HomeMy WebLinkAboutO-81-25DORDINANCE NO. 6-o~/-~-g--~ AN ORDINANCE OF THE CITY OF SEBASTIAN, FLORIDA, AMENDING THE COMPREHENSIVE PLAN DESIGNATED FROM (COR) COMMERCIAL OFFICE RESIDENTIAL TO (CG) COMMERCIAL GENERAL FOR A PARCEL OF LAND IN GOVERNMENT LOT 3, SECTION 6, TOWNSHIP 31 SOUTH, RANGE 39 EAST, COMPRISING 16.2 ACRES, MORE OR LESS (PARCEL NO. 1); ALSO AMENDING THE COMPREHENSIVE PLAN DESIGNATED FROM LIMITED DENSITY (LD) TO (COR) COMMERCIAL OFFICE RESIDENTIAL FOR A PARCEL OF LAND BEING ALL OF BLOCKS 1 AND 2 AND THAT PORTION OF TRACT D LYING SOUTH OF MAIN STREET OF SEBASTIAN GARDENS SUBDIVISION, AS RECORDED IN PLAT BOOK 5, PAGE 58, PUBLIC RECORDS OF INDIAN RIVER COUNTY, FLORIDA, COMPRISING 7.8 ACRES, MORE OR LESS (PARCEL NO. 2); ALSO AMENDING THE COMPREHENSIVE PLAN DESIGNATION FROM COUNTY A-AGRICULTURAL TO (MD) MULTI-FAMILY FOR A PARCEL OF LAND PARTLY IN THE NORTHEAST QUARTER OF THE SOUTHEAST QUARTER OF SECTION 1, TOWNSHIP 31 SOUTH, RANGE 39 EAST, AND PARTLY IN THE NORTHWEST QUARTER OF THE SOUTHWEST QUARTER OF SECTION 6, TOWNSHIP 31 SOUTH, RANGE 39 EAST, COMPRISING 12.58 ACRES, MORE OR LESS, ALL IN INDIAN RIVER COUNTY, FLORIDA; PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE COUNCIL OF THE CITY OF SEBASTIAN FLORIDA, THAT: SECTION I Ch.a..n~ge in Comprehensive Plan Designation - Parcel No. 1 The Comprehensive Land Use Plan Designation of Commercial Office Residential (COR) is hereby changed to (CG) Commercial General for the following described parcel of land, consisting of 16.2 acres, more or less: Begin at the SW corner of Government Lot 3, Section 6, Township 31 South, Range 39 East, run North along said government lot line 309 feet; thence run N 89° 56' 51" E 250 feet; thence run North parallel to said government lot line 370 feet to the South right of way line for Main Street; thence meander the South right of way line of Main Street in a northeasterly direction to the Northeast corner of Lot 1, Block 5, Replat of School Park Subdivision as recorded in Plat Book 2, page 29, public records of Indian River County, Florida; thence run S 0° 10' 04" W a distance of 138.11 feet; thence run N 89° 56' 51" E a distance of 130 feet; thence run S 0° 10' 04" W a distance of 128.11 feet; thence run S 89° 56' 51" W a distance of 150 feet; thence run S 0° 10' 04" W a distance of 677 feet; thence run S 89° 56' 51" W a distance of 970 feet to point of beginning; LESS the 30-foot right of way for Lake Street and the 35-foot right of way for Palmetto Avenue, as shown on said Replat of School Park Subdivision; lying and being in Indian River County, Florida. Said land consisting of 16.2 acres, more or less. SECTION II Change in Comprehensive Pla.n.. D_.._e.~!.cjnation - Parcel 2 The Comprehensive Land Use Plan Designation of (LD) Limited Density is hereby changed to (COR) Commercial office Residental for the following described parcel of land, consisting of 7.8 acres, more or less: All of Blocks 1 and 2, together with right of way for Yucca Court lying adjacent to said Blocks 1 and 2, and that portion of Tract D lying South of Main Street of Sebastian Gardens Subdivision as recorded in Plat Book 5, page 58, public records of Indian River County, Florida; lying and being in Indian River County, Florida. SECTION III .Change in Comprehensive P. la.n.. De~si~nation - Parcel 3 The Comprehensive Land Use Plan Designation of County A- Agricultural is hereby changed to (MD) Multi-Family for the following described parcel of land, consisting of 12.58 acres, more or less: TRACT 1: Beginning at the NE corner of the SE 1/4 of Section 1, Township 31 South, Range 38 East, run S 0° 10' 42" W 663.5 feet; thence run S 89° 56' 51" W 589 feet; thence run N 0° 10' 42" E 656.64 feet; thence run N 89° 56' 51" E 580.80 feet to the point of beginning; EXCEPT, HOWEVER, the following property which has been conveyed by deed recorded in Deed Book 5, page 454, St. Lucie County records· to-wit: Begin at a point 4 and 52/100 chains South and 8 and 93/100 chains West of Northeast corner of Northeast 1/4 of Southeast 1/4, Section 1, Township 31 South, Range 38 East, run South 100 feet; thence East 100 feet; thence North 100 feet; thence West 100 feet to point of beginning; lying and being in Indian River County, Florida. TRACT 2: Commencing at the NE corner of the SE 1/4 of Section 1, Township 31 South, Range 38 East, run S 0° 10' 42" W 209 feet to point of beginning; thence run N 89° 56' 51" E 291 feet; thence run S 0° 10' 42" W 588 feet; thence run S 89° 56' 51" W 291 feet; thence run N 0° 10' 42" F 588 feet to the point of beginning; lying and being in Indian River County, Florida. SECTION IV This Ordinance shall become effective upon final passage. This Ordinance was read for the first time on the t~//~ day of ~, 1984, and was advertised in the [/~z.o ~ ~ ~ on the &~ day of , 1984, for a Public Hearing to be held on the ~/'~, day of · 1984, at which time it was passed by the City Council.
