ASSIST CON-
STRUCTION BOARD; CREATING SEC. ?-92.2 OF THE
CODE SETTING FORTH POWERS AND DUTIES OF
CONSTRUCTION BOARD; AMENDING SEC. 7-100 OF THE
CODE BY ADDING PROVISIONS FOR REVOCATIONS OR
SUSPENSION OF CONTRACTORS CERTIFICATES;
STATING A SEVERABILITY CLAUSE; PROVIDING AN
EFFECTIVE DATE.
WHEREAS, the Construction Board of the City of
Sebastian has recommended that certain provisions of
Article VII of the Code of Ordinances pertaining to Con-
tractors be created and amended so as to better clarify
the intent and purpose of this Article:
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF
THE CITY OF SEBASTIAN, FLORIDA as follows: SECTION I.
That section 7-92 of the Code of Ordinances,
City of Sebastian, Florida, is hereby amended by adding a
subsection, to be numbered 7-92(j), which said subsection
shall read as follows:
Section 7-92. Construction Board.
(j) Members of the board shall receive no salary
or compensation for attendance at meetings, but may be
reimbursed for their actual expenses incurred in the
performance of their duties in accordance with procedures
established by resolution of the City' Council.
SECTION 'II.
That the Code of Ordinances, City of Sebastian,
Florida, is hereby amended by adding a section, to be numbered
7-92.1, which said section shall read as follows: "Section 7-92.1. Administration.
In order to carry out the intent of this chapter,
the City Council hereby appoints the following officials
to assist the Board in performing its duties:
(a) Building Official. The building official,
or his authorized representative, shall have the primary duty
of enforcing the various codes and initiating disciplinary
proceedings before the Board, and shall make such recommenda-
tions or reports to the Board as needed on each matter
considered by it.
(b) Clerk. The Mayor shall appoint a City employee
to be the Board Clerk. The Clerk shall record all meetings of
the Board and shall prepare minutes of each meeting, which
minutes shall state all motions, the vote of each member
upon each question or motion or indicate if a member were
absent or failed to vote. Such minutes may be in a summary
or outline form, so long as they accurately reflect the
deliberations of the Board. The Clerk shall perform such other
functions assigned to the Clerk by the Board.
(c) Legal Counsel. The City Attorney shall advise
and be counsel to the Board. The legal counsel shall be
compensated as provided by the City Council.
SECTION III.
That the Code of Ordinances, City of Sebastian,
Florida, is hereby amended by adding a section, to be
numbered 7-92.2, which said section shall read as follows:
"Sec. 7-92.2. Powers and Duties.
The Construction Board shall have the following
powers and duties:
(a) Advice to the City Council.
On its own initiative or whenever requested to do
so by the City Council, to give advice to the City Council
and to other public officials or employees with reference
to any matter affecting contractors or the construction
industry within the corporate limits of the City;
(b) Reviewing City Building and Housing Codes.
To advise the City Council concerning the city building

and housing codes, their adoption, their amendment, and the
revision of the minimum state building codes or any
standard published code of technical regulation which
constitutes all or part of said codes or of this Chapter;
(c) Examination of Contractor's License Holders
and Applicants therefor.
To examine or cause to be examined holders of
contractor's licenses within the city or applicants for such
license, in accordance with the requirements of this Chapter;
(d) Licensing of Contractors
To license contractors pursuant to the requirements
of this Chapter;
(e) Review of Violations of Chapter by License Holders
On its own motion or the verified written complaint
of any person, the Board may investigate the actions of
any contractor certified under this Chapter or a state-
certified contractor and hold due process hearings; the
Board may take appropriate disciplinary action if the con-
tractor is found to be guilty of or has committed any one
or more of the acts or omissions constituting cause for
disciplinary action as set out in this Chapter.
(f) Coordinate Investigations with Other Government
Agencies.
To cooperate with other governmental agencies, local,
state and federal with reference to any matter affecting
contractors or the construction industry with the corporate
limits of the City.
SECTION IV.
That Section 7-100 of the Code of Ordinances, City
of Sebasian, Florida, is hereby amended by adding sub-
subsections, to be numbered 7-100(b) (10),(Il)and (12), which
said sub-subsections shall read as follows:
Section 7~100 Revocation or Suspension of Certificates.

(11) Giving or offering to give directly or indirectly
any city employee or board member anything of value, monetary
or otherwise, with intent to influence such employee in the
discharge of his or her duties under the provisions of this
Chapter.
(.12) Attempting or threatening to coerce or coercing
through physical attack, injury or damage to any board member
or city's employee's person, family or property, with intent
to influence such employee in the discharge of his or her duties
under the provisions of this chapter.
SECTION V,
The invalidity of any' section or provision of this
ordinance shall not invalidate other sections or provisions
thereof.
SECTIiON VI'~
Ail ordinances or parts of ordinances in conflict
herewith or inconsistent with the provisions hereof are
hereby repealed.
I HEREBY CERTIFY that the foregoing Ordinance was
finally passed by the City. Council of the City of Sebastian,

I HEREBY CERTIFY that Notice of Public Hearing of
the foregoing Ordinance was given in accordance with Section
166.041 of the Florida Statutes, that said public hearing
was held in the City Hall of the City of Sebastian, Florida,
and that the foregoing Ordinance was duly passed and adopted
by the City Council of the City of Sebastian, Florida,
